Justice S.S.SATHEESACHANDRAN\n\n Dated :31\/07\/2009\n\n O R D E R\n              S.S.SATHEESACHANDRAN, J.\n                  -------------------------------\n              W.P.(C).NO.21639 OF 2009 (O)\n                -----------------------------------\n           Dated this the 31st day of July, 2009\n\n                       J U D G M E N T\n<\/pre>\n<p>      The writ petition is filed seeking the following reliefs:<\/p>\n<blockquote><p>          i. to call for the records relating to the suit<br \/>\n          O.S.No.225\/1995 and direct the learned<br \/>\n          Munsiff, Paravur to defer the trial of the suit<br \/>\n          until a report and plan are submitted by the<br \/>\n          commissioner      and    the   Taluk    Surveyor<br \/>\n          appointed in the case.\n<\/p><\/blockquote>\n<blockquote><p>          ii. to direct an enquiry to be made into the<br \/>\n          non availability of the survey records in the<br \/>\n          survey   department      preventing    the   just<br \/>\n          disposal of the suit.\n<\/p><\/blockquote>\n<blockquote><p>          iii. to stay the trial proceedings in the suit<br \/>\n          O.S.No.225\/1995 of the Munsiff&#8217;s Court,<br \/>\n          Paravur till the disposal of the writ petition.\n<\/p><\/blockquote>\n<blockquote><p>          iv. to grant such other reliefs as could be<br \/>\n          granted in the nature and circumstances of<br \/>\n          the case.\n<\/p><\/blockquote>\n<p>      2. Petitioner is the plaintiff in O.S.No.225 of 1995 on the<\/p>\n<p>file of the Munsiff&#8217;s Court, Paravur. Suit originally was filed<\/p>\n<p><span class=\"hidden_text\">WPC.21639\/09                   2<\/span><\/p>\n<p>for permanent prohibitory injunction, but, later on amended<\/p>\n<p>for declaration of title and recovery of possession.         An<\/p>\n<p>Advocate Commission was taken out by the plaintiff to<\/p>\n<p>measure out the suit property with reference to survey<\/p>\n<p>records. The Commissioner has filed a report stating that the<\/p>\n<p>suit property could not be identified with the survey records<\/p>\n<p>available with the surveyor. Certified copies of the sketches of<\/p>\n<p>the sub division relating to the suit property were produced.<\/p>\n<p>The Commissioner was again appointed, and, an interim<\/p>\n<p>report was filed by that Commissioner stating the enquiry<\/p>\n<p>conducted at the village offices disclosed that the sub division<\/p>\n<p>sketches relating to the suit property are not available in the<\/p>\n<p>village offices. Without issuing any further direction to the<\/p>\n<p>Commissioner, the case has been listed for trial on 1.8.2009, is<\/p>\n<p>the grievance canvassed in the petition for the reliefs<\/p>\n<p>aforementioned invoking the supervisory jurisdiction vested<\/p>\n<p>with this Court under Article 227 of the Constitution of India.<\/p>\n<p>     3. I heard the learned counsel for the petitioner. I find<\/p>\n<p>no notice to the respondents is necessary in the facts<\/p>\n<p><span class=\"hidden_text\">WPC.21639\/09                      3<\/span><\/p>\n<p>presented, and, hence, it is dispensed with.<\/p>\n<p>      4.    Suit filed for injunction has been subsequently<\/p>\n<p>amended for declaration of title and recovery of possession.<\/p>\n<p>Recovery of possession of the suit property, as a whole, as<\/p>\n<p>having     been   subsequently      trespassed  upon    by    the<\/p>\n<p>respondents, is sought for in the amended plaint. An interim<\/p>\n<p>report is seen filed by the second Commissioner as seen from<\/p>\n<p>Ext.P3 as early on 1.4.2009. If at all the petitioner had any<\/p>\n<p>case that the identification of the property is possible with the<\/p>\n<p>copies of the sketches produced by the Assistant Director of<\/p>\n<p>Survey, she could have brought it to the notice of the court<\/p>\n<p>and applied for issuing proper directions to the Commissioner.<\/p>\n<p>At the fag end after the suit has been listed for trial, she has<\/p>\n<p>filed this writ petition, that is, two days before the date fixed<\/p>\n<p>for recording of evidence. After going through the copy of<\/p>\n<p>plaint and other materials produced with the writ petition, I<\/p>\n<p>find this is not a fit case where the issue of any direction or<\/p>\n<p>orders to the court below as sought for by the petitioner is<\/p>\n<p>called for.
