           Petitioner, the mother of Shaji,<\/p>\n
whose body was found hanging on the upstair of<\/p>\n
the  house,   being          constructed                 by him,  on<\/p>\n
6\/7\/2006, filed this petition under Article<\/p>\n
226 of Constitution of India, for a direction<\/p>\n
to respondents 1 and 2 to appoint a Senior<\/p>\n
Police   Officer             to          investigate           Crime<\/p>\n
No.411\/2006    of          Varkala              Police       Station<\/p>\n
registered under the caption “man missing” and<\/p>\n
subsequently converted under Section 174 of<\/p>\n
Code of Criminal Procedure. Deceased Shaji was<\/p>\n
working in Gulf. He married Lyna and was<\/p>\n
staying with her and the father-in-law                          and<\/p>\n
mother-in-law and           their children, since his<\/p>\n
return from Gulf 1=             years prior to the date<\/p>\n

of his missing. Sunil, bother-in-law of the<\/p>\n
deceased     Shaji   came to   the  house  of  the<\/p>\n
petitioner on 3\/7\/2006 and informed that Shaji<\/p>\n
was    missing   five  days  earlier to  3\/7\/2006.<\/p>\n
Petitioner went to Varkala Police Station and<\/p>\n
furnished the information of missing of Shaji<\/p>\n
based on which Crime No.411\/2006 was registered<\/p>\n
under     the  caption  man  missing. On  6\/7\/2006<\/p>\n
body was found hanging in decomposed stage in<\/p>\n
the upstair portion of the       building,   which<\/p>\n
was being constructed by Shaji. Petition is<\/p>\n
filed      alleging  that  there  was   no  proper<\/p>\n
investigation      and  though  father-in-law  and<\/p>\n
brother-in-law of Shaji had sustained injuries,<\/p>\n
suspected to be caused in the incident which<\/p>\n
led     to   the   death  of   Shaji,  no   proper<\/p>\n
investigation     was  conducted.  It  was    also<\/p>\n
contended     that   wife  of  Shaji  had  illicit<\/p>\n

relationship with one    Sathishan, while Shaji<\/p>\n
was in Gulf and on his return, on getting<\/p>\n
information which was not originally believed<\/p>\n
by Shaji, he used to     quarrel with the wife.<\/p>\n
Petitioner would contend that it was disclosed<\/p>\n
to    her that some times prior to the date of<\/p>\n
missing there was quarrel between father-in-law<\/p>\n
and the wife of Shaji with him and something<\/p>\n
occurred and Matador Tempo Van owned by Shaji<\/p>\n
was taken by Sathishan and it is suspected that<\/p>\n
body was shifted. It is also contended that<\/p>\n
postmortem certificate shows the contusion of<\/p>\n
8x4x0.3 c.m on the right of front of chest 7 cm<\/p>\n
to the right of midline and 4 c.m above costal<\/p>\n
margin, which shows that death was not due to<\/p>\n
hanging.     It is also  contended  that  close<\/p>\n
relatives      of the  wife  of  Shaji      are<\/p>\n
influential    and closed  to  leaders  of  the<\/p>\n

community and it is in such circumstances, no<\/p>\n
proper investigation is being conducted. It is<\/p>\n
therefore contended that, a direction    is to be<\/p>\n
issued to conduct proper investigation by a<\/p>\n
Senior Police Officer.\n<\/p>\n
           2. Though there was a direction to file<\/p>\n
a statement, two years back no statement was<\/p>\n
filed by the respondents.\n<\/p>\n
           3. Learned  Government   Pleader   made<\/p>\n
available the case diary. On going through the<\/p>\n
case diary, I find that proper investigation<\/p>\n
was not conducted. There are several suspicious<\/p>\n
circumstances,     which    warrants   a    proper<\/p>\n
investigation. Though      Shaji was living along<\/p>\n
with the wife and in-laws and it was alleged<\/p>\n
that Shaji was missing       five days prior to<\/p>\n
3\/7\/2006,     factum of missing was not reported<\/p>\n
to the police, either by the       wife   or  the<\/p>\n

in-laws. The fact was not even informed to the<\/p>\n
mother      or other relatives  of  Shaji.  First<\/p>\n
statement recorded from the wife and father-in-<\/p>\n
law    and brother-in-law  show that as stated by<\/p>\n
the petitioner, petitioner was informed aboubt<\/p>\n
the missing only on 3\/7\/2006 by Sunil, brother-<\/p>\n
in-law of Shaji. Statement recorded shows that<\/p>\n
according     to the wife  and  in-laws,  on  the<\/p>\n
previous night of date of missing, there was an<\/p>\n
attempt by Shaji to hang himself, after getting<\/p>\n
the    wife hanged and as wife was not willing to<\/p>\n
join the husband, the fact was informed to the<\/p>\n
father-in-law.     Statement   shows  that    the<\/p>\n
deceased had allegedly     tied rope,  which was<\/p>\n
being used for the well on a fan. It was there,<\/p>\n
even in the morning. If that be the case, in<\/p>\n
the normal human conduct, if the husband is<\/p>\n
missing from the morning of the very next day,<\/p>\n

the wife and in-laws would definitely doubt<\/p>\n
whether he committed suicide as there was an<\/p>\n
attempt     earlier. In  that   case,  one  would<\/p>\n
expect them to inform the relatives of the<\/p>\n
husband of Shaji or to make a thorough search<\/p>\n
or at least inform the police. But that was not<\/p>\n
done, what was admittedly done.\n<\/p>\n
           4. Though  due to decomposed stage of<\/p>\n
the body, external injuries could not be found<\/p>\n
out    by   Dr.Rema who  conducted  the  autopsy,<\/p>\n
postmortem certificate reveals that there was a<\/p>\n
contusion     of 8x4x0.3 c.m on the right side of<\/p>\n
front of chest 7 c.m to right of midline and 4<\/p>\n
cm above costal margin. How this injury was<\/p>\n
sustained and whether it is possible, in the<\/p>\n
case of a suicide by hanging, was not properly<\/p>\n
considered by the Investigating Officer. It is<\/p>\n
also seen from the case diary that by the time<\/p>\n

\n                          7<\/span><\/p>\n
body    of   Shaji was  found  in  the decomposed<\/p>\n
stage, there were injuries on the body of both<\/p>\n
the father-in-law      and brother-in-law. Though<\/p>\n
explanation was offered by the brother-in-law,<\/p>\n
that he had fallen while sitting on a stool<\/p>\n
and sustained injury and treatment record was<\/p>\n
also procured, it is clear that       considering<\/p>\n
the nature of the incident and conduct of the<\/p>\n
relatives, a proper investigation should have<\/p>\n
been carried out. In such circumstances, it is<\/p>\n
absolutely     necessary   to  direct  a   proper<\/p>\n
investigation,     irrespective  of  the  finding<\/p>\n
arrived at by the Investigating Officer, based<\/p>\n
on the registration of the case under Section<\/p>\n
174 of Code of Criminal Procedure.<\/p>\n
             Writ  petition  is  allowed. Second<\/p>\n
respondent      Director   General   of   Police,<\/p>\n
Thiruvananthapuram     is  directed   to  entrust<\/p>\n

\n                         8<\/span><\/p>\n
investigation     of Crime   No.411  of  2006   of<\/p>\n
Varakala Police Station to the CBCID with a<\/p>\n
direction      that   it   shall    be   properly<\/p>\n
investigated by a superior police officer not<\/p>\n
below     the  rank of  Deputy  Superintendent  of<\/p>\n
Police. All efforts should be made to find out<\/p>\n
the     truth   and complete   the  investigation<\/p>\n
expeditiously and file a final report before<\/p>\n
the       concerned   Magistrate.    Investigating<\/p>\n
Officer is directed to file report before Sub<\/p>\n
Divisional Magistrate to     send the records to<\/p>\n
the concerned Magistrate including the FIR.<\/p>\n
