Earlier, the petitioner had come to this Court by<br \/>\nfiling Special Civil Application No.935 of 2009 which was disposed of<br \/>\nby this Court (Coram : Honourable Mr.Justice K.A.Puj) by order dated<br \/>\n 4.2.2009.\n<\/p>\n<p> The Court<br \/>\nwas pleased to observe as under.\n<\/p>\n<p>&#8220;Having<br \/>\n\theard learned advocate appearing for the petitioner and having<br \/>\n\tconsidered the averments made in the petition as well as draft<br \/>\n\tamendment and having considered the documents attached therewith,<br \/>\n\t the<br \/>\n\tCourt is of the view that since the representation is made by the<br \/>\n\tpetitioner to the respondent No.1 Corporation only<br \/>\n\ton  19.01.2009 ,<br \/>\n\twhich is under consideration by the Corporation, it is not just and<br \/>\n\tproper for this Court to issue any direction at this stage except to<br \/>\n\tdirect the respondent No.1 Corporation to decide the said<br \/>\n\trepresentation as early as possible.   Moreover,<br \/>\n\tthe respondent No.2<br \/>\n\thas filed suit against the respondent No.1 and if there is any<br \/>\n\tgrievance to the petitioner to the effect that the respondent No.1<br \/>\n\tCorporation is not taking any action by virtue of the said suit and<br \/>\n\tinjunction order also indirectly affects the petitioner, the<br \/>\n\tpetitioner can move an appropriate application to be joined as a<br \/>\n\tparty in the said suit and make appropriate representation in the<br \/>\n\tsaid suit.  Even against the respondent No.3, if any grievance is<br \/>\n\tthere, the petitioner can file separate suit against respondent<br \/>\n\tNo.3. Since all these avenues are open for the petitioner, this<br \/>\n\tCourt is not entertaining  this<br \/>\n\tpetition and if the petitioner so desirous, the petitioner can take<br \/>\n\tall these appropriate actions available to him under the law.<br \/>\n\t&#8221;\n<\/p>\n<p>\t(emphasis<br \/>\n\tsupplied).\n<\/p>\n<p>3.\t\tLearned<br \/>\nadvocate for the petitioner submitted that, thereafter, the<br \/>\npetitioner did file  an application in Regular Civil Suit No.105 of<br \/>\n2007 filed in the Court of Honourable Principal Senior Civil Judge,<br \/>\nHalol for being impleaded as party to the suit.  Learned advocate for<br \/>\nthe petitioner says that, the said application was rejected by Halol<br \/>\nCourt.\n<\/p>\n<p>3.1\t\tLearned<br \/>\nadvocate for the petitioner submitted that, thereafter, the plaintiff<br \/>\nof that suit (Regular Civil Suit No.105 of 2007) filed Misc. Civil<br \/>\nApplication No.880 of 2010 before learned District Court, Panchmahals<br \/>\nfor transfer of Regular Civil Suit No.105 of 2007 and the said<br \/>\napplication came to be allowed by learned Principal District Judge,<br \/>\nPanchmahals at Godhra by order dated 5.7.2010.\n<\/p>\n<p>3.2\t\tLearned<br \/>\nadvocate for the petitioner vehemently submitted that now that suit<br \/>\nhas been transferred from Halol Court to the District Court,<br \/>\nPanchmahals, the petitioner is rendered remediless in the matter of<br \/>\nrejection of his application for being impleaded as party.  Learned<br \/>\nadvocate for the petitioner also vehemently submitted that since the<br \/>\nsuit has been transferred from Halol Court to the District<br \/>\nCourt, Panchmahals, the orders issued by the Halol<br \/>\nCourt becomes nonest in the eye of law and, therefore, according to<br \/>\nthe learned advocate for the petitioner, today, there is no order<br \/>\nprohibiting respondent No.1 herein &#8211; GIDC, from implementing<br \/>\nits order dated 8.12.2005, still however, for the reasons best known<br \/>\nto the GIDC, it is not implementing that order.  Learned advocate for<br \/>\nthe petitioner submitted that, therefore, this is a fit case which<br \/>\nmust be entertained by this Court as the GIDC is not discharging its<br \/>\nduty which it is otherwise bound to discharge under the law.\n<\/p>\n<p>4.\t\tThe<br \/>\nCourt is not able to accept the submissions made by the learned<br \/>\nadvocate for the petitioner.  The Court does not agree to the<br \/>\nsubmission made by learned advocate for the petitioner that, &#8216;once<br \/>\nthe suit filed before the Halol Court gets transferred to the<br \/>\nDistrict Court, Panchmahals at Godhra, the petitioner is rendered<br \/>\nremediless against rejection of his application for being impleaded<br \/>\nas party to the suit&#8217;.\n<\/p>\n<p>4.1\t\tThe<br \/>\nCourt is also not able to accept the submission made by learned<br \/>\nadvocate for the petitioner that once the suit filed in the Court at<br \/>\nHalol is transferred to the District Court, Pachmahals, all orders<br \/>\npassed by the Halol Court come to an end automatically, meaning<br \/>\nthereby, they became nonest in the eye of law.   Taking these<br \/>\nsubmissions into consideration, this Court is of the opinion that the<br \/>\npresent petition is thoroughly misconceived and misdirected<br \/>\nand hence, it deserves to be dismissed with costs.  Filing of such<br \/>\npetition, more particularly, seeking enforcement of order dated<br \/>\n8.12.2005 against which first representation was filed by the<br \/>\npetitioner as is recorded by this Court in its order dated 4.2.2009<br \/>\nin Special Civil Application No.935 of 2009 on 19.1.2009 is nothing<br \/>\nbut &#8216;an exercise of twisting arm&#8217;.\n<\/p>\n<p>5.\t\tIt<br \/>\nwill be appropriate to mention herein that learned advocate for the<br \/>\npetitioner submitted that petitioner though titled as &#8216;Gujarat Wooden<br \/>\nIndustry&#8217;,<br \/>\na registered partnership firm is operating &#8216;Weigh Bridge&#8217; and<br \/>\nrespondent Nos.2 and 3 are also operating Weigh Bridge.  From the<br \/>\naforesaid facts, it can be understood that the petitioner is<br \/>\naggrieved by the competitive activities of respondent Nos.2 and 3.<br \/>\nIt was inquired from learned advocate as to under which provision of<br \/>\nlaw, it is legal for the petitioner to operate Weigh Bridge and<br \/>\nillegal for respondent Nos.2 and 3 to do the same thing.\n<\/p>\n<p>5.1\t\tLearned<br \/>\nadvocate could not explain the same.  Instead of that, he invited<br \/>\nattention of the Court to order dated 8.12.2005 wherein it is stated<br \/>\nthat, so far as respondent No.2 herein is concerned, it was held by<br \/>\nthe GIDC that, &#8216;it is not lawful to operate Weigh Bridge.&#8217; Be that as<br \/>\nit may,  this Court is of the firm opinion that the present petition<br \/>\nis filed only with a view to ventilate the personal grievance and<br \/>\nthat too after waiting for long 4 years, i.e. after the order was<br \/>\npassed by the GIDC on 8.12.2005, the<br \/>\nfirst representation was filed by the petitioner on 19.1.2009.\n<\/p>\n<p>6.\t\tThe<br \/>\npetition is dismissed with costs of Rs.15,000\/-.  It is clarified<br \/>\nthat deposit of this amount of costs with the Registry of this Court<br \/>\nshall be condition precedent for filing any further proceedings<br \/>\nbefore any Court including that of the District Court at Panchmahals.\n<\/p>\n<p>7.\t\tRegistry<br \/>\nis directed to send a copy of this order to the District Court,<br \/>\nPanchmahals at Godhra to be kept on file of Regular Civil Suit No.105<br \/>\nof 2007 filed in the Court of learned Principal Senior Civil Judge,<br \/>\nHalol which is transferred to District Court, Panchmahals at Godhra<br \/>\nby order dated 5.7.2010 in Misc.
