Justice M.SASIDHARAN NAMBIAR\n\n Dated :24\/02\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.333 of 2010\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    Petitioner  was   the  sixth  accused  in   C.C.No.<\/p>\n<p>778\/2004  on   the  file   of  Judicial   First   Class<\/p>\n<p>Magistrate&#8217;s Court, North Paravur. Prosecution case is<\/p>\n<p>that the six accused formed themselves into an unlawful<\/p>\n<p>assembly  with   the   common  object   of   wrongfully<\/p>\n<p>restraining first respondent and cause hurt and in<\/p>\n<p>furtherance of their common object, on 24.12.1999 at<\/p>\n<p>about 11.30 p.m., while first respondent was riding a<\/p>\n<p>motor cycle, petitioners wrongfully confined him and<\/p>\n<p>with deadly weapons inflicted injuries on him and<\/p>\n<p>thereby committed offences under Sections 143, 147,<\/p>\n<p>148, 341 and 323 read with Section 149 of Indian Penal<\/p>\n<p>Code. As petitioner was absconding, the case as against<\/p>\n<p>him was split up and refiled as C.C.No.220\/2009 and the<\/p>\n<p>other accused were tried by the learned Magistrate. By<\/p>\n<p>Annexure-A1 judgment, the remaining five accused were<\/p>\n<p>acquitted. This petition is filed under Section 482 of<\/p>\n<p>Code of Criminal Procedure to quash the proceedings as<\/p>\n<p>against the petitioner contending that as he was in<\/p>\n<p><span class=\"hidden_text\">CRMC 333\/10                2<\/span><\/p>\n<p>Gulf, he could not appear before the court, when the<\/p>\n<p>other accused were tried and the entire disputes with<\/p>\n<p>the first respondent were later settled amicably and in<\/p>\n<p>view of the settlement and order of acquittal as<\/p>\n<p>against the other accused, it is not in the interest of<\/p>\n<p>justice to continue the prosecution.\n<\/p>\n<p>    2. First respondent appeared through a counsel and<\/p>\n<p>filed  a   joint petition  along  with  the  petitioner<\/p>\n<p>stating that entire disputes between them were settled<\/p>\n<p>amicably   and  therefore,  first  respondent  has   no<\/p>\n<p>objection for quashing the proceedings.<\/p>\n<p>    3. Learned counsel appearing for the petitioner,<\/p>\n<p>first respondent and learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>    4. Joint petition filed by the petitioner and<\/p>\n<p>first respondent, who is the injured, establishes that<\/p>\n<p>there has been an amicable settlement of the disputes.<\/p>\n<p>Annexure-A1 judgment shows that when the remaining five<\/p>\n<p>accused were tried, first respondent turned hostile. So<\/p>\n<p>also  the   other eye  witnesses.  Consequently,  other<\/p>\n<p>prosecution  witnesses  were  not  examined.  When  the<\/p>\n<p>disputes between the parties were settled amicably and<\/p>\n<p><span class=\"hidden_text\">CRMC 333\/10                3<\/span><\/p>\n<p>the offences alleged are purely personal in nature as<\/p>\n<p>against the first respondent, as held by the Apex Court<\/p>\n<p>in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> (2008 (3) KLT<\/p>\n<p>19), it is not in the interest of justice to continue<\/p>\n<p>the prosecution. It is more so, when out of the six<\/p>\n<p>accused, five were already acquitted, consequent to the<\/p>\n<p>settlement and even if petitioner is to be tried, there<\/p>\n<p>is no likelihood of a successful prosecution.<\/p>\n<p>     In such circumstances, petition is allowed.
