The same is served and learned Advocate Mr.Kasvala<br \/>\nappears for the respondent-workman.\n<\/p>\n<p>2.1\t\tThe matter requires<br \/>\nconsideration.\n<\/p>\n<p>3.\t\tRULE.\n<\/p>\n<p>Learned Advocate Mr.Kasvala waives service of Rule on behalf on<br \/>\nbehalf of the respondent-workman.\n<\/p>\n<p>\t\tAt the request of<br \/>\nlearned Advocate Mr.Munshaw for the petitioners, the matter is taken<br \/>\nup for final disposal, to which learned Advocate Mr.Kasvala for the<br \/>\nrespondent has no objection.\n<\/p>\n<p>4.\t\tLearned Advocate for<br \/>\nthe petitioners submitted that the respondent-workman was serving as<br \/>\npart-time peon in an Ayurvedic Clinic at village Gokharwala, Tal. &amp;<br \/>\nDist. Amreli.  It is not in dispute that he was service since<br \/>\n01.03.1987 and he continued in service till 28.02.2002, the period<br \/>\ncomes to about 15 years.  The respondent-workman was getting Rs.900\/-<br \/>\nper month as remuneration.  The date of birth of the<br \/>\nrespondent-workman is 05.03.1958, i.e. he is of 53 years of age<br \/>\napprox. and retirement age is 58 years.\n<\/p>\n<p>4.1\t\tLearned Advocate<br \/>\nfor the petitioners submitted that even the &#8216;Vaidhya&#8217;, who was<br \/>\nattending this Ayurvedic Clinic, was also on part-time basis and<br \/>\nClinic was run by him in one room, at his residence, as was expected<br \/>\nby the authorities.\n<\/p>\n<p>4.2\t\tLearned Advocate<br \/>\nfor the petitioner submitted that if this amount of Rs.1 lac is<br \/>\nmaintained, that will work harsh on the public exchequer and it will<br \/>\nbe setting a wrong precedent, more particularly when the<br \/>\nrespondent-workman was a part-timer and was getting Rs.900\/- per<br \/>\nmonth.\n<\/p>\n<p>5.\t\tAs against this,<br \/>\nlearned Advocate for the petitioner submitted that the<br \/>\nrespondent-workman was in service for 15 years, he remained out of<br \/>\nservice for 9 years and still, he has about 5 years to go and<br \/>\ntherefore, the amount awarded is absolutely just and proper.  In<br \/>\nsupport of his submission, he submitted that on the basis of Rs.900\/-<br \/>\nper month, if back wages are to be calculated, it will come roughly<br \/>\nabout Rs.97,200\/- and therefore, the amount awarded by way of lump<br \/>\nsum compensation in lieu of reinstatement and back wages is just and<br \/>\nproper.\n<\/p>\n<p>6.\t\tTaking into<br \/>\nconsideration the aforesaid facts, with rival submissions of the<br \/>\nlearned Advocates for the parties, the Court is of the opinion that<br \/>\nthe amount awarded is little on higher side and is required to be<br \/>\nreduced, more particularly when this amount is to come from a public<br \/>\nbody like Gram Panchayat, which in turn will be getting the amount<br \/>\nfrom Taluka Panchayat and District Panchayat.\n<\/p>\n<p>6.1\t\tTaking into<br \/>\nconsideration the fact that it was absolutely on part-time basis that<br \/>\nthe respondent-workman was employed and he was getting Rs.900\/- per<br \/>\nmonth, meaning thereby his duty hours were restricted to a few hours<br \/>\nin a day and for remaining hours, he was supposed to attend his own<br \/>\nother work, this Court is of the opinion that if the amount is<br \/>\nreduced to Rs.60,000\/- (Rupees Sixty Thousand Only), it will serve<br \/>\nthe ends of justice.\n<\/p>\n<p>7.\t\tAccordingly, the<br \/>\npetition is partly allowed.  The petitioners are directed to pay an<br \/>\namount of Rs.60,000\/- (Rupees Sixty Thousand Only) to the<br \/>\nrespondent-workman.  Rule is made absolute.  No costs.\n<\/p>\n<p>\t\tAt the request of the<br \/>\nlearned Advocate for the respondent-workman it is directed that the<br \/>\npetitioners shall pay this amount as expeditiously as possible, but<br \/>\nnot later than 15.10.2011.
