JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n                     Date\n: 13\/09\/2007 \n\n \n\n \n \n\n\n \n\nORAL\nORDER<\/pre>\n<p> :(Per : HONOURABLE MR.JUSTICE J.R.VORA)<\/p>\n<p>1.\t\tThe<br \/>\nabove referred Criminal  Appeal is preferred by the State  against<br \/>\nthe judgment and  order  delivered by  Presiding Officer, Third Fast<br \/>\nTrack Court, Kheda  at Nadiad   on  25th of  January,  2005, in<br \/>\nSessions Case No. 94 of  2003.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>         42 accused came to be charge-sheeted for the offences<br \/>\npunishable under Sections 147, 148, 149, 435, 436 and 336 of the<br \/>\nIndian Penal Code as well as for the offence punishable under Section<br \/>\n135 of the Bombay Police Act.  Trial proceeded against  accused Nos.<br \/>\n1 to  16  and  18  to  42 and those accused are opponents herein came<br \/>\nto be acquitted by the Trial Court, vide judgment and order dated<br \/>\n25.1.05.\n<\/p>\n<p>3.\t\tOn<br \/>\ncalling for the Record and  Proceedings, it is found that at the time<br \/>\nof framing of the charge, accused No. 17 Sureshbhai  Ramanbhai  was<br \/>\nnot available for trial and learned Advocate for the accused<br \/>\nsubmitted an application vide Exhibit ?  4 to separate the trial of<br \/>\nsaid accused No. 17 Sureshbhai  from other accused. The said<br \/>\napplication came to be granted by learned Trial Judge on 20.11.2004<br \/>\nwhereby the  learned Trial  Judge though directed  to separate the<br \/>\ntrial of accused No. 17 Sureshbhai  but  at  the  same time directed<br \/>\nKapadvanj Rural Police to file a separate charge-sheet against the<br \/>\nsaid accused No. 17.  However,  at  this juncture, we do not probe<br \/>\nfurther as to the legality of the order passed by the Trial Court in<br \/>\nthis delay condonation application, and suffice it to say that,<br \/>\naccused No.17 Sureshbhai Ramanbhai was not put to trial.\n<\/p>\n<p>4.\t\tIt<br \/>\nis  also to be noted  that Opponent No.31  Gordhanbhai Manibhai<br \/>\nPatel  has expired  and  necessary  note has  been taken by this<br \/>\nCourt vide order passed on 22.8.2007.\n<\/p>\n<p>5\t\tIn<br \/>\npreferring above Criminal  Appeal against the order of acquittal<br \/>\ndelay has been caused of 40 days and, hence, this Application by  the<br \/>\n State for condonation of delay.\n<\/p>\n<p>5\t\tLearned<br \/>\n  APP  Mr. K.C. Shah    for the State and learned Advocate Mr. H.J.<br \/>\nTrivedi for the present opponents were heard at length.\n<\/p>\n<p>6\t\tHaving<br \/>\n  gone   through the  application and having regard to rival<br \/>\ncontentions,  though  this Application is opposed  by the other side,<br \/>\n it  clearly appears that the State has made out sufficient grounds<br \/>\nfor condonation  of  delay as it clearly appears that delay has been<br \/>\ncaused on account of  administrative reasons and for collecting<br \/>\nnecessary material  and papers.  From the grounds  averred in paras<br \/>\n4,5 and 6 of  the  Application by the State, it clearly appears that<br \/>\nno inaction or negligence can be attributed to the State in causing<br \/>\ndelay of 40 days in preferring the Appeal.  Taking liberal view,<br \/>\nthis Application deserves to  be allowed.\n<\/p>\n<p>7\t\tIn<br \/>\nview of above,  this Application  is allowed.  Delay caused of 40<br \/>\ndays in preferring the Criminal  Appeal is condoned. Rule made<br \/>\nabsolute.
