1.\tRule.\n<\/p>\n
Learned APP Mr. D.C. Sejpal waives service of rule on behalf of
\nrespondent State.\n<\/p>\n
2.\tThe
\napplicant seeks an order of anticipatory bail in connection FIR
\nbearing C.R.No.I-501 of 2009 registered with Umra police
\nstation,Surat on 30.12.2009.\n<\/p>\n
3.\tIt
\nis not in dispute that previously the applicant had approached this
\nCourt by filing Criminal Miscellaneous Application  No.9846 of 2010
\nseeking similar order of anticipatory bail. This application was
\nallowed by learned Single Judge of this Court by order dated
\n17.9.2010. In the said order it was provided that the order shall be
\nvalid if the applicant is arrested at any time within 90 days from
\nthe date of the order. Since within period of 90 days of validity of
\nthe anticipatory bail order, the applicant was not arrested, he has
\nmoved the present application for anticipatory bail.\n<\/p>\n
4.\tIt
\nis not even the case of the respondent that the applicant did not
\ncooperate with the investigation or was not available for arrest
\nduring the validity of the previous anticipatory bail order. The
\nState has also not argued that after passing of the said anticipatory
\nbail order, there is any change in circumstance or that the applicant
\nhas, for certain reasons, made himself dis-entitled to seek fresh
\norder of anticipatory bail.\n<\/p>\n
5.\tIn
\nthat view of the matter, I am of the opinion that the present
\napplication is required to be allowed. Any other view would amount to
\nreviewing previous order passed by another learned Single Judge of
\nthis Court. In fact condition limiting life of an anticipatory bail
\norder in view of the decision of the Apex Court in the case of
\nSiddharam Satlingappa Mhetre vs. State of Maharashtra and others
\nreported in (2011) 1 SCC 694, has been rendered illegal. The Apex
\nCourt made following observations in para 123 of the judgment:-\n<\/p>\n
“123.\n<\/p>\n
In view of the clear
\ndeclaration of law laid down by the Constitution Bench in Sibbia
\ncase, it would not be proper to limit the life of anticipatory bail.
\nWhen the Court observed that the anticipatory bail is for limited
\nduration and thereafter the accused should apply to the regular court
\nfor bail, that means the life of Section 438 CrPC would come to an
\nend after that limited duration. This limitation has not been
\nenvisaged by the legislature. The Constitution Bench in Sibbia case
\nclearly observed that it is not necessary to rewrite Section 438
\nCr.PC. Therefore, in view of the clear declaration of the law by the
\nConstitution Bench, the life of the order under Section 438 CrPC
\ngranting bail cannot be curtailed.”\n<\/p>\n
6.\tCounsel
\nfor the original complainant, however, submitted that  the previous
\norder of anticipatory bail is challenged by the complainant before
\nthe Apex Court in which notice has also been issued.\n<\/p>\n
7.\tTo
\nmy mind, this should not detain me from granting protection to the
\napplicant in absence of which he would be exposed to arrest by the
\ninvestigating agency which would frustrate present anticipatory bail
\napplication. Particularly, when this is not a fresh application for
\nanticipatory bail but only successive anticipatory bail application
\nsince within the validity period of previous anticipatory bail order,
\nthe applicant was not arrested, I see no reason to refuse the prayer.\n<\/p>\n
8.\tIn
\nthe result, the applicant is ordered to be released on bail in
\nthe event of his arrest in connection with FIR
\nbearing C.R.No.I-501 of 2009 registered with Umra police
\nstation,Surat he shall be
\nreleased on bail upon his furnishing a bond of Rs. 20,000\/-(Rupees
\nTwenty Thousand) with one surety of like amount to the satisfaction
\nof the lower Court and subject to the following conditions  that he :\n<\/p>\n
[A]\tshall
\ncooperate with the investigation and make himself available for
\ninterrogation whenever required.\n<\/p>\n
[B]\tshall
\nremain present at Umra
\npolice station, Surat on 14.2.2011 between 11:00 am to
\n2:00 pm;\n<\/p>\n
[C]\tshall not
\nhamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
[D]\tat the time
\nof execution of bond, furnish the address to the Investigating
\nOfficer and the Court concerned and shall not change the residence
\ntill the final disposal of the case or till further orders;\n<\/p>\n
[E] \twill not
\nleave India without the permission of the Court and, if is holding a
\nPassport, shall surrender the same before the trial Court immediately<\/p>\n
[F]\tIt would be
\nopen to the Investigating Officer to file an application for remand,
\nif he considers it just and proper and the concerned Magistrate would
\ndecide it on merits.\n<\/p>\n
[G]\tWithin a
\nperiod of ten days from the date of arrest, the applicant shall apply
\nfor regular bail which application shall be decided by the competent
\nCourt in accordance with law without being influenced by the fact
\nthat anticipatory bail was granted.\n<\/p>\n
\tRule
\nmade absolute. Application is disposed of accordingly.\n<\/p>\n
\tDirect
\nservice is permitted.\n<\/p>\n
