Justice V.GIRI\n\n Dated :05\/06\/2009\n\n O R D E R\n                           V.GIRI,J.\n                     -------------------------\n                 W.P ( C) No. 6676 of 2009\n                    --------------------------\n               Dated this the 5th June,2009\n\n                      J U D G M E N T\n<\/pre>\n<p>     Petitioner borrowed an amount of Rs.1,50,000\/- from<\/p>\n<p>the 1st respondent by way of housing loan. EMI was fixed<\/p>\n<p>at Rs.2977\/-.  There was default in repayment of        the<\/p>\n<p>same. Bank initiated steps under the Securitisation and<\/p>\n<p>Reconstruction of Financial Asset and Enforcement of<\/p>\n<p>Security Interest Act, 2002 and Exhibit-P1 notice has<\/p>\n<p>been issued. According to the petitioner, he is willing to<\/p>\n<p>remit the entire amount due to the Bank provided he is<\/p>\n<p>given the benefit of One Time Settlement Scheme.<\/p>\n<p>Though OTS was offered to the petitioner, he could not<\/p>\n<p>avail the same. Now since the Bank has issued a notice<\/p>\n<p>under the Securitisation Act, it is up to the petitioner to<\/p>\n<p>avail the remedy available under the statute in relation to<\/p>\n<p>the proceedings under the Securitisation Act.        In the<\/p>\n<p>meanwhile, the Bank shall give a reply to the petitioner<\/p>\n<p>indicating whether it is willing to        accept the entire<\/p>\n<p>W.P ( C) No. 6676 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>amount for the purpose of closure of the loan. If it is not<\/p>\n<p>willing to do so, reason in respect of the same also should<\/p>\n<p>be indicated in the reply to be furnished to the petitioner<\/p>\n<p>by the Bank.
