ANJANA PRAKASH<\/p>\n<p>Anjana                The appellant nos.1 and 2 have been convicted<br \/>\nPrakash, J:\n<\/p>\n<blockquote><p>              u\/s.324 I.P.C. and sentenced to R.I. for one year, whereas<\/p>\n<p>              appellant nos.3 and 4 have been convicted u\/s.323 I.P.C. and<\/p>\n<p>              sentenced to R.I. for six months by a judgment dated 31.8.1994<\/p>\n<p>              passed by the Sessions Judge, Saran, Chapra in Sessions Trial<\/p>\n<p>              No.24 of 1994.\n<\/p><\/blockquote>\n<blockquote><p>                      2. The case of the prosecution is that on 4.12.1993 on<\/p>\n<p>              account of an earlier dispute between the accused they abused<\/p>\n<p>              the informant and thereafter the appellant nos.1 and 2 armed<\/p>\n<p>              with chhura and appellant nos.3 and 4 armed with lathies came<\/p>\n<p>              to his door and assaulted the informant.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                           -2-<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                          3. During trial the prosecution has examined seven<\/p>\n<p>               witnesses in all. Out of whom, P.W.5 is the informant, whereas<\/p>\n<p>               P.W.1 is his father and P.W.2, P.W.3 and P.W.4 have deposed<\/p>\n<p>               as eye witnesses. P.W.6 is the doctor, who had examined the<\/p>\n<p>               injured, whereas P.W.7 is the Investigating Officer.<\/p>\n<\/blockquote>\n<blockquote><p>                          4. Initially the appellants were charged u\/s.307\/34<\/p>\n<p>               I.P.C. but they were acquitted of the charges since the Trial<\/p>\n<p>               Court was of the view that the injuries have not been inflicted<\/p>\n<p>               for causing the death of the informant and were convicted as<\/p>\n<p>               mentioned above.\n<\/p><\/blockquote>\n<blockquote><p>                          5. On going through the evidence of the eye witnesses<\/p>\n<p>               as well as the doctor and the Investigating Officer, I find that the<\/p>\n<p>               prosecution has been successful in proving its case beyond all<\/p>\n<p>               reasonable doubt, even though minor discrepancies had been<\/p>\n<p>               found by the doctor with nature of injuries.<\/p>\n<\/blockquote>\n<blockquote><p>                          6.
