Manohar, J.\n<\/p>\n<p>     The respondent,  Sarabjeet,  was  originally  the\tsub-<br \/>\ntenant of  one Damri  Lal, the\tpredecessor in\ttitle of the<br \/>\npresent appellants,  in respect of lands situated within the<br \/>\nlimits of  the Municipal  Board,  Bhadohi,  Tehsil  Gyanpur,<br \/>\nwhich are the subject matter of this appeal. These lands, at<br \/>\nall material  times, were  governed by the provisions of the<br \/>\nBanaras State Tenancy Act, 1949.\n<\/p>\n<p>     Damri Lal\thad brought  a suit being Suit No.46 of 1955<br \/>\nagainst the  respondent for ejectment of the respondent from<br \/>\nthe suit  lands under  Section\t154  of\t the  Banaras  State<br \/>\nTenancy Act,  1949,  in\t the  Court  of\t the  Sub-Divisional<br \/>\nOfficer, Bhadohi.  On 1.10.1955\t the parties compromised the<br \/>\nsuit  and   a  consent\tdecree\twas  accordingly  passed  on<br \/>\n4.11.1955. The\tcompromise which  is dated  1.10.1955 and is<br \/>\nsigned by  both the parties including the respondent, states<br \/>\nthat the  respondent relinquishes  his rights in the land in<br \/>\nfavour of  Damri Lal.  The respondent  who is  the defendant<br \/>\nthere, has stated: &#8220;I have no concern in the land in dispute<br \/>\nand the\t crops standing\t thereon from today&#8217;s date. A decree<br \/>\nin  favour   of\t the  plaintiff\t against  the  defendant  be<br \/>\npassed&#8230;&#8230;&#8230;&#8221; Accordingly a consent decree was passed.\n<\/p>\n<p>     According to  the\tappellants,  under  this  compromise<br \/>\ndecree possession  of the  said lands was surrendered by the<br \/>\nrespondent to  Damri Lal.  They\t further  contend  that\t the<br \/>\nrespondent interfered  with Damri  Lal&#8217;s possession  in July<br \/>\n1957. As  a result, proceedings were initiated under Section<br \/>\n145 of\tthe Criminal Procedure Code at the instance of Damri<br \/>\nLal. These  proceedings finally\t concluded on 30.3.1959. The<br \/>\nSub-Divisional Magistrate, Bhadohi, held that the respondent<br \/>\nwas  in\t  possession  of   the\tsaid  lands.  As  a  result,<br \/>\nimmediately thereafter\ton 12.4.1959,  a suit  was filed  by<br \/>\nDamri Lal under Section 159 of the Banaras State Tenancy Act<br \/>\nbefore the Revenue Court for ejectment of the respondent and<br \/>\nfor recovery  of possession. Damri Lal, however, died during<br \/>\nthe pendency  of the  suit and\tthe present  appellants were<br \/>\nbrought on  the record\tof the\tsuit in\t his place. The suit<br \/>\nremained stayed\t for several  years. Ultimately,  the  trial<br \/>\ncourt, by  its judgment and order dated 26.7.1969, held that<br \/>\nthe plaintiffs\t(appellants herein) were entitled to succeed<br \/>\nand passed a decree in their favour.\n<\/p>\n<p>     It was contended before the Revenue Court that the suit<br \/>\nwas barred  under Section  47 of  the Civil  Procedure\tCode<br \/>\nbecause the  proper remedy  was for  the appellants  to have<br \/>\nexecuted the  compromise decree\t which they  had obtained in<br \/>\nthe earlier  proceedings. A  separate suit  was barred. This<br \/>\ncontention was\tnegatived by  the trial\t court. It held that<br \/>\nthe appellants\twere dispossessed  after the  consent decree<br \/>\nand as a result of the order passed under Section 145 of the<br \/>\nCriminal Procedure  Code. Hence\t a fresh cause of action had<br \/>\naccrued to the plaintiffs and they were entitled to maintain<br \/>\nthe suit.\n<\/p>\n<p>     In\t the  meanwhile,  some\ttime  after  the  compromise<br \/>\ndecree, the respondent had filed Suit No.709 of 1956 against<br \/>\nDamri Lal in the Munsif&#8217;s Court at Gyanpur for setting aside<br \/>\nof the\tcompromise decree  on the ground of fraud. The trial<br \/>\ncourt held that the compromise was valid and binding between<br \/>\nthe parties and this conclusion was ultimately upheld by the<br \/>\nHigh Court  in its  judgment and  order dated 28.4.1967. The<br \/>\nattempt of  the respondent  to get  out\t of  the  compromise<br \/>\ndecree had,  thus failed.  It seems that in the interregnum,<br \/>\nhe  took   possession  of   the\t lands\t which\tresulted  in<br \/>\nproceedings under Section 145 of the Criminal Procedure Code<br \/>\nat the\tinstance of  Damri Lal.\t It was, however, held there<br \/>\nthat the  respondent was  in possession\t of the\t land.\tThis<br \/>\ncompelled  the\t appellants  to\t file  the  suit  which\t has<br \/>\nultimately come before us.\n<\/p>\n<p>     After the\tjudgment of the trial court dated 26.7.69 in<br \/>\nthat suit  decreeing the plaintiff&#8217;s suit for possession, an<br \/>\nappeal was filed by the respondent before the Addl. District<br \/>\nJudge at  Varanasi who\tallowed the appeal and set aside the<br \/>\ndecree passed  by the Revenue court. The District Court held<br \/>\nthat the  suit under  Section 159 of the Banaras Tenancy Act<br \/>\nwas barred  under Section 47 of the Civil Procedure Code. It<br \/>\nheld that although the respondent had surrendered his rights<br \/>\nover the  lands under the compromise decree, that decree was<br \/>\nnot executed. The respondent had not been dispossessed under<br \/>\nthe compromise\tdecree. The  remedy of\tthe appellant was to<br \/>\nexecute the  compromise decree.\t In Second  Appeal, the High<br \/>\nCourt has  confirmed this conclusion holding that in view of<br \/>\nthe provisions of Section 47 of the Civil Procedure Code the<br \/>\nsuit was not maintainable.\n<\/p>\n<p>     Both the courts below seem to have ignored the terms of<br \/>\nthe compromise\tdecree which records that the respondent has<br \/>\ngiven up  from that  day all  rights over the land including<br \/>\nthe standing  crops thereon  &#8211;\tclearly\t implying  that\t the<br \/>\npossession of  the land was given to Damri Lal from the date<br \/>\nof the\tcompromise. It\tis only\t on this basis that criminal<br \/>\nproceedings under Section 145 of the Criminal Procedure Code<br \/>\nat the\tinstance of  Damri Lal\tcan be understood. It was on<br \/>\naccount of  the dispossession  of Damri\t Lal some time after<br \/>\nthe compromise\tdecree that  it became\tnecessary for him to<br \/>\nresort to  proceedings under  Section 145  of  the  Criminal<br \/>\nProcedure Code. The respondent was at this time taking steps<br \/>\nto set\taside the compromise decree by filing a suit. As the<br \/>\nfindings in  the criminal  proceedings showed the respondent<br \/>\nin possession, the present suit was filed by Damri Lal.\n<\/p>\n<p>     On assessment of evidence, the trial court was right in<br \/>\ncoming\tto   the  conclusion   that  on\t  account   of\t the<br \/>\ndispossession of  Damri Lal  after the\tcompromise decree, a<br \/>\nfresh cause  of action\tarose in  his favour.  There was  no<br \/>\noccasion  for  Damri  Lal  to  have  the  compromise  decree<br \/>\nexecuted since\the was given possession under the compromise<br \/>\ndecree. It  was his dispossession thereafter which gave rise<br \/>\nto the\tnext round  of litigation.  Such litigation  is\t not<br \/>\nbarred under Section 47 of the Civil Procedure Code. Section<br \/>\n47 bars\t a  separate  suit  only  in  respect  of  questions<br \/>\nrelating to  the execution, discharge or satisfaction of the<br \/>\ndecree. If  there is  a subsequent  dispossession after\t the<br \/>\ndecree for  possession is  complied with,  a suit  to obtain<br \/>\npossession is not barred simply because there was an earlier<br \/>\ndecree obtained by the plaintiff for possession which decree<br \/>\nhad been complied with. In fact there will be no question of<br \/>\nexecuting the  earlier\tdecree\twhen  it  has  already\tbeen<br \/>\ncomplied with.\n<\/p>\n<p>     Under Section  159 of  the Banaras\t State Tenancy\tAct,<br \/>\n1949, a\t person taking\tpossession of a plot of land without<br \/>\nthe written  consent of\t the person entitled to admit him to<br \/>\noccupy his  plot and  otherwise than  in accordance with the<br \/>\nprovisions  of\tlaw,  is  liable  to  ejectment\t under\tthat<br \/>\nsection. The  present suit  was filed by the appellant under<br \/>\nSection 159 of the Banaras State Tenancy Act, 1949. The High<br \/>\nCourt was  not right  in  holding  that\t the  suit  was\t not<br \/>\nmaintainable.\n<\/p>\n<p>     Learned  Advocate\tfor  the  appellant  has  drawn\t our<br \/>\nattention to a decision of this Court in <a href=\"\/doc\/35944\/\">Brij Kishore Prasad<br \/>\nSingh and  Ors. v. Jaleshwar Prasad Singh and Ors. (AIR<\/a> 1973<br \/>\nSC 1130).  In that  case a  decree for\tpartition  had\tbeen<br \/>\nobtained by  the parties  on a\tcompromise. Certain property<br \/>\ncame to\t the share  of one Kishundeo Singh. But Defendants 1<br \/>\nand 2  had been\t allowed to  continue in possession with the<br \/>\npermission of  Kishundeo Singh,\t acknowledging the  title of<br \/>\nKishundeo Singh to this property. The partition deed was not<br \/>\ndrawn up  as the necessary stamp paper was not produced. The<br \/>\nCourt, in  a subsequent\t suit which  was filed\tby Kishundeo<br \/>\nSingh for Khas possession, held that the suit was not barred<br \/>\nby Section  47\tof  the\t Civil\tProcedure  Code.  Under\t the<br \/>\ncompromise, Kishundeo  Singh was  in constructive possession<br \/>\nof the property and his suit for recovery of Khas possession<br \/>\nwas not\t barred. The  present suit  is on a stronger footing<br \/>\nbecause under  the compromise  decree, possession was handed<br \/>\nover to\t Damri Lal,  of the  property in  question.  On\t his<br \/>\nsubsequent dispossession  Damri Lal  was entitled  to file a<br \/>\nsuit for  possession on\t the basis of the title which he had<br \/>\nacquired under\tthe compromise decree which has been held to<br \/>\nbe valid and binding between the parties.\n<\/p>\n<p>     The appeal\t is, therefore,\t allowed.
