It is<br \/>\n\tfurther stated that this being a very serious allegation, which is<br \/>\n\tmade on oath, the applicants may be directed to disclose the<br \/>\n\tinformation on the basis of which such an untrue allegation has been<br \/>\n\tmade.\n<\/p>\n<p>\tOn<br \/>\n\t14.12.2010, this Court had passed an order in the following terms:\n<\/p>\n<p>&#8220;S.O.\n<\/p>\n<p>to 27.12.2010.\n<\/p>\n<p>To<br \/>\nbe heard with Special Civil Application No.13498 of 2010.\n<\/p>\n<p>The<br \/>\napplicant to justify the averments made in sub-para 2 of paragraph 2<br \/>\nof the application.&#8221;\n<\/p>\n<p>\tPursuant<br \/>\n\tto the said order, on behalf of the applicants, applicant No.2 has<br \/>\n\tfiled an affidavit stating that the petitioner wishes to make<br \/>\n\tavailable most the material which lead him to believe that the<br \/>\n\tsatisfaction note\/ground for search have been fabricated, malafide<br \/>\n\tand based on material collected\/fabricated post facto.  It is stated<br \/>\n\ttherein that having failed to persuade the petitioner for making<br \/>\n\tnon-existent disclosure under pressure through various means, the<br \/>\n\tDepartment had started taking recourse of fabricating papers and so<br \/>\n\tcalled evidences to justify the search as detailed in the affidavit.<br \/>\n\tIt is further averred that the Department had given notice to some<br \/>\n\tparties to extract confession statement against the petitioner.<br \/>\n\tBeing alarmed the petitioner had sent a letter to the Deputy<br \/>\n\tDirector of Income Tax (Inv) asking them to desist from using such<br \/>\n\tparties under duress to extract illegal confession statements. In<br \/>\n\tfact the party had been given legal notice by the petitioner clearly<br \/>\n\tsaying therein that legal action will be taken against the party for<br \/>\n\tfailure of submitting account confirmation and making defamatory<br \/>\n\tstatement and also committing breach of trust for spreading the<br \/>\n\tcanard that the material supplied by them was under bogus bills. It<br \/>\n\tis further stated that it had come to the notice of the petitioner<br \/>\n\tthat said party\/parties were facing multiple tax proceedings and<br \/>\n\twere thus totally under mercy and influences of tax authorities. It<br \/>\n\tis also averred  that in the affidavit filed by the respondent No.2,<br \/>\n\tit had been stated that the petitioner No.2 had requested the<br \/>\n\tADIT\/DDIT (Investigation) not to take statement of Shri Bharat Shah.<br \/>\n\tThat the petitioner is<br \/>\n\tnot aware who Shri Bharat Shah is and has never asked the Income Tax<br \/>\n\tDepartment not to take the statement of Shri Bharat Shah. The letter<br \/>\n\tto Income Tax Department and the legal notice to the party only<br \/>\n\tmentioned the name of the firm. It is clearly evident that someone<br \/>\n\tcalled Shri Bharat Shah is being used by the Income Tax Department<br \/>\n\tto extract confession\/illegal statement in order to justify the<br \/>\n\tillegal action of search. It is, inter<br \/>\n\talia, stated that<br \/>\n\tpressure tactics had been used right from beginning onto the<br \/>\n\tpetitioner to make disclosure of non-existent income. It is<br \/>\n\tsubmitted that inference is obvious that the Department did not have<br \/>\n\tany material to launch search in first place and subsequent<br \/>\n\tnon-discovery of evidence relating to unaccounted income, assets<br \/>\n\tetc. and in light of resistance shown by the petitioner and after<br \/>\n\tfailing to make petitioner to make any non-existent disclosure, the<br \/>\n\tDepartment has resorted to create papers and evidence by taking<br \/>\n\tstatement from parties already facing various income tax inquiries<br \/>\n\tfor years.  The main refrain of the applicants in the affidavit is<br \/>\n\tthat the Department has been trying to pressurize the petitioner and<br \/>\n\this representative to make non-existent disclosure. It is further<br \/>\n\tstated that the petitioner No.2 is in possession of some other<br \/>\n\trelevant material, which if produced through this affidavit may lead<br \/>\n\tto further changes of track of search related investigation, further<br \/>\n\t&#8220;fishing and roving&#8221; inquiry, further lengthening of on<br \/>\n\tgoing investigation and further collection of confession under<br \/>\n\tduress, which altogether will be detrimental to the interest of the<br \/>\n\tpetitioner. The petitioner has requested to permit the petitioner to<br \/>\n\tpresent himself in person for restricted viewing of such papers and<br \/>\n\tnarration of some other facts in confidentiality to the Court.\n<\/p>\n<p>\tOn<br \/>\n\tthe other hand, Mr. M. R. Bhatt, learned Senior Advocate appearing<br \/>\n\tfor the respondents has strongly objected to the allegations that<br \/>\n\tthe satisfaction note may have been fabricated later on, post-search<br \/>\n\tby the respondents in order to substantiate their action.\n<\/p>\n<p>\tThis<br \/>\n\tCourt has perused the satisfaction note and the material on record<br \/>\n\tand is satisfied that the allegation made in the application is<br \/>\n\twithout any basis whatsoever.
