H.L.Dattu,C.J.\n<\/p>\n
                Public spirited citizens and the Residents’ Association are<\/p>\n
before this Court in this public interest litigation, inter alia, seeking the<\/p>\n
following reliefs. They are as under:\n<\/p>\n
             “(i)   Call for the records relating to the proposed<\/p>\n
     covering up of the last reach of Edanada – Killiyar thodu and<\/p>\n
     peruse the same.\n<\/p><\/blockquote>\n
             (ii)   Issue a Writ of Certiorari quashing Ext.P-5 tender<\/p>\n
     and all further proceedings pursuant to the same.<\/p>\n<\/blockquote>\n
             (iii)  Direct the respondents to consider Ext.P-3 report<\/p>\n
     of the expert and carry out the recommendations contain<\/p>\n
     therein.\n<\/p><\/blockquote>\n
             (iv)   Direct the respondents to ensure that water<\/p>\n
     logging in the residential area of petitioners is effectively<\/p>\n
     managed by further widening the thodu to ensure efficient<\/p>\n
     discharge of rainwater into Killiyar river.<\/p>\n<\/blockquote>\n
             (v)    Direct the respondents to utilize the funds for<\/p>\n
     Ext.P-5 work for ensuring greater discharge of storm water and<\/p>\n
     for Flood management activities in the area.<\/p>\n<\/blockquote>\n
             (vi)   To declare that it is not the duty of the respondent<\/p>\n
     department to construct the road in the area”.<\/p><\/blockquote>\n

               (2)    The respondents have filed their detailed counter<\/p>\n
affidavit. In that, they have enclosed the earlier orders passed by a Division<\/p>\n
Bench of this Court.\n<\/p>\n
               (3) Confederation of Consumer Vigilance Centre, represented<\/p>\n
by its General Secretary was before this Court in W.P.(C).No.12396 of<\/p>\n
2006. The main relief sought in the writ petition was, to direct the<\/p>\n
respondents in the writ petition to complete the work of providing concrete<\/p>\n
slabs and constructing retaining walls for Edanadu Thodu as expeditiously<\/p>\n
as possible.\n<\/p>\n
               (4) After service of notice, the 2nd respondent in the writ<\/p>\n
petition – Executive Engineer, Minor Irrigation, Thiruvananthapuram – had<\/p>\n
filed a statement before this Court, wherein he had stated, that, the work<\/p>\n
will be completed within six months from the date of the order.<\/p>\n
               (5) Placing on record the statement of the 2nd respondent\/<\/p>\n
Executive Engineer, the writ petition came to be disposed of by this Court.<\/p>\n
               (6)   After the disposal of the aforesaid writ petition, yet<\/p>\n
another citizen was before this Court in W.P.(C).No.29072 of 2006. The<\/p>\n
prayer made in that writ petition was, that, the drainage should not be<\/p>\n
covered with concrete slabs, since it would lead to flooding of the area<\/p>\n
during rainy season. The request of the petitioner in the writ petition was<\/p>\n
rejected by this Court, by its order dated 20th November, 2006. The<\/p>\n

aforesaid order passed by this Court reads as under:-<\/p>\n
             “In this public interest litigation filed by K.Venugopalan<\/p>\n
      Nair, the prayer is that the drain should not be covered as that<\/p>\n
      would lead to flood during rainy season. Learned counsel for the<\/p>\n
      petitioner has not been able to impress us as to how only<\/p>\n
      covering of drain which is otherwise required keeping away<\/p>\n
      hygienic conditions would result into flood during rainy season.<\/p>\n
      We do not find any merit in this petition. However, we dispose of<\/p>\n
      this petition by simply observing that while the process of<\/p>\n
      covering the drainage is done by putting slabs, adequate<\/p>\n
      precaution should be taken that it would not lead to flood during<\/p>\n
      rainy season”.<\/p><\/blockquote>\n
              (7) Since the respondents had not complied with the orders<\/p>\n
and directions issued by this Court in W.P.(C).No.12396 of 2006, the<\/p>\n
Confederation of Consumer Vigilance Centre was before this Court in<\/p>\n
Cont.Case (C).No.88 of 2007. The said petition came to be disposed of by<\/p>\n
this Court on 22nd January, 2007, placing on record the statement made by<\/p>\n
the learned Government Pleader, that, the work will be commenced and<\/p>\n
completed within a particular time frame.\n<\/p>\n
              (8) After disposal of all these writ petitions and the contempt<\/p>\n
petition, now yet another group of residents of the locality are before this<\/p>\n
Court in this writ petition, for the reliefs indicated by us earlier.<\/p>\n
              (9)   Having gone through the pleadings made in the writ<\/p>\n
petition and the prayers sought therein and also the earlier orders passed by<\/p>\n
W.P.(C).No.24692\/2008-S                   – 4 –<\/span><\/p>\n
this Court, we are of the opinion, that, if, for any reason, we grant the reliefs<\/p>\n
sought in the writ petition, it would be literally passing an order contrary to<\/p>\n
the earlier orders passed by this Court. In our opinion, the same is<\/p>\n
impermissible in law. Therefore, the reliefs sought for by the petitioners in<\/p>\n
this writ petition cannot be granted by us, in view of the earlier orders<\/p>\n
passed by this Court in the writ petitions and the contempt petition.<\/p>\n
               (10) Accordingly, the writ petition requires to be rejected and<\/p>\n
it is rejected.\n<\/p>\n
               (11) In view of the orders passed in the writ petition, all<\/p>\n
pending interlocutory applications are rejected.<\/p>\n
               Ordered accordingly.\n<\/p>\n<\/p>\n
