Santosh Hegde &amp; Doraiswamy Raju\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>SANTOSH HEGDE, J.\n<\/p>\n<p>\tThe appellant and 12 others were chargesheeted before<br \/>\nthe learned Sessions Judge, Barnala, for various offences;<br \/>\nprincipal offence amongst them being one punishable under<br \/>\nSection 302 IPC for having caused the death of Hari Singh and<br \/>\nBharpur Singh in an incident which took place on 4.6.1987 at<br \/>\nabout 10 a.m. It is the prosecution case that in regard to certain<br \/>\ndisputes the appellants&#8217; group and complainant PW-4, Nazar<br \/>\nSingh&#8217;s group had in regard to the right to bid for certain<br \/>\nShamlat land which was being auctioned on the relevant date,<br \/>\nthe appellant and other accused persons assaulted the group of<br \/>\nthe complainant, caused injuries to various persons, consequent<br \/>\nto which the abovesaid two persons died due to the injuries<br \/>\nsuffered in the said attack. The learned Sessions Judge as per<br \/>\nhis judgment dated 22.12.1988 convicted 9 of those persons for<br \/>\noffences punishable under Section 304, Part II, IPC, and<br \/>\nsentenced them to undergo RI for a period of 8 years and to pay<br \/>\na fine of Rs.1,000\/- each. Being aggrieved by the said<br \/>\njudgment, the appellants preferred criminal appeals before the<br \/>\nHigh Court of Punjab &amp; Haryana at Chandigarh, and the High<br \/>\nCourt as per its judgment dated 2.11.1995 upheld the conviction<br \/>\nof the appellants imposed on them under Section 304, Part II,<br \/>\nIPC but on taking into consideration various extenuating<br \/>\nfactors, reduced the said sentence from 8 years to 5 years&#8217; RI,<br \/>\nmaintaining the fine imposed by the Sessions Court. The other<br \/>\nsentences imposed on the appellants under other minor charges<br \/>\nwere maintained and were made to run concurrently. It is<br \/>\nagainst this judgment of the High Court that the appellants, 8 in<br \/>\nnumbers, are before us.\n<\/p>\n<p>\t  Having perceived the difficulty in arguing for a clear<br \/>\nacquittal, Mr. Mahabir Singh, learned counsel appearing for the<br \/>\nappellants, in our view rightly, confined the two-fold arguments<br \/>\nto the nature of the offence and the quantum of sentence only.\n<\/p>\n<p>\tHe contended that the courts below erred in coming to<br \/>\nthe conclusion that the offence in question was one falling<br \/>\nunder Section 304, Part II, IPC, while if at all a conviction is to<br \/>\nbe based, according to him, it could be only under Section 325<br \/>\nIPC. Based on the material available on record, he pointed out<br \/>\nthat though the appellants had carried sharp-edged and\tblunt<br \/>\nweapons which could cause serious injuries, a perusal of the<br \/>\ninjuries caused on the deceased would show that they were not<br \/>\nused for the purpose of causing such injuries which in their<br \/>\nknowledge would cause death.\n<\/p>\n<p>\t In support of this contention, the learned counsel drew our<br \/>\nattention to the injuries found on the deceased and argued that<br \/>\nthese injuries were small in nature and were not deep enough so<br \/>\nas to cause a knowledgeable death. He further contended that<br \/>\neven, according to the prosecution the appellants are supposed<br \/>\nto have carried weapons like spears, daggers, gandasas, gupti<br \/>\netc. and if, as a matter of fact, the appellants were to cause<br \/>\ninjuries which in their knowledge would cause death then the<br \/>\ninjuries on the deceased would have been more severe injuries.<br \/>\nHe also contended that since the attack in question was<br \/>\nspontaneous, without there being any personal or individual<br \/>\nenmity with the deceased persons, the injuries at the most<br \/>\ncould be attributable to offences punishable under Section 325<br \/>\nIPC.\n<\/p>\n<p>\t  We have carefully examined the evidence adduced by the<br \/>\nprosecution and also the arguments addressed on behalf of the<br \/>\nparties. The learned Sessions Judge who considered the<br \/>\nevidence on record, in our opinion, rightly came to the<br \/>\nconclusion that the offence in question could not be one that<br \/>\ncould be brought under Section 302 read with Section 149 IPC,<br \/>\nbut the one which would fall under Section 304, Part II, IPC.<br \/>\nHe found that at least one of the injuries caused on the deceased<br \/>\nwas severe enough to cause death in the ordinary course of<br \/>\nnature. Based on the evidence of the doctor, he held that an<br \/>\nincised wound of  3 x  x  inches on the right side of the<br \/>\nscalp just above the left ear which caused the fracture of left<br \/>\nparietal and left temporal bone extending to the frontal and<br \/>\noccipital region could never be treated as an injury<br \/>\ncontemplated under Section 325 IPC, but should be held to be<br \/>\none that would cause death which knowledge the appellant<br \/>\nmust have had. It is on an analysis of this evidence of the doctor<br \/>\npertaining to the injuries suffered by the two deceased persons,<br \/>\nnamely, Hari Singh and Bharpur Singh, the learned Sessions<br \/>\nJudge came to the conclusion that these accused who have been<br \/>\nfound guilty of having caused those injuries could only be<br \/>\nconvicted for an offence punishable under Section 304, Part II,<br \/>\nIPC. The High Court on re-appreciation of this evidence, has<br \/>\nagreed with the learned Sessions Judge, and we do not find any<br \/>\ninfirmity in the findings recorded by the trial court as well as<br \/>\nthe High Court. In our opinion, it would be stretching the<br \/>\ndefence case far beyond the limits if we were to conclude that<br \/>\nthe injuries caused on the two deceased persons which were<br \/>\nattributed to the appellants, could be anything other than the<br \/>\none falling under Section 304, Part II, IPC. In the said view of<br \/>\nthe matter, we are not inclined to interfere with the findings<br \/>\nrecorded by the two courts below.\n<\/p>\n<p>\tIt was next contended by Mr. Mahabir Singh, learned<br \/>\ncounsel, that the appellants are all aged persons and the incident<br \/>\nin question took place as far back as on 4.6.1987 and they<br \/>\nhaving served some part of the sentence, are entitled to a more<br \/>\nhumane consideration, hence, the sentence of 5 years awarded<br \/>\nby the High Court should be reduced. We notice that under the<br \/>\nCode, the maximum sentence awardable for an offence under<br \/>\nSection 304, Part II, IPC is imprisonment for 10 years. Inspite<br \/>\nof the same, the learned Sessions Judge considered the material<br \/>\non record and came to the conclusion that a sentence of 8 years<br \/>\nwith a fine of Rs.1,000\/- each would serve the ends of justice in<br \/>\nthe facts and circumstances of the case. Even this sentence was<br \/>\nreduced by the High Court on taking a more humane approach<br \/>\nand reduced that sentence to a period of 5 years. We are<br \/>\nconvinced that the sentence now awarded by the High Court is<br \/>\nreasonable, even taking into consideration the respective ages<br \/>\nof the appellants as also the long period that has rolled by since<br \/>\nthe committing of the offence in question. We do not think it<br \/>\nappropriate to further reduce the period of sentence, keeping in<br \/>\nview the gravity of the offence committed.\n<\/p>\n<p>\tIn the said view of the matter, the appeals fail and the<br \/>\nsame are hereby dismissed. If the appellants are on bail the<br \/>\nbailbonds are cancelled, and they are required to serve out the<br \/>\nremainder period of their sentence.\n<\/p>\n<p>\t\t\t\t&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..J.\n<\/p>\n<p>\t\t\t\t\t(N.
