The Chairman,\n    Executive Committee,\n   Sports Development Authority of Tamilnadu,\n               Chennai - 600 084.                        ...\n                                                 Respondents\n\n                            * * *\n       Writ   Petition  filed  under  Article  226  of   the\nConstitution   of  India  praying  to  issue   a   Writ   of\nCertiorarified Mandamus as stated therein.\n                            * * *\n               For petitioner      : M\/s.G.Bala &amp; Daisy\n               For respondents : Mr.P.Srinivas for R1\n                            * * *\n\n\n\n                        O R D E R\n<\/pre>\n<p>       The  Writ  Petition has been filed  praying  for  the<\/p>\n<p>issuance  of a Writ of certiorarified mandamus to  call  for<\/p>\n<p>the  records  relating to the impugned order passed  by  the<\/p>\n<p>respondent   herein  in  his  proceedings   in   Se.Mu.Order<\/p>\n<p>No.17516\/Ni.A.Pa.1\/2002, dated 9.3.2005 and quash  the  same<\/p>\n<p>and consequently direct the respondents to grant all service<\/p>\n<p>and  monetary benefits to the petitioner, with  effect  from<\/p>\n<p>14.8.2003, within a time frame.\n<\/p>\n<\/p>\n<p>      2.Heard the learned counsel for the petitioner as well<\/p>\n<p>as for  the respondents.\n<\/p>\n<\/p>\n<p>     3.The brief facts of the case, leading to the filing of<\/p>\n<p>the writ petition, are as follows:-\n<\/p>\n<p>      The petitioner had joined in the government service as<\/p>\n<p>a  Football Coach, on 17.08.1976, and he was promoted as the<\/p>\n<p>District  Sports Officer in the year 1986.   The  petitioner<\/p>\n<p>was due for next promotion in the year 2003.  On 11.07.2003,<\/p>\n<p>he  was  served  with  a  show  cause  notice  alleging  six<\/p>\n<p>delinquencies against the petitioner for which  disciplinary<\/p>\n<p>action  was  to be initiated under Rule 17(b) of  the  Tamil<\/p>\n<p>Nadu  Civil  Services  (Discipline and  Appeal)  Rules.   On<\/p>\n<p>24.07.2003,  the  petitioner had submitted his  explanation.<\/p>\n<p>However,  the  petitioner was placed under  suspension  from<\/p>\n<p>14.08.2003, on the ground that an inquiry into grave charges<\/p>\n<p>was  contemplated.  On 09.10.2003, the respondent had framed<\/p>\n<p>the  charges  under  Rule  17(b) of  the  Tamil  Nadu  Civil<\/p>\n<p>Services  (Discipline and Appeal) Rules.   The  charge  memo<\/p>\n<p>consisted  of three counts of dereliction of duty.   As  per<\/p>\n<p>the  existing Government Orders the charge memo, under  Rule<\/p>\n<p>17(b),  can  be  framed for grave allegations  warranting  a<\/p>\n<p>severe  punishment. However, in the case of the  petitioner,<\/p>\n<p>the  allegations  have  been made only  for  the  reason  of<\/p>\n<p>denying the petitioner&#8217;s legitimate claim for promotion.<\/p>\n<p>      4.It  has been further stated that the first count  of<\/p>\n<p>charge  relate  to the alleged failure of the petitioner  to<\/p>\n<p>check   the  cash  book  and  other  registers  and  diaries<\/p>\n<p>resulting  in  his  subordinates making a complaint  to  the<\/p>\n<p>District Collector.  The second count of the charge is  that<\/p>\n<p>the petitioner had attended duty only for 74 days out of 275<\/p>\n<p>working days from 25.02.2002 to 11.02.2003, and that he  had<\/p>\n<p>failed  to be present, on 05.08.2003, when the Minister  for<\/p>\n<p>Sports and Youth Welfare had visited the office.  During the<\/p>\n<p>oral enquiry, both the counts were held to be false and  not<\/p>\n<p>proved.    The  third  count  of  the  charge  against   the<\/p>\n<p>petitioner  is for having failed to settle the  accounts  of<\/p>\n<p>the  summer coaching camp.  During the enquiry, none of  the<\/p>\n<p>prosecution  witnesses had deposed that the  petitioner  had<\/p>\n<p>indulged   in  mal-practice  or  misappropriation   of   the<\/p>\n<p>Government funds.  Only third count of the charge  was  held<\/p>\n<p>to  be proved.  Even though, the petitioner had submitted  a<\/p>\n<p>detailed   explanation   to   the  Disciplinary   Authority,<\/p>\n<p>requesting  him to drop all the proceedings, the respondent,<\/p>\n<p>on 09.03.2005, had imposed the major punishment of reduction<\/p>\n<p>in  rank to the post of Coach, for a period of three  years.<\/p>\n<p>The  respondent had passed the impugned order, treating  the<\/p>\n<p>period of suspension as leave, which is in violation of  the<\/p>\n<p>provisions  of the Fundamental Rules.  As per the provisions<\/p>\n<p>of  Rule 17(b), a delinquent officer cannot be imposed  with<\/p>\n<p>more than one punishment for a misconduct.  Whereas, in  the<\/p>\n<p>present case, the respondent had listed out as many as  four<\/p>\n<p>penalties,  including treating the period of  suspension  as<\/p>\n<p>leave,  violating  the statutory rules.  The  punishment  in<\/p>\n<p>reduction   in   rank  is  excessive,   harsh   and   highly<\/p>\n<p>disproportionate.   The petitioner had  maintained  a  clean<\/p>\n<p>record of service for the past 29 years of his service.<\/p>\n<p>      5.  In  the counter affidavit filed on behalf  of  the<\/p>\n<p>first  respondent, it has been stated that the writ petition<\/p>\n<p>is  not maintainable for the reason that the petitioner  has<\/p>\n<p>an  appellate remedy before the Executive Committee and  the<\/p>\n<p>petitioner  has  already filed an appeal  which  is  pending<\/p>\n<p>disposal.     Without awaiting the decision on  the  appeal,<\/p>\n<p>the  petitioner has prematurely approached this Court.   The<\/p>\n<p>petitioner&#8217;s  contention  that  the  proceedings  have  been<\/p>\n<p>initiated  against him at the verge of his  next  promotion,<\/p>\n<p>with  a  view to deny the petitioner&#8217;s legitimate claim  for<\/p>\n<p>promotion,  is  not  correct.  The disciplinary  proceedings<\/p>\n<p>have  been initiated only after the receipt of petitions  of<\/p>\n<p>allegations  against the petitioner from the  staff  of  the<\/p>\n<p>Sport  Development Authority of Tamil Nadu,  District  Unit,<\/p>\n<p>Kancheepuram, and forwarded by the District Collector.<\/p>\n<p>      6.  The  learned counsel, appearing on behalf  of  the<\/p>\n<p>respondents,  has  pointed out that  the  appeal  remedy  is<\/p>\n<p>provided under Rule 60 of the Service Rules for Employees of<\/p>\n<p>Sports  Development  Authority of Tamil  Nadu,  1998,  which<\/p>\n<p>reads as follows :-\n<\/p>\n<blockquote><p>      &#8220;The  Executive Committee or the Authority as  the<\/p>\n<p>      case  may be, shall be the Appellate Authority  in<\/p>\n<p>      all  service matters in which the Member Secretary<\/p>\n<p>      or  the Executive committee respectively has  been<\/p>\n<p>      designated as the Appointing Authority.&#8221;<\/p><\/blockquote>\n<p>      7.The  learned  counsel appearing  on  behalf  of  the<\/p>\n<p>petitioner  had  stated  that  the  petitioner,  during  the<\/p>\n<p>pendency  of the writ petition, has submitted an appeal,  on<\/p>\n<p>20.09.2005,   to   the  Appellate  Authority,   the   second<\/p>\n<p>respondent herein, which is still pending, as no orders have<\/p>\n<p>been  passed  till  date.   The  learned  counsel  for   the<\/p>\n<p>petitioner   had  stated  that  it  would  suffice,  if  the<\/p>\n<p>Appellate  Authority,  the  second  respondent  herein,   is<\/p>\n<p>directed  to  dispose of the appeal within a specified  time<\/p>\n<p>frame.\n<\/p>\n<\/p>\n<p>      8.On such submission being made, the second respondent<\/p>\n<p>is   directed  to  dispose  of  the  appeal  filed  by   the<\/p>\n<p>petitioner,  on  20.09.2005, under Rule 60  of  the  Service<\/p>\n<p>Rules for Employees of Sports Development Authority of Tamil<\/p>\n<p>Nadu,1998,  on merits and in accordance with law,  within  a<\/p>\n<p>period  of  eight weeks from the date receipt of a  copy  of<\/p>\n<p>this order.\n<\/p>\n<\/p>\n<\/p>\n<p>      With  the  above  directions,  the  writ  petition  is<\/p>\n<p>disposed of .\n<\/p>\n<p>SSM<\/p>\n<p>To<\/p>\n<p>1.
