Bhatt<br \/>\n\tfor respondent NO. 3. Learned Advocate Mr. Vibhuti Nanavati is<br \/>\n\tappearing for respondent NO.4.\n<\/p>\n<p>Claims<br \/>\n\tTribunal at Palanpur awarded amount of compensation of<br \/>\n\tRs.2,00,800.00 in favour of the respondent claimant by award dated<br \/>\n\t23rd November, 2007 in MACP No. 256 of 2000. Challenge in<br \/>\n\tthis appeal is to the extent of Rs.86,127\/-. Appeal is valued at<br \/>\n\tRs.86127.00 for the purpose of court fees. There is no challenge for<br \/>\n\tthe rest of the amount.\n<\/p>\n<p>This<br \/>\n\tcourt is aware about the fact that in first appeal, notice for final<br \/>\n\tdisposal was issued by this court by order dated 28.4.2008. But, ,<br \/>\n\tconsidering the pendency of many matters which are very old than the<br \/>\n\tpresent one, it is not possible for this Court to take up this<br \/>\n\tappeal for final disposal. Therefore, considering the submissions of<br \/>\n\tthe learned advocates for the parties, appeal is admitted.\n<\/p>\n<p>Ad<br \/>\n\tinterim relief in Civil Application No. 4523 of 2008 is granted by<br \/>\n\torder dated 28.4.2008 in terms of para 6(A) to the extent the amount<br \/>\n\tis under challenge in the appeal.  Therefore, learned advocate Mr.<br \/>\n\tThakkar for the appellant has submitted that most probably the rest<br \/>\n\tof the amounts must have been deposited by the insurance company<br \/>\n\tbefore the claims tribunal concerned. Therefore, in view of such a<br \/>\n\tstatement made by the learned Advocate Mr.Thakkar before this Court,<br \/>\n\tonly with a view to avoid the confusion, it is directed to the<br \/>\n\tinsurance company to deposit the entire amount as per award together<br \/>\n\twith costs and interest till date before the claims tribunal<br \/>\n\tconcerned within one month if it has not been deposited so far by<br \/>\n\tthe insurance company till date. Amount, if any, deposited by the<br \/>\n\tinsurance company in the registry of this Court be transmitted to<br \/>\n\tthe claims tribunal, if it has not been transmitted so far till<br \/>\n\tdate.\n<\/p>\n<p>After<br \/>\n\trealizing the aforesaid amounts by the claims tribunal, it is<br \/>\n\tdirected to the claims tribunal to disburse Rs.1,00,000.00 in the<br \/>\n\tname of claimant Gulabsing Lalsing Parmar (Rajput) by an account<br \/>\n\tpayee cheque drawn in his favour and rest of the amount is ordered<br \/>\n\tto be invested in any nationalized bank in FDR initially for a<br \/>\n\tperiod of five years which will be renewed thereafter from time to<br \/>\n\ttime with interest accrued thereon till the appeal is finally<br \/>\n\tdecided by this court. Though the FDR of the rest of the amount will<br \/>\n\tbe in the name of the claimant, the FDR shall remain in the safe<br \/>\n\tcustody of the Nazir of the Claims Tribunal concerned till the<br \/>\n\tappeal is finally decided by this Court. It is clarified that the<br \/>\n\tclaimant will not be entitled for any amount of interest accruing on<br \/>\n\tthe said FDR till the appeal is finally decided by this court. Rule<br \/>\n\tin this civil application is accordingly made absolute in terms in<br \/>\n\tterms indicated here in above.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Sunil Trivedi for learned Advocate Mr. Padhya for<br \/>\n\trespondent NO. 1 as well as learned advocate Mr. Shrikar Bhatt for<br \/>\n\trespondent NO. 3 waives notice of admission in  the appeal.
