Baghel, Deputy\nState                           Government Advocate.\n                         ORDER\n<\/pre>\n<p>                        (18\/06\/2009)<\/p>\n<p>     The applicant has filed this petition under section 482 of<\/p>\n<p>Cr.P.C for the quashment of criminal proceedings pending<\/p>\n<p>before IInd Additional Sessions Judge, Katni in S.T. No. 38\/05<\/p>\n<p>for the offence punishable under section 306\/34 of IPC arising<\/p>\n<p>out of the crime no. 574\/04 registered at police station Katni.<\/p>\n<p>2.   In brief the prosecution case is that on 21\/09\/04 at Katni<\/p>\n<p>Civil Line, five persons namely Kishori Lal Gupta, Maya Bai<\/p>\n<p>w\/o Kishori Lal, Monika D\/o Kishori Lal, Renuka D\/o Kishori<\/p>\n<p>Lal and Mayank S\/o Kishori Lal committed suicide by<\/p>\n<p>consuming some poisonous substance.            The matter was<br \/>\n                    Page numbers              M.Cr.C. No. 4705\/2009<\/p>\n<p>reported to the police station Katni on which basis a merg was<\/p>\n<p>recorded. During inquiry of merg it was found that these five<\/p>\n<p>persons died by consuming some poisonous substance and<\/p>\n<p>their visras were sent for chemical examination to the<\/p>\n<p>Forensic Science Laboratory. During investigation, a suicidal<\/p>\n<p>note, alleged to be written by deceased Kishori Lal has was<\/p>\n<p>seized where it is alleged that due to the recovery<\/p>\n<p>proceedings initiated by Oriental Commerce Bank for the<\/p>\n<p>recovery of loan amount which he has taken from the bank<\/p>\n<p>concerned, in that recovery proceedings his house was<\/p>\n<p>wrongly auctioned by the recovery officer Nahida Khatoon,<\/p>\n<p>Naib Tahsildar. It is further alleged that the other co-accused<\/p>\n<p>as well as applicant Asha Singh Gaharwar have insulted him<\/p>\n<p>with regard to the aforesaid recovery proceedings initiated by<\/p>\n<p>recovery officer hence, Kishorilal and his family members<\/p>\n<p>have committed suicide. On the basis of suicidal note, police<\/p>\n<p>has registered a case under section 306 of IPC against the<\/p>\n<p>applicant   and   other   co-accused   persons.     After    due<\/p>\n<p>investigation, a charge sheet has been filed which is pending<br \/>\n                    Page numbers                M.Cr.C. No. 4705\/2009<\/p>\n<p>presently before the Additional Sessions Judge, Katni.<\/p>\n<p>Aggrieved by the aforesaid charge sheet, this petition under<\/p>\n<p>section 482 of the Cr.P.C has been filed for quashment of<\/p>\n<p>criminal proceedings initiated by the police station Katni.<\/p>\n<p>3.   It is submitted by learned counsel for the applicant that<\/p>\n<p>this Court in M.Cr.C. Nos. 8451\/2005, 8453\/2005 and<\/p>\n<p>1336\/2006 has already quashed the proceedings against<\/p>\n<p>other co-accused namely Suresh Kumar Gupta, Prakash and<\/p>\n<p>Satyapal Grover and thus, the criminal proceedings against<\/p>\n<p>the present applicant should also be quashed on similar<\/p>\n<p>grounds.\n<\/p>\n<p>4.   Having heard learned counsel for the applicant as well<\/p>\n<p>as the Government Advocate for the State.<\/p>\n<p>5.   Learned counsel for the applicant Shri Tiwari submits<\/p>\n<p>that there is not an iota of evidence on record on which basis<\/p>\n<p>the necessary ingredients for the offence punishable u\/s 306<\/p>\n<p>of IPC is made out against the applicant. Learned counsel<\/p>\n<p>further argued that in M.Cr.C. No. 8451\/2005 proceedings<\/p>\n<p>against other four accused persons have already been<br \/>\n                      Page numbers              M.Cr.C. No. 4705\/2009<\/p>\n<p>quashed and applicant has similar case as of other co-<\/p>\n<p>accused.\n<\/p>\n<p>6.   In order to implicate a person under Section 306\/34 of<\/p>\n<p>IPC there should be some material against the said persons<\/p>\n<p>that they have abetted the deceased to commit suicide. The<\/p>\n<p>term &#8220;Abetted of a thing&#8221; has been defined in Section 107, IPC<\/p>\n<p>which reads thus :\n<\/p>\n<blockquote><p>           &#8220;107. Abetment of a thing :- A person abets<br \/>\n           the doing of a thing; or<br \/>\n                 First &#8211; Instigates any person to do that<br \/>\n           things; or<br \/>\n                 Secondly &#8211; engages with one or more<br \/>\n           other person or persons in any conspiracy for<br \/>\n           the doing of that thing, if an act or illegal<br \/>\n           omission takes place in pursuance of that<br \/>\n           conspiracy, and in order to the doing of that<br \/>\n           thing; or<br \/>\n                 Thirdly &#8211; intentionally aids, by any act or<br \/>\n           illegal omission, the doing of that thing.\n<\/p><\/blockquote>\n<blockquote><p>                 Explanation 1- A person who, by wilful<br \/>\n           misrepresentation, or by concealment of a<br \/>\n           material fact which he is bound to disclose,<br \/>\n           voluntarily causes or procures, or attempts to<br \/>\n           cause or procure, a thing to be done, is said<br \/>\n           to instigate the doing of that thing.\n<\/p><\/blockquote>\n<blockquote><p>                 Explanation 2- Whoever, either prior to<br \/>\n           or at the time of the commission of offence of<br \/>\n           an act, does anything in order to facilitates the<br \/>\n           common of that act, and thereby facilitates the<br \/>\n                    Page numbers                  M.Cr.C. No. 4705\/2009<\/p>\n<p>          commission thereof, is said to aid the doing of<br \/>\n          that act.&#8221;\n<\/p><\/blockquote>\n<p>7.   If the provisions of Section 107 IPC is read in<\/p>\n<p>juxtaposition of the material available on record, it would<\/p>\n<p>reveal that the entire emphasis has been putforth by the<\/p>\n<p>prosecution   against    the      present   applicants    are    that<\/p>\n<p>deceased&#8217;s wife Sapna was not prepared to live with him<\/p>\n<p>therefore, deceased has committed the suicide.<\/p>\n<p>8.   By taking the shelter under the umbrella of           following<\/p>\n<p>decisions of the Apex Court, learned counsel for the<\/p>\n<p>applicants has placed reliance on these authorities :-<\/p>\n<p>     8-<a href=\"\/doc\/337402\/\">I. In State of West Bengal vs. Orilal Jaiswal and<\/a><\/p>\n<p>another AIR 1994 SC 1418             dealing with offence under<\/p>\n<p>section 306\/34 IPC the Apex Court held as under:<\/p>\n<blockquote><p>              &#8220;The Court should be extremely careful<br \/>\n       in assessing the facts and circumstances of<br \/>\n       each case and the evidence adduced in the<br \/>\n       trial for the purpose of finding whether the<br \/>\n       cruelty meted out to the victim had in fact<br \/>\n       induced her to end the life by committing<br \/>\n       suicide. It is transpires to the Court that a<br \/>\n       victim committing suicide was hyper sensitive<br \/>\n       to ordinary petulance dischord and difference<br \/>\n       in domestic life quite common to the society<br \/>\n       to which the victim belonged and such<br \/>\n       petulance dischord and difference were not<br \/>\n       expected to induce a similarly circumstanced<br \/>\n       individual in a given society to commit<br \/>\n       suicide, the conscience of the Court should<br \/>\n       not be satisfied for basing a finding that the<br \/>\n                      Page numbers                M.Cr.C. No. 4705\/2009<\/p>\n<p>       accused charged of abetting the offence of<br \/>\n       suicide should be found guilty.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     8-II.      In     Padmabai     v.   State    of    MP     1987<\/p>\n<p>Cri.L.J.1573 it has been held:\n<\/p><\/blockquote>\n<blockquote><p>             &#8220;It is of the essence of the crime of<br \/>\n       abetment of suicide that the abettor<br \/>\n       should be proved to have substantially<br \/>\n       assisted in a commission of the offence<br \/>\n       of           suicide.          Investigation,<br \/>\n       incitement,provocation,encouragement,<br \/>\n       insinuation, solicitation, which words<br \/>\n       connote different meanings are, no<br \/>\n       doubt, some of the acts, which may<br \/>\n       constitute an &#8216;abetment&#8217; for commission<br \/>\n       of suicide. But all such acts or any of<br \/>\n       them have to be positive and potent in<br \/>\n       nature, of such a degree, that the direct<br \/>\n       result of such acts may be none other,<br \/>\n       but the commission of suicide.\n<\/p><\/blockquote>\n<blockquote><p>             Stray         domestic       quarrels,<br \/>\n       perfunctory abuses by mother-in-law, to<br \/>\n       her daughter-in-law in the Indian Society,<br \/>\n       crude and uncultured behaviour by the<br \/>\n       &#8216;in-laws&#8217; or the husband towards his wife<br \/>\n       being mundane matters of normal<br \/>\n       occurrence in the traditional joint Hindu<br \/>\n       families, will not go to form and constitute<br \/>\n       &#8216;abetment&#8217; unless these acts or conduct<br \/>\n       singly or cumulatively, are found to be of<br \/>\n       such formidable and compelling nature<br \/>\n       as may lead to the commission of suicide<br \/>\n       or may facilitate in a singular and prime<br \/>\n       manner, the commission of the same.&#8221;<\/p><\/blockquote>\n<p>     8-<a href=\"\/doc\/62469467\/\">III.     In Mahendra Singh vs. State of MP<\/a> 1995<\/p>\n<p>Supp.(3)SCC 731 the appellant was charged for an offence<br \/>\n                     Page numbers            M.Cr.C. No. 4705\/2009<\/p>\n<p>under Section306\/34 IPC basically based upon the dying<\/p>\n<p>declaration of the deceased, which reads as under:<\/p>\n<blockquote><p>            &#8220;My mother-in-law and husband and<br \/>\n      sister-in-law (husband&#8217;s elder brother&#8217;s wife)<br \/>\n      harassed me. They beat me and abused me.<br \/>\n      My husband Mahendra wants to marry a<br \/>\n      second time. He has illicit connections with my<br \/>\n      sister-in-law. Because of these reason and<br \/>\n      being harassed I want to die by burning.&#8221;<\/p><\/blockquote>\n<p>     Hon&#8217;ble Apex Court considering the definition of<\/p>\n<p>&#8216;abetment&#8217; u\/s 107 IPC found that the charge and conviction of<\/p>\n<p>the appellant for an offence u\/s 306\/34 is not sustainable<\/p>\n<p>merely on the allegation of harassment to the deceased.<\/p>\n<p>Because none of the ingredients of abetment are attracted on<\/p>\n<p>the statement of deceased.\n<\/p>\n<p>     8-IV.      In Ramesh Kumar v. State of Chhatisgarh<\/p>\n<p>2001(9) SCC 618 Apex Court while considering the charge<\/p>\n<p>and conviction for an offence u\/s 306\/34 IPC on the basis of<\/p>\n<p>dying declaration recorded by an Executive Magistrate were<\/p>\n<p>she stated that previously there had been quarrel between the<\/p>\n<p>deceased and her husband and on the day of occurrence she<\/p>\n<p>had a quarrel with her husband who had said that she could<\/p>\n<p>go anywhere she wanted to go and thereafter she had poured<\/p>\n<p>kerosene on herself and had set fire. Acquitting the accused<\/p>\n<p>Apex Court held :\n<\/p>\n<blockquote><p>          &#8221; A word uttered in a fit of anger or<br \/>\n     emotion without intending the consequences<br \/>\n     to actually follow can not be said to be<br \/>\n                    Page numbers                  M.Cr.C. No. 4705\/2009<\/p>\n<p>      instigation. If it transpires to the court that a<br \/>\n      victim committing suicide was hypersensitive<br \/>\n      or    ordinary       petulance,    discord   and<br \/>\n      differences in domestic life quite common to<br \/>\n      the society to which the victim belonged and<br \/>\n      such petulance, discord and differences were<br \/>\n      not expected to induce a similarly<br \/>\n      circumstances individual in given society to<br \/>\n      commit suicide, the conscience of the court<br \/>\n      should not be satisfied for basing a finding<br \/>\n      that the accused charged of abetting the<br \/>\n      offence of suicide should be found guilty.&#8221;\n<\/p><\/blockquote>\n<p>9.    I have gone through the FIR, merg report alongwith<\/p>\n<p>suicidal note of Kishorilal as well as statements recorded u\/s<\/p>\n<p>161 of Cr.P.C.\n<\/p>\n<p>10.   Looking to the suicidal note as well as other statements<\/p>\n<p>of prosecution witnesses it cannot be said that deceased<\/p>\n<p>committed suicide due to abetment by applicant hence no<\/p>\n<p>case is made out against applicant on whose basis prima<\/p>\n<p>facie a charge u\/s 306 of IPC can be framed against the<\/p>\n<p>applicant.   In   such   circumstances,    the    entire    criminal<\/p>\n<p>proceedings registered against the applicant is liable to be<\/p>\n<p>quashed.\n<\/p>\n<pre>                    Page numbers               M.Cr.C. No. 4705\/2009\n\n11.   In the result, this petition is allowed.    The criminal\n\n<\/pre>\n<p>proceedings pending against the applicant before the<\/p>\n<p>Additional Sessions Judge, Katni in S.T. No. 38\/05 for the<\/p>\n<p>offence punishable under section 306 of IPC is hereby<\/p>\n<p>quashed.     A copy of this order be sent to the trial court for<\/p>\n<p>information and compliance.\n<\/p>\n<p>                                           (S.C.
