Respondents No. 5 and<br \/>\n\t6 herein were aggrieved by an order dated 25.8.2005 by which the<br \/>\n\tCollector, Gandhinagar was pleased to dispose of the appeal of the<br \/>\n\tsaid respondents without any order on the basis  that issues have<br \/>\n\tbeen compromised between respondents No. 5 and 6 herein on one side<br \/>\n\tand respondent no.7 on the other side.\n<\/p>\n<p>The<br \/>\n\tpetitioner of Special Civil Application No.5340\/2008 claims to have<br \/>\n\tpurchased the same subject matter land from original owner Gabhaji<br \/>\n\tShanaji Thakor, who is petitioner in Special Civil Application<br \/>\n\tNo.698\/2008. Grievance of the petitioner in Special Civil<br \/>\n\tApplication No. 5340\/2008 is that though Kachha entry was made in<br \/>\n\this favour on the basis of a registered sale deed, the Secretary<br \/>\n\tallowed the revision application of the present respondents No. 5<br \/>\n\tand 6 without hearing the present petitioner or original land owner<br \/>\n\tGabhaji. It is also contended that earlier respondents No. 5 and 6<br \/>\n\thad unsuccessfully appealed before the Deputy Collector against the<br \/>\n\trestoration of the name of Gabhaji in the revenue record.<br \/>\n\tThereafter, before the Secretary without joining either the original<br \/>\n\towner Gabhaji or subsequent purchaser i.e petitioner of Special<br \/>\n\tCivil Application No. 5340\/2008, impugned order came to be passed.\n<\/p>\n<p>Only<br \/>\n\ton the ground that order passed by the Deputy Collector dated<br \/>\n\t25.5.2006 was not brought to the notice of the Secretary and<br \/>\n\tallowing the impugned order in the revision application to survive<br \/>\n\tsimultaneously with the said order dated 25.5.2006 passed by the<br \/>\n\tDeputy Collector would be incongruent, I am inclined to remand the<br \/>\n\tproceedings for fresh consideration and disposal in accordance with<br \/>\n\tlaw. I am however, not in agreement with the contention of the<br \/>\n\tpetitioner that revision application was not maintainable, since the<br \/>\n\tCollector had disposed of appeal of respondents No. 5 and 6 herein<br \/>\n\ton compromise. I find that Collector instead of passing some order<br \/>\n\ton merits had closed the proceedings without any order and had<br \/>\n\tthereby effectively rejected the appeal of respondents No. 5 and 6<br \/>\n\twithout adjudication. The Secretary was therefore, well within his<br \/>\n\tpowers to entertain the revision application of respondents No. 5<br \/>\n\tand 6.\n<\/p>\n<p>However,<br \/>\n\tto enable  all the affected persons to bring full material on record<br \/>\n\tbefore final order can be passed, impugned order dated 6.8.2007<br \/>\n\tpassed by the Secretary is quashed. Proceedings are remanded for<br \/>\n\tfresh consideration and disposal in accordance with law to the<br \/>\n\tSecretary. It will be open for the petitioners of both these<br \/>\n\tpetitions to participate in the said revision application and final<br \/>\n\torder will be passed after hearing them as well.\n<\/p>\n<p>In<br \/>\n\tview of the above directions, Special Civil Application No.<br \/>\n\t5340\/2008 is allowed to the above extent.\n<\/p>\n<p>In<br \/>\n\tview of the order passed in Special Civil Application No. 5340\/2008,<br \/>\n\tSpecial Civil Application No. 698\/2008 is not pressed.\n<\/p>\n<p>Both<br \/>\n\tthe petitions are disposed of accordingly.\n<\/p>\n<p>(Akil<br \/>\n\tKureshi,J.)<\/p>\n<p>(raghu)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Fulabhai vs Additional on 25 August, 2008 Author: Akil Kureshi,&amp;Nbsp;
