(Oral)\n<\/pre>\n<p>CRM No.50839 of 2009<\/p>\n<p>            Allowed as prayed for.\n<\/p>\n<p>Main Case<\/p>\n<p>            As per the averments made in the petition, date of birth of<\/p>\n<p>petitioner No.1 is 13.1.1979 as per his passport (Annexure P-1) and the date<\/p>\n<p>of birth of petitioner No.2 is 3.4.1984 as per matriculation certificate<\/p>\n<p>(Annexure P-2). They have stated that they are major and they have<\/p>\n<p>performed marriage as per Sikh rites and ceremonies on 6.10.2009.<\/p>\n<p>Photographs of their marriage are appended as Annexure P-3 and marriage<\/p>\n<p>certificate is attached as Annexure P-4.\n<\/p>\n<p>            Before coming to this Court, the petitioners have also<\/p>\n<p>approached Senior Superintendent of Police, Jallandhar (respondent No.2)<\/p>\n<p>for providing them security.\n<\/p>\n<p>            Though both the petitioners are major yet they are<\/p>\n<p>apprehending danger to their lives at the hands of respondents No.4 to 8 as<\/p>\n<p>they have married against their wishes.\n<\/p>\n<p><span class=\"hidden_text\"> CRM-M 28088 of 2009            -2-<\/span><\/p>\n<p>            Counsel for the petitioners relies upon a decision of the<\/p>\n<p>Supreme Court in Lata Singh Vs. State of U.P. and another (2006) 5 SCC<\/p>\n<p>475 in which it is held that &#8220;Once a person becomes a major, he or she can<\/p>\n<p>marry whosoever he\/she likes. If the parents of the boy or girl do not<\/p>\n<p>approve of such inter-caste or inter-religious marriage, the maximum they<\/p>\n<p>can do is that they can cut-off social relations with the son or the daughter,<\/p>\n<p>but they cannot give threats or commit or instigate acts of violence and<\/p>\n<p>cannot harass the person who undergoes such inter-caste or inter-religious<\/p>\n<p>marriage. We, therefore, direct that the administration\/police authorities<\/p>\n<p>throughout the country will see to it that if any boy or girl who is a major<\/p>\n<p>undergoes inter-caste or inter-religious marriage with a woman or man who<\/p>\n<p>is a major, the couple is not harassed by anyone nor subjected to threats or<\/p>\n<p>acts of violence, and anyone who gives such threats or harasses or commits<\/p>\n<p>acts of violence either himself or at his instigation, is taken to task by<\/p>\n<p>instituting criminal proceedings by the police against such persons and<\/p>\n<p>further stern action is taken against such persons as provided by law.&#8221;<\/p>\n<p>            After hearing the counsel for the petitioners and keeping in<\/p>\n<p>view the facts and circumstances of the case particularly the fact that both<\/p>\n<p>the petitioners are major, respondent No.2 is directed to look into the<\/p>\n<p>representation (Annexure P-5) and if the facts stated in the application are<\/p>\n<p>found to be correct and any danger to the lives and liberty of the petitioners<\/p>\n<p>is found, he shall provide necessary protection to them.<\/p>\n<p>            The petition stands disposed of.<\/p>\n<pre>\n\n\n\n                                          (Rakesh Kumar Jain)\n8.10.2009                                       Judge\nMeenu\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Raman Kumar Chopra And Another vs State Of Punjab And Others on 8 October, 2009 CRM-M 28088 of 2009 -1- IN THE PUNJAB AND HARYANA HIGH COURT AT CHANDIGARH CRM No.50839 of 2009 and CRM-M 28088 of 2009 Date of Decision: 8.10.2009 Raman Kumar Chopra and another ..Petitioners.
