BASANT, J.\n\n                        - - - - - - - - - - - - - - - - - - - - - -\n\n                        Crl.M.C.No.  1086  of   2005\n\n                        - - - - - - - - - - - - - - - - - - - - - -\n\n                  Dated this the 28th day of   March, 2007\n\n\n                                     O R D E R\n<\/pre>\n<p>       The  petitioner faces indictment in a prosecution under Section<\/p>\n<p>138   of   the   N.I.   Act.     The   case   was   posted   for   defence   evidence.<\/p>\n<p>Witnesses  were present,  but  the  counsel  could    not  reach  the  court.<\/p>\n<p>The  witnesses   could   not   be   examined.     The   learned   Magistrate   has<\/p>\n<p>now  posted  the  case  for  judgment.    The petitioner  has  come to this<\/p>\n<p>Court with a prayer that the petitioner may be permitted to examine<\/p>\n<p>the defence witnesses.\n<\/p>\n<\/p>\n<p>       2.  No serious objection is raised by the learned counsel for the<\/p>\n<p>respondent\/complainant.  The counsel  submits that the prayer may be<\/p>\n<p>allowed on appropriate conditions, as the respondent\/complainant has<\/p>\n<p>been   unnecessarily   dragged   to   this   Court   and   there   has   been<\/p>\n<p>unjustified  protraction  of the  proceedings,  all because  the  petitioner<\/p>\n<p>did not get ready for examination of the defence witnesses.  I am, in<\/p>\n<p>these   circumstances,   satisfied   that   the   petitioner   can   be   granted   an<\/p>\n<p>opportunity   to   examine  the   defence  witnesses,    subject   to   the<\/p>\n<p>Crl.M.C.No.  1086  of   2005<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>condition   that   the   petitioner   must   pay   cost   of   Rs.500\/-     to   the<\/p>\n<p>respondent\/complainant.\n<\/p>\n<\/p>\n<p>      3. This Crl.M.C. is  hence allowed to the above extent.<\/p>\n<p>                                                     (R.
