The Tribunal has awarded\n\ncc5mdpensati\u00a2r;cii~ o:f'l2s.1,;l'1','426\/-- with interest at 6% per\n\n   of petition till the date of payment.\n\n1' \",3.HAggrieVed\"'\u00abby  appellant has filed this appeal, seeking\n\n4\"enhanc.ement;\"\n\nL2\n\n\n\n5. The learned counsel for the appellant contended\n\nthat the compensation awarded by the Tribunal towards pain\n\nand sufferings, loss of amenities of life and incidental\n\nexpenses is totally inadequate. He therefore,  .\n\nthe impugned judgement and award ne_ed.s_ to be    it \n\n6. As against this, the leameld cQ'_t11iVse:1'~fo1'_:'the \n\nrespondent submitted that,  Tribnnalpp:e~.on_:\"\"\"'proper \" it<\/pre>\n
consideration of the material, on reeer,d’,.ha.s awardedjust and
\nreasonable compensation  not call for<\/p>\n
interference.\n<\/p>\n
7.  -_ha,\\wr’e7.is-arefu’i1\u00a7”aconsidered the submissions
\nmade by the learned coudridsein\ufb01gr\u00e9the parties.\n<\/p>\n

V.\n<\/p>\n<\/p>\n
9. It is relevant to note, the Tribunal has awarded a
\nsum of Rs.40,000\/– towards pain and sufferings. g”-.._’p1’he<\/p>\n
appellant has sustained the following injuries:-<\/p>\n
[i] A lacerated wound measuring ll\/2″,     <\/p>\n
on the right eyebrow,<\/p>\n
[ii] Fracture over the frontal bonel’–nearg,ltI!li1e “oi’bitl’or1VF,<\/p>\n
the right and\n<\/p>\n
(iii) A lacerated wourid  1\/2  on the<\/p>\n
right eye.\n<\/p>\n
The appellant  –asfinpatient for a period of
\n19 days. The inju.ries:”-hpai.re”resulted in permanent disability
\nto the brain   Tribunal has awarded a sum
\nof, x to.ward_s___vpain and sufferings, which is<\/p>\n
inadequat.e.  regard to the nature of injuries, duration<\/p>\n
 nature of treatment, in our considered view, a sum of<\/p>\n
 would be a reasonable surn towards pain and<\/p>\n
“and accordingly, it is awarded.<\/p>\n

10. The Tribunal has awarded a sum of Rs.56,\u00e9l-26\/–<\/p>\n
towards medical expenses, attendant charges._l:’-kind<\/p>\n
conveyance. The appellant has taken treatmentas  ~<\/p>\n
for a period of 19 days and has produc\u00bbed..rnediclall’  ll’<\/p>\n
tune of Rs.54,526\/–. Therefore, it is  to  .<\/p>\n
Rs.60,0O0\/– towards medical V    and” T<\/p>\n
attendant charges and acco’rdingly’,”‘itlis a’W.arded.”–.. <\/p>\n
11. The Tribunal   Rs.25,000\/c
\ntowards loss of   has suffered
\ninjury to his I7ihg”l””l”~L..’_::.lE$:”:{1′.;:.:”    frontal bone and it
\nhas resulted in  of 10% in respect of the
\nbrain functioning  the right eye. The appellant
\nto s_nTfer_ldiscornfort_throughout his life. The Tribunal has<\/p>\n
 of Rs.25,000\/– towards disability and<\/p>\n
 .cliscorrlfort,  inadequate. Having regard to the nature<\/p>\n
ldipsabilitypland discomfort, the appellant has to suffer, in our<\/p>\n
 view, a sum of Rs.50,000\/– would be a reasonable<\/p>\n
li\/\/<\/p>\n
sum towards loss of amenities of life and accordingly, it is<\/p>\n
awarded .\n<\/p>\n
14. The compensation awarded by the <\/p>\n
