M. SAHAI)<\/p>\n<p>1.\tWe<br \/>\nhave heard learned counsel Mr. B.B. Gogia for the appellant and Mr.<br \/>\nBhavesh P. Trivedi for respondent No.1.\n<\/p>\n<p>2.\tThis<br \/>\nLetters Patent Appeal has been filed  challenging order passed by<br \/>\nlearned Single Judge in Special<br \/>\nCivil Application No.531 of 2009, dated 27.1.2009 by which,<br \/>\nlearned Single Judge has directed the respondents to consider the<br \/>\ncase of the petitioner-appellant for regularisation as and when<br \/>\nvacancy occurs and, so far as minimum wage is concerned, the<br \/>\nappellant-petitioner may claim before the appropriate forum.\n<\/p>\n<p>3.\tThe<br \/>\nappellant was initially appointed in Navagadh Gram Panchayat, as a<br \/>\nLibrary Sanchalak on  part-time basis. It is admitted that he is only<br \/>\n7th Std. pass, whereas the qualification for Librarian is<br \/>\nGraduate in Library Science. Subsequently, Navagadh Gram Panchayat<br \/>\nwas merged in Jetpur Nagar Palika.  The appellant was taken into<br \/>\nservice by Jetpur Nagar Palika on the same terms and conditions on<br \/>\nwhich he was working in Navagadh Gram Panchayat. He was part-time<br \/>\nLibrary Sanchalak in Navagadh Gram Panchayat and he has been taken as<br \/>\nPart-time Library Sanchalak in Jetpur Nagar Palika.\n<\/p>\n<p>4.\tWhether<br \/>\na part-time Sanchalak could be regularised or not, or could be taken<br \/>\ninto consideration, this has to be considered while considering the<br \/>\nclaim of the petitioner-appellant by the respondents.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the appellant has placed reliance on a letter of<br \/>\nrespondent dated 21.1.2010.  This letter is not the subject matter of<br \/>\nchallenge in the present appeal, therefore, we are not inclined to<br \/>\nconsider this letter.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above, we are not inclined to interfere with the impugned<br \/>\norder passed by the learned Single Judge.
