  is vtrorki\u00e9ngv\u00abavs.’j_’,i\u00a7.tlditional Superintendent of Police (non–<\/p>\n
 I95), Duepartmvent of Police, Karwar District. The applicant<\/p>\n
 wlasAVVtra.nsferred to the present place from Davanagere by<\/p>\n
 dated 24.07.2008 and he reported to duty in the<\/p>\n
  ‘dpresent place of work on 28.07.2008. Within three months<\/p>\n

an<\/p>\n
of reporting for duty at Karwar, the first respondent –<\/p>\n
State of Karnataka has issued the order dated 23.10.2008<\/p>\n
transferring the applicant to the office of the <\/p>\n
Bangalore and in turn, transferred the St” respo,n’d’e–n’t–…i:ri. <\/p>\n
the application (writ petitioner) in place of  at ”  <\/p>\n
Karwar. Being aggrieved by the said <\/p>\n
application No.5213\/2008 was\u00bbr’fil_ed conftendirtgi’that: <\/p>\n
said order of transfer was notH0’i’n:’accordantewith the
\nguidelines issued for the’cu’t–ren–t a\u00a7:avdemic”year and it was
\nnot preceded by the proceediings  if:\u00bbhe\u00b0Ca’d:Vr;e– ivlanagernent<\/p>\n
Authority and sa._ifne:;1iwas.p’renjature..:v*fh’e–applicant sought
\nfor quasfi_ing_  transfer dated 23.10.2008<\/p>\n
issued by thefirst  null and void in so far as<\/p>\n

  said application was resisted by the<\/p>\n

 and was in the interest of administrative exigency<\/p>\n

4, On 31.10.2008, the KAT, after hearing both<\/p>\n
the Appiicant and the Caveator, passed an interim_4vo.rd-ef’r~.._V<\/p>\n
of stay staying the operation of the <\/p>\n
23.10.2008 in so far as it relates to htlfieappi_.i’ca’rit:andsthe 0′ <\/p>\n
fifth respondent in the Application.\n<\/p>\n
5. Being aggrieyed   interim

  up for final hearing. During the course of hearing,<\/p>\n

it was brought to the notice of the KAT by the Government<\/p>\n
Pleader that bye–elections were declared at Karwar and<\/p>\n
Principal Secretary, Home Department, has req_crest’ed’.i’e:’to’ <\/p>\n
transfer the Appiicant in View of the_gene’ral”‘*poel.icy   <\/p>\n
eiection of Election Commission of I”ndiai”as the “Ap’pl’icant.’~:\u00bb::ii_’<\/p>\n
hails from Uttara Kannada Districtwwith “Anix<oE.a as"'hvis~\u00abh.ome<\/p>\n
town.\n<\/p>\n
7. On 04.12.2008.,_i<AT, after hearing tl*'1'e-"parties<\/p>\n
and in view of the parties passed an<\/p>\n
interim order as ifoliows:\n<\/p>\n
 The agreed upon by the

\n transfer guidelines dated 22.11.2001 and<\/p>\n

12. Learned counsel appearing for the petitioner
\nsubmitted that the impugned order passed by the KAT is<\/p>\n
not in accordance with law and the KAT couid not have<\/p>\n
interfered with the order of transfer, which had.f”b.een”‘–,_<\/p>\n
passed in the interest of exigency of ser’Jice4’:’n”a’nd<\/p>\n
wherefore, the order passed by the \u00a5_(,A.T,__is iiahl’e”  <\/p>\n
aside.\n<\/p>\n
13. Learned counsel ap.pea.rirrg_n for “‘respo\u00a7ndent
\nNo.5 argued in support of–Vthe”ord,e;r by the KAT.<\/p>\n
  -A Government Advocate<\/p>\n
appearing \u00abfor__ respon’der:\u00abts”‘_.\u00bbi.:t’Ato 4 submitted that the<\/p>\n
.__impuggne’d’ order”‘is.._VVjustinfied and the petitioner is given<\/p>\n
 atV’>’EAanng’aio_re as he was awaiting posting.<\/p>\n
 have given careful consideration to the<\/p>\n
it’Al.’ii\u00e9cdntentions’ of the learned counsel appearing for the<\/p>\n
parties and scrutinized the rnateria} on record.<\/p>\n

16. The material on record would clearly show that<\/p>\n
the Applicant before the KAT (respondent No.5 herein)._w\u00aba_s~..vv<\/p>\n
working in Davanagere as Additional SuperintendentfoiT.-.2’~-<\/p>\n
Police (non IPS) and he was transferredy_’to Ka’rwar;;.i)tta’_ra  <\/p>\n
Kannada District, by order of transfer<\/p>\n
and he took charge of the said ‘p:_ostzon “2’8.:CJ7.2i}ti’8~\u00bb.iavn.deVetiie A<\/p>\n
impugned order of transferAp_.._l:h:as_ aideeri’  on
\n23.10.2008 i.e., within   date of the
\nApplicant assuming char:g’e”etf’: material on
\nrecord would  iolflllthe Applicant to
\nthe office by order dated
\n23.10.2003  within three months from<\/p>\n
the date of his iiposltinguat ithe\u00e9\u00e9present post i.e., Karwar by<\/p>\n
” _VVorderVdlated 24.O7.V_2DlO8V:and the same was not preceded<\/p>\n
 the  of’\u00ab-tvhe Cadrei\/ianagement Authority. Having<\/p>\n
ve’i’i_fie.d_\u00ab1tlhe”‘_~o_ridjn’al records, the KAT has held that the<\/p>\n
 _orderl'”of ti–%ansf’er dated 23.10.2008 is iiiegai and cannot be<\/p>\n
Hit’it’~u’s.i.t:sttai.ned””as it is contrary to the guidelines issued for<\/p>\n
 of officiais in the Department of Police and<\/p>\n
A -i.i:pr’en1ature transfer of the Applicant was not preceded by<\/p>\n
the order of the Cadre Management Authority and<\/p>\n
\\\u00a7><\/p>\n

\nwherefore, the KAT by order dated 20.03.2009, allowed<\/p>\n
the Applications filed by the fifth respondent herein and<\/p>\n
has set aside the orders dated 23.10.2008 and  V.<\/p>\n
passed by the first respondent.\n<\/p>\n
16.1 Having regard to the abo.ve_4sai_d””fa’ct.$,’V”it’dis  <\/p>\n
clear that the fifth respondent herein”:.had_’_’ iassuiirnedifchiafrkgeg”*1:’<\/p>\n
as Additional Superintendent’V__:0f.x Police, .
\n28.07.2008 and the ;__irnpug4An_edf._order.”  transfer
\ntransferring the fifth respondent. of the
\nCOD, Bangalore, iegassed’ it was a<\/p>\n
premature tr–ansfer,as.n::dt c’on:tra.ry to the transfer guidelines<\/p>\n
dated 22.1.’t;’24001v  was not preceded by the<\/p>\n
order V0_’E’t”.h\u20ac2 Cadre\ufb02ianagement Authority. Therefore, the<\/p>\n
_V.\u00bb”rilgyhtly..V’held that the order of transfer dated<\/p>\n
23″.10’f.l2i00si”‘ioaptligoed in Application No.5213\/2008 could<\/p>\n
‘not  s–usta’i”ned. The KAT further held that the<\/p>\n
…..,’i,”‘5;;’v:bseguenf0order of transfer impugned in Application<\/p>\n
‘.”gl’\u00a7lo’.~\u00a2li5\/22009 dated 16.01.2009 is also liable to be set<\/p>\n
A fasiide. It is well settled that the Tribunal or this Court<\/p>\n
\u00e9lwouid be slow to interfere with the order of transfer and<\/p>\n

only in cases, where the order of transfer is without<\/p>\n
jurisdiction or is motivated by ma\ufb01a ride, the Tribunal:”ob.r’~i.Vv<\/p>\n
this Court would not hesitate to set aside  <\/p>\n
transfer. in the present case, the order_of tiansfeii ,of=:the 04 <\/p>\n
Applicant before the KAT (respondent N103  <\/p>\n
