Justice K.HEMA\n\n Dated :23\/01\/2009\n\n O R D E R\n                          K.HEMA, J.\n                     ---------------------------\n                     B.A. No.37 OF 2009\n                     ---------------------------\n           Dated this the 23rd day of January, 2009\n\n\n                           O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.<\/p>\n<p>     2. The alleged offence is under Section 420 of I.P.C.<\/p>\n<p>According to prosecution, first petitioner bid a chitty<\/p>\n<p>conducted by defacto complainant and offered petitioner nos.<\/p>\n<p>2 and 3 as sureties. Second petitioner produced a cheque<\/p>\n<p>signed by him as a security for the amount but the said cheque<\/p>\n<p>belonged to the account maintained by third accused and<\/p>\n<p>thereby all of them in furtherance of common intention<\/p>\n<p>committed the offence of cheating etc.<\/p>\n<p>     3. Learned counsel for petitioners submitted that<\/p>\n<p>property was also offered as a security and the defacto<\/p>\n<p>complainant can proceed against petitioner and petitioner may<\/p>\n<p>be granted anticipatory bail.\n<\/p>\n<p>     4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that this is a clear case of cheating and also forgery.<\/p>\n<p>Second accused signed and issued a cheque, which belongs to<\/p>\n<p>third accused from his account. The nature of the offence<\/p>\n<p>B.A.No.37 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>committed is serious and anticipatory bail may not be granted,<\/p>\n<p>it is submitted.\n<\/p>\n<p>       On hearing both sides, considering the serious nature of<\/p>\n<p>the allegations made, I am satisfied that it may not be proper<\/p>\n<p>to grant anticipatory bail. The crime is registered as early as<\/p>\n<p>on 10.12.2008 and petitioners are required for investigation.<\/p>\n<p>              Hence, petitioners are directed to surrender<\/p>\n<p>              before the Investigating Officer or the court<\/p>\n<p>              concerned without any delay and co-operate<\/p>\n<p>              with   the  investigation.
