The alleged offence is under Section 8(2) of Abkari<\/p>\n<p>Act. According to prosecution, petitioner (second accused) was<\/p>\n<p>the owner of the house from where 25 litres of arrack were<\/p>\n<p>seized. The article was in possession of the first accused, who is<\/p>\n<p>her son. On search, the article was seized from the house.<\/p>\n<p>      3.    Learned counsel for the petitioner submitted that the<\/p>\n<p>incident occurred on 2.9.2008 at about 10 p.m.                      As per the<\/p>\n<p>mahazar, on getting reliable information that the first accused<\/p>\n<p>was possessing illicit arrack, the Excise Officials came to the<\/p>\n<p>house of the petitioner and a person was found standing in front<\/p>\n<p>of the house, but, he ran away on seeing the Excise Officials.<\/p>\n<p>Petitioner was present in the house and on questioning her, she<\/p>\n<p>was informed that it was her son who ran away. On search, 25<\/p>\n<p>litres of arrack were seized from the house.<\/p>\n<p>      4.    Learned counsel for petitioner submitted that the<\/p>\n<p><span class=\"hidden_text\">BA No.6442\/08                     2<\/span><\/p>\n<p>offence under Section 8(2) of Abkari Act will not be attracted as<\/p>\n<p>against petitioner because there is no case and she was found<\/p>\n<p>dealing with article. As per the prosecution case itself, the first<\/p>\n<p>accused was in possession of arrack and petitioner was only in<\/p>\n<p>constructive possession of the article. The information received<\/p>\n<p>itself was that first accused was in possession of the article.<\/p>\n<p>The offence committed by petitioner would fall only under<\/p>\n<p>Section 64(A) of Abkari Act which provides that any owner of a<\/p>\n<p>building permits any person to use the building for manufacture<\/p>\n<p>sale or storing for sale of liquor etc. in contravention of the Act,<\/p>\n<p>he shall be punishable with fine which shall not less than<\/p>\n<p>Rs.25,000\/- unless he proves to the satisfaction of the court that<\/p>\n<p>all due and reasonable precautions were taken by him to prevent<\/p>\n<p>such use. The said offence is bailable one and petitioner can<\/p>\n<p>be said to have committed only such offence, even if the<\/p>\n<p>entire case is accepted. If, petitioner, who is the mother of first<\/p>\n<p>accused is remanded to custody on these allegations, she will<\/p>\n<p>suffer irreparable loss and injury and hence, she may be<\/p>\n<p>granted anticipatory bail, it is submitted.<\/p>\n<p><span class=\"hidden_text\">BA No.6442\/08                    3<\/span><\/p>\n<p>    On hearing both sides, I am satisfied that petitioner can be<\/p>\n<p>granted anticipatory bail on conditions.\n<\/p>\n<p>    Hence, the following order is passed:\n<\/p>\n<blockquote><p>            Petitioner shall surrender before the Magistrate<\/p>\n<p>            Court concerned within seven days from today and<\/p>\n<p>            she shall be released on bail on her executing bond<\/p>\n<p>            for Rs.25,000\/- with two solvent sureties each for the<\/p>\n<p>            like sum to the satisfaction of the learned Magistrate<\/p>\n<p>            on condition that she will report before the<\/p>\n<p>            Investigating Officer as and when directed and she<\/p>\n<p>            shall not commit any offence while on bail.<\/p>\n<\/blockquote>\n<p>    The petition is allowed.\n<\/p>\n<\/p>\n<p>                                                 K.HEMA, JUDGE<br \/>\ncsl<\/p>\n<p><span class=\"hidden_text\">BA No.6442\/08    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rugmini Amma vs State Of Kerala on 24 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6442 of 2008() 1.
