Justice ANTONY DOMINIC\n\n Dated :29\/10\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n             --------------------------------------------------\n                 W.P.(C) NO.30634 OF 2009 (Y)\n             --------------------------------------------------\n          Dated this the 29th day of October, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>      By Ext.P1 order, petitioner was transferred from Karukone<\/p>\n<p>to Punalur. According to the petitioner, he made Ext.P2 and P3<\/p>\n<p>representations objecting to Ext.P1 and thereafter Ext.P4 report<\/p>\n<p>was submitted by the 3rd respondent to the 4th respondent.<\/p>\n<p>Petitioner states that the transfer order has been issued on the<\/p>\n<p>wrong assumption that he resides at Agasthyacode and that as a<\/p>\n<p>matter of fact he lives in a place at Alenchery.<\/p>\n<p>      2.  First of all a reading of Ext.P4 itself shows that the<\/p>\n<p>transfer has been ordered in the exigencies of service. That apart,<\/p>\n<p>Ext.P4 shows that, because of the transfer, the petitioner is only<\/p>\n<p>to travel 5 Km more. Even if the petitioner is not staying at<\/p>\n<p>Agasthyacode as stated in Ext.P3, his electoral card Ext.P5 shows<\/p>\n<p>that he is a resident of Alenchery, which is also in suburb of<\/p>\n<p>Punalur itself.
