Justice T.R.RAMACHANDRAN NAIR\n\n Dated :08\/08\/2008\n\n O R D E R\n         P.R.RAMAN &amp; T.R.RAMACHANDRAN NAIR, JJ.\n\n                   ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~\n                     W.P.(C).No.24041 of 2008-K\n                   ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~\n\n                Dated this the 8thday of August, 2008\n\n                           J U D G M E N T\n<\/pre>\n<p>RAMAN, J.\n<\/p>\n<p>      The petitioner is stated to be the President of the Taliparamba<\/p>\n<p>Trichambaram Kanhirangad Devaswom (for short, &#8216;T.T.K Devaswom&#8217;).<\/p>\n<p>The T.T.K.Devaswom is functioning as per the scheme framed by the<\/p>\n<p>Sub Court, Payyannur in O.P.No.60\/1987. As per the scheme, the<\/p>\n<p>temple has to be administered by a Managing Committee consisting of<\/p>\n<p>eight members out of which, five are to be elected from hereditary<\/p>\n<p>trustees and the remaining three are to be appointed from the public<\/p>\n<p>as non-hereditary trustees by the first respondent, namely, the Deputy<\/p>\n<p>Commissioner The term of the present committee expired on<\/p>\n<p>03\/08\/2008. Election to the Managing Committee of the five member<\/p>\n<p>hereditary trustees in the Board is already over. What remains is only<\/p>\n<p>election to the non-hereditary trustees. There is a provision in the<\/p>\n<p>scheme enabling the Deputy Commissioner to pass such orders in the<\/p>\n<p>nature of an interim measure enabling the out going committee, to<\/p>\n<p>continue till new managing committee takes charge after conducting<\/p>\n<p>election. Ext.P1 is the application of the petitioner submitted before<\/p>\n<p>W.P.(C).NO.24041\/2008-K<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>the first respondent for permitting the present managing committee<\/p>\n<p>to continue its function till a new managing committee is constituted<\/p>\n<p>and that committee starts functioning. He seeks direction for disposal<\/p>\n<p>of Ext.P1.\n<\/p>\n<p>      2.    Heard learned Government Pleader also.
