Justice C.K.ABDUL REHIM\n\n Dated :17\/06\/2010\n\n O R D E R\n          PIUS C.KURIAKOSE &amp; C.K.ABDUL REHIM, JJ.\n                      ------------------------\n                     L.A.A.No. 487 OF 2010\n                      ------------------------\n\n              Dated this the 17th day of June, 2010\n\n                            JUDGMENT\n<\/pre>\n<p>Pius C.Kuriakose, J.\n<\/p>\n<p>      Under challenge in this appeal preferred by the claimant is<\/p>\n<p>the award of the Reference Court.           The case pertains to<\/p>\n<p>acquisition of land in      Pettah village    for the purpose of<\/p>\n<p>construction of the New International Passenger Terminal at<\/p>\n<p>Chackai. The Land Acquisition Officer awarded land value at the<\/p>\n<p>rate of Rs.74,105\/- per Are. The Reference Court would refix the<\/p>\n<p>land value at Rs.1,11,150\/- per Are.          We notice   various<\/p>\n<p>judgments of this Court pertaining to acquisition of land in the<\/p>\n<p>same village     for the same purpose pursuant to the same<\/p>\n<p>notification.  It is noticed enhancement by 90% over what was<\/p>\n<p>awarded by the Land Acquisition Officer has been generally<\/p>\n<p>approved in those cases. Keeping in mind that aspect, we allow<\/p>\n<p>the appeal to the extent of refixing the value of the land under<\/p>\n<p>acquisition at Rs.1,41,000\/- per Are.<\/p>\n<p>      2. The appeal is allowed as above. The appellant will be<\/p>\n<p>entitled for all statutory benefits admissible under Section 23<\/p>\n<p><span class=\"hidden_text\">L.A.A..No.487\/2010              2<\/span><\/p>\n<p>(2), 23(1A) and Section 28 of the Act on the total enhanced<\/p>\n<p>compensation to which    he becomes eligible by virtue of this<\/p>\n<p>judgment. However, on the consideration that causes should be<\/p>\n<p>allowed to be adjudicated as far as     possible on their merits<\/p>\n<p>rather than decided on technicalities, we are inclined to condone<\/p>\n<p>the delay imposing conditions.\n<\/p>\n<p>     2.    This application will stand allowed subject to the<\/p>\n<p>following conditions:\n<\/p>\n<blockquote><p>              i).The appellant   shall  pay a sum of<\/p>\n<p>         Rs.3000\/-(Rupees Three Thousand only) as<\/p>\n<p>         cost to the Government through the office of<\/p>\n<p>         the Advocate General within two weeks from<\/p>\n<p>         today and produce receipt before this court.<\/p>\n<\/blockquote>\n<blockquote><p>              ii).  The appellant shall pay a further<\/p>\n<p>         amount of Rs.2,000\/-(Rupees Two Thousand<\/p>\n<p>         only) to the High Court Legal Services<\/p>\n<p>         Committee within the same time limit and<\/p>\n<p>         produce receipt before this court.<\/p>\n<\/blockquote>\n<blockquote><p>              ii).
