S.J.MUKHOPADHAYA)<\/p>\n<p>\tOn<br \/>\nhearing the parties, it appears that all the encroachers were removed<br \/>\nafter notice to them.\n<\/p>\n<p>\tIt<br \/>\nis alleged that 79 more fresh encroachments have been made and<br \/>\nnotices have been issued to them on 2nd August 2011 to<br \/>\nreply by 10th August 2011, whereinafter action will be<br \/>\ntaken against them.\n<\/p>\n<p>\tLearned<br \/>\ncounsel appearing on behalf of the petitioner would contend that the<br \/>\nMembers of the Panchayat who encroached over the Gauchar land of<br \/>\nvillage Piluda have not yet been removed, they are still occupying<br \/>\nthe land.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, as we find that the encroachment is again made<br \/>\nafter removal of first set of encroachment, we direct the Collector,<br \/>\nBanaskantha, Taluka Development Officer, Tharad, Mamlatdar, Tharad<br \/>\nand the Members of the Panchayat to remove all the encroachment by<br \/>\n14th August 2011 and report the matter to the Court.\n<\/p>\n<p>\tIt<br \/>\nis made clear that it will be the duty of the Piluda Gram Panchayat<br \/>\nto ensure that no Gauchar land is encroached by any person including<br \/>\nthe Sarpanch or the Members of the Gram Panchayat. If any such<br \/>\nencroachment is made, it should be reported to the Collector,<br \/>\nBanaskantha, Taluka Development Officer, Tharad and the Mamlatdar,<br \/>\nTharad, within three days and the said encroachment should be removed<br \/>\nwithout notice to them. This exercise will continue as and when such<br \/>\nencroachment is found and reported.\n<\/p>\n<p>\tWe<br \/>\nmake it clear that once the encroachment is removed, thereafter if<br \/>\nany person re-encroaches the land, he is not entitled for any notice<br \/>\nfor removal of the encroachment.\n<\/p>\n<p>\tSimilar<br \/>\nprocedure to be followed with regard to encroachers who are there<br \/>\nover the Non-Gauchar land of the Panchayat or the State.\n<\/p>\n<p>\tReport<br \/>\ncompliance by 17th August 2011.\n<\/p>\n<p>\tPost<br \/>\nthe matter for orders on 23rd August 2011 on the top of<br \/>\nthe list.\n<\/p>\n<p>\tIn<br \/>\nview of the order passed by this Court, no further order is required<br \/>\nto be passed on Civil Application.
