Sharma, J \n\n\n\n\n       Dated:01\/09\/2009\n\n\n:       Judgment\n\n                            ORDER\n<\/pre>\n<p>               (Passed on 1st September, 2009)<\/p>\n<p>1.    Quashment of the order dated 30-11-2004 passed  by  the<br \/>\n  1st  Additional  Sessions  Judge,  Mahasamund  in  Criminal<br \/>\n  Revision  No.148\/2004, modifying the order  dated  9-3-2004<br \/>\n  passed by the Judicial Magistrate First Class, Mahasamund, in<br \/>\n  Misc. Criminal Case No.11\/2002 under Section 125 of the Code<br \/>\n  of  Criminal  Procedure, 1973 (for short  `the  Code&#8217;),  by<br \/>\n  invoking the inherent jurisdiction under Section 482 of the<br \/>\n  Code  has been prayed by the petitioner, who is son of  the<br \/>\n  respondent.\n<\/p>\n<p>2.    Brief facts leading to filing of this petition are that<br \/>\n  the  petitioner, who is son of the respondent through first<br \/>\n  wife,  is  living  separately  from  the  respondent.   The<br \/>\n  respondent has filed an application under Section 125 of the<br \/>\n  Code against his son i.e. the petitioner for maintenance on<br \/>\n  the ground of his inability to maintain himself and willful<br \/>\n  neglect by the petitioner having sufficient means to maintain<br \/>\n  his  father.  The petitioner has filed detailed  reply  and<br \/>\n  alleged  that the respondent is having sufficient means  to<br \/>\n  maintain  himself, he is residing with his second son  born<br \/>\n  through his second wife who was having sufficient means  to<br \/>\n  maintain the respondent, but only with a view to harass him,<br \/>\n  the  respondent has filed application for maintenance.  The<br \/>\n  petitioner is not having sufficient means and the respondent<br \/>\n  is having sufficient means for his maintenance.\n<\/p>\n<p>3.    After  affording opportunity of hearing to the parties,<br \/>\n  learned  Judicial  Magistrate First Class,  Mahasamund  has<br \/>\n  awarded maintenance of Rs.500\/- per month to the respondent.<br \/>\n  Order of the Judicial Magistrate First Class was challenged<br \/>\n  in criminal revision and the said order was modified on the<br \/>\n  ground that both the sons of the respondent are liable  for<br \/>\n  maintenance  and the amount of maintenance was  reduced  to<br \/>\n  Rs.250\/- per month.\n<\/p>\n<p>4.    I  have  heard learned counsel for the parties, perused<br \/>\n  the order impugned and record of the Courts below.\n<\/p>\n<p>5.    Learned  Senior  Advocate appearing on  behalf  of  the<br \/>\n  petitioner  argued  that  the  petitioner  is  under  moral<br \/>\n  obligation  to  maintain his father and the petitioner  has<br \/>\n  categorically deposed in his statement that if  his  father<br \/>\n  will reside with him then he will maintain him even he will<br \/>\n  maintain his step-mother also and provide sufficient food &amp;<br \/>\n  other things to his father &amp; step-mother, but his father does<br \/>\n  not  want to reside with him and only with a view to harass<br \/>\n  him,  his  father  has filed application  for  maintenance.<br \/>\n  Learned  Senior Advocate further argued that the respondent<br \/>\n  has  partitioned his land, area comprising of  10.05  acres<br \/>\n  which was recorded in the name of the respondent, presently<br \/>\n  more than 4 acres of land is in possession of second son of<br \/>\n  the  respondent,  about 4-5 acres of  land  has  also  been<br \/>\n  purchased by the respondent in the name of the wife of  his<br \/>\n  second  son,  1.5  acres of land is in  possession  of  the<br \/>\n  respondent along with his second son and virtually about 10<br \/>\n  acres  of land is in possession the respondent &amp; his second<br \/>\n  son  which is sufficient for maintenance of the respondent,<br \/>\n  his  wife,  his second son &amp; family of second  son  of  the<br \/>\n  respondent.  Learned Senior Advocate placed reliance in the<br \/>\n  matter of <a href=\"\/doc\/1720873\/\">Chaturbhuj v. Sita Bai1<\/a> in which it has been held<br \/>\n  by the Apex Court that deserted wife earning some income does<br \/>\n  not disentitle her from claim of maintenance and the income<br \/>\n  not sufficient to maintain herself still makes her unable to<br \/>\n  maintain  herself.  Learned Senior Advocate further  placed<br \/>\n  reliance in the matter of Ram Dew Shah and another v. Jagan<br \/>\n  Nath  Shah2 in which the Gauhati High Court has  held  that<br \/>\n  claim  of  aged  father for maintenance  allowance  by  the<br \/>\n  children  having sufficient means, father having source  of<br \/>\n  income from rented house, his second wife also working person<br \/>\n  and father being able to maintain himself, there is no point<br \/>\n  to ask for maintenance.\n<\/p>\n<p>6.    On  the  other hand, learned counsel for the respondent<br \/>\n  opposed the petition and submitted that the petitioner is son<br \/>\n  of the respondent and he is under obligation to maintain his<br \/>\n  father  who is unable to maintain himself.  Although second<br \/>\n  son  of the respondent is also having land, but it does not<br \/>\nabsolve  the  petitioner  from  maintenance  of  his  father.<br \/>\n  Learned counsel further submits that only meager and  token<br \/>\n  amount  of  Rs.250\/-  per month has  been  awarded  to  the<br \/>\n  respondent against the petitioner, therefore, the petitioner<br \/>\n  has  utterly failed to make out a case for quashment of the<br \/>\n  order  impugned  in terms of Section 482 of  the  Code  for<br \/>\n  invoking the inherent jurisdiction.\n<\/p>\n<p>7.    Factual  matrix  of the case on the basis  of  evidence<br \/>\n  adduced on behalf of the parties reveal that the respondent,<br \/>\n  father  of the petitioner, has partitioned his land between<br \/>\n  his  two  sons  including the petitioner, himself  and  his<br \/>\n  daughters.  The respondent has retained only 1 +  acres  of<br \/>\n  land  for  himself and has partitioned the  remaining  land<br \/>\n  between  his  both sons equally and both the  sons  are  in<br \/>\n  possession of about 4 acres of land each.  Second son of the<br \/>\n  respondent from his second wife is also having lands, he is<br \/>\n  in possession of the land which he has received on partition<br \/>\n  and another 4 acres of land which has been purchased in the<br \/>\n  name  of  his  wife.   This shows that second  son  of  the<br \/>\n  respondent is having sufficient property.  This is not  the<br \/>\n  case in which the petitioner is not having sufficient means.<br \/>\n  The respondent is the person who has given 4 acres of land to<br \/>\n  the  petitioner on partition.  The respondent  himself  has<br \/>\n  retained only 1 + acres of land.  This shows the bona  fide<br \/>\n  partition made by the respondent who has retained only 1  +<br \/>\n  acres of land for himself.\n<\/p>\n<p>8.     After  appreciating  the  evidence,  learned  Judicial<br \/>\n  Magistrate First Class has awarded only Rs.500\/- per month to<br \/>\n  the respondent which has been reduced to Rs.250\/- per month<br \/>\n  by  the  revisional  Court.  It is not  disputed  that  the<br \/>\n  petitioner is not under obligation to maintain his  father.<br \/>\n  Taking  into  consideration  the  meager\/token  amount   of<br \/>\n  maintenance of Rs.250\/- per month awarded against the son who<br \/>\n  is  in  possession  of 4 acres of land  obtained  from  the<br \/>\n  respondent  on  partition, I do  not  find  any  scope  for<br \/>\n  interference with the order impugned.\n<\/p>\n<p>9.
