No:1003 of 2003\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n            Dated this the 22nd day of November 2010\n\n                               O R D E R\n<\/pre>\n<p>      This Revision petition is filed by the accused in C.C. No.1371<\/p>\n<p>of 1996 on the file of Judicial First Class Magistrate Court,<\/p>\n<p>Perumbavoor challenging the conviction and sentence passed<\/p>\n<p>against him for the offence punishable under Section 138 of N.I.<\/p>\n<p>Act. The cheque amount was Rs.63,875\/-. In the Trial Court, the<\/p>\n<p>accused was sentenced to undergo simple imprisonment for three<\/p>\n<p>months and also to pay a fine of Rs.5,000\/-, in default to undergo<\/p>\n<p>simple imprisonment for two weeks.                   The appeal against that<\/p>\n<p>conviction and sentence was dismissed.\n<\/p>\n<p>      2. I heard the learned counsel for the revision petitioner,<\/p>\n<p>learned counsel for the complainant and the public prosecutor.<\/p>\n<p>      3. The learned counsel appearing for the revision petitioner<\/p>\n<p>reiterated the same contention raised before the Trial Court and the<\/p>\n<p>appellate court. Learned counsel for the complainant supported the<\/p>\n<p>judgment of the court below.\n<\/p>\n<p>Crl.R.P. No:1003 of 2003<br \/>\n<span class=\"hidden_text\">                                   :2:<\/span><\/p>\n<p>         4. The courts below have concurrently held that the cheque in<\/p>\n<p>   question was drawn by the petitioner in favour of the complainant,<\/p>\n<p>   that the complainant had validly complied with clauses (a) and (b)<\/p>\n<p>   of the proviso to Section 138 of the N.I. Act and that the Revision<\/p>\n<p>   petitioner\/accused failed to make the payment within 15 days of<\/p>\n<p>   receipt of the statutory notice. Both the courts have considered and<\/p>\n<p>   rejected the defence set up by the revision petitioner while entering<\/p>\n<p>   the conviction.    The said conviction has been recorded after a<\/p>\n<p>   careful evaluation of the oral and documentary evidence. I do not<\/p>\n<p>   find any error, illegality or impropriety in the conviction so<\/p>\n<p>   recorded concurrently by the courts below and the same is hereby<\/p>\n<p>   confirmed.\n<\/p>\n<p>         5. In the decision reported in <a href=\"\/doc\/1594211\/\">Damodar S. Prabhu v. Sayed<\/p>\n<p>   Babalal H<\/a> (2010(2) KHC 428 (SC)), it was held that in a case of<\/p>\n<p>   dishonour of cheques, compensatory aspect of the remedy should<\/p>\n<p>   be given priority over the punitive aspect. Considering the facts<\/p>\n<p>   and circumstances of the case, I am of the view that sentencing the<\/p>\n<p>   accused to pay a fine of Rs.64,000\/- would meet the ends of justice.<\/p>\n<p>Crl.R.P. No:1003 of 2003<br \/>\n<span class=\"hidden_text\">                                    :3:<\/span><\/p>\n<p>   The said fine shall be paid as compensation under Section 357(1)<\/p>\n<p>   of Cr.P.C. The Revision petitioner is permitted either to deposit the<\/p>\n<p>   said fine amount before the Court below or directly pay the<\/p>\n<p>   compensation to the complainant within three months from today<\/p>\n<p>   and to produce a memo to that effect before the Trial Court in case<\/p>\n<p>   of direct payment. If he fails to deposit or pay the said amount<\/p>\n<p>   within the aforesaid period, he shall suffer simple imprisonment for<\/p>\n<p>   three months by way of default sentence.         The amount if any<\/p>\n<p>   deposited in the trial court by the accused can be given credit to.<\/p>\n<p>         6.   In the result, this Revision petition is disposed of<\/p>\n<p>   confirming the conviction entered by modifying the sentence<\/p>\n<p>   imposed on the revision petitioner.\n<\/p>\n<\/p>\n<p>                                M.
