(1) 449\n 1990 SCALE  (2)1302\n\n\nACT:\n    Election  Law: Representation of the People\t Act,  1951.\nSection\t 81  and 86--Election petition--Filing\ton  the\t re-\nopening\t day  of the High  Court  after\t vacation--Statutory\nperiod\tof 45 days over during the vacation--Whether  liable\nto be dismissed under section 86 of the Act?\n    Notification dated 29. 12. 1989 issued by the High Court\nnotifying  the Sankranthi vacation--Its\t interpretation\t and\nscope--No distinction can be made between the court and\t the\noffice\t(Registry)--Manner and extent of functioning  during\nthe  vacation--Whether\tin the light of the wording  of\t the\nnotification,  the High Court remained closed  between\t2.1.\n1990 and 12.1.1990 so as to enable the election\t petitioners\nto invoke Section 10 of the General Clauses Act.\n\n\n\nHEADNOTE:\n    The\t appellant had contested for the assembly seat\tfrom\nAvinagoda constituency and declared elected on November\t 26,\n1989 to the Andhra Pradesh Legislative Assembly. An election\npetition  calling in question his election was fried by\t the\nrespondents  in the High Court of Andhra Pradesh on the\t re-\nopening day of the Court after Sankranthi vacation on  Janu-\nary  15,  1990. As the statutory period\t of  fortyfive\tdays\nunder  section\t81 of the Act had expired during  the  vaca-\ntions,\tthe appellant moved an application praying for\tdis-\nmissal of the election petition, inter alia on the ground of\nlimitation.  It\t was contended that the\t Registry  was\topen\nduring this vacation, two Assistant Registrars were on duty,\nurgent applications were disposed of by the vacation  judges\nand  in\t fact 25 election petitions were filed\tduring\tthis\nperiod.\t The  High Court rejected all  the  contentions\t and\ndismissed  his application and relying on Section 10 of\t the\nGeneral\t Clauses Act held that filing of the Election  Peti-\ntion  on the re-opening day of the Court was within  limita-\ntion. The correctness of the decision of the High Court\t has\nbeen  challenged by the successful candidate in this  appeal\nby  special leave. Affirming the judgment of the High  Court\nand dismissing the appeal, this Court,\n    HELD:  Sections  4 and 5 of the Limitation Act  have  no\napplication  to the election petitions under  Representation\nof the People Act. The benefit\n702\nOf  Section  10 of the General Clauses Act can\thowever,  be\navailed to have limitation saved under the Act. [704D]\n    The notification dated December 29, 1989 nowhere  stated\nthat  the Registry would remain open. A bare reading of\t the\nsaid notification leaves no manner of doubt that the  Andhra\nPradesh\t High Court remained closed for all purposes  except\nfor applications of urgent nature for which vacation  judges\nand  vacation officers were designated. There was no  provi-\nsion  for filing of Election Petitions in  the\tnotification\nand  as\t such  the filing of the election  petition  by\t the\nrespondents on re-opening day of the High Court by  invoking\nSection 10 of the General Clauses Act, was justified.  There\nis no infirmity in the reasoning and the conclusions reached\nby the High Court. [706C, 708C]\n    <a href=\"\/doc\/1906339\/\">Hukumdev  Narain Yadav v.
