C.\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The petitioner has sought the quashing of the order dated 22nd<br \/>\nJuly, 2010 passed by the Executive Engineer, Jhansi Prakhand,<br \/>\nBetwa Nahar, Jhansi by which her application claiming<br \/>\ncompassionate appointment on the death of her father-in-law has<br \/>\nbeen rejected solely on the ground that the daughter-in-law is not<br \/>\nincluded in the definition of family of father-in-law.\n<\/p>\n<p>Sri Vinod Sinha, learned counsel for the petitioner contends that<br \/>\nthe daughter-in-law is included in the definition of family of<br \/>\nfather-in-law and in support of this contention he has placed before<br \/>\nthe Court the judgment rendered by a Division Bench of this Court<br \/>\nin Zila Panchayat, Kaushambi &amp; Anr. Vs. Lalti Devi &amp; Anr.,<br \/>\n2008 (1) AWC 1035.\n<\/p>\n<p>Learned Standing Counsel appearing for the respondents states<br \/>\nthat it will not be necessary to file a counter affidavit and the<br \/>\npetition may be disposed of at this stage.\n<\/p>\n<p>In Zila Panchayat, Kaushambi (supra), this Court observed as<br \/>\nfollows:-\n<\/p>\n<p>&#8220;Learned counsel for the appellant tried to argue that the definition of family<br \/>\ncontained in Rule 2(c) is exhaustive though we do not find any substance<br \/>\ntherein. From a bare reading thereof, it is evidence that the said definition is<br \/>\ninclusive and it is reproduced as under:\n<\/p>\n<p>&#8220;2(c). &#8216;family&#8217; shall include the following relations of the deceased<br \/>\nGovernment servant:\n<\/p>\n<p>(i) Wife or husband;\n<\/p>\n<p>(ii) Sons;\n<\/p>\n<p>(iii) Unmarried and widowed daughters.&#8221;\n<\/p>\n<p>We are fortified in taking the aforesaid view that Rule 2 (c) is inclusive from<br \/>\nthe Division Bench judgment of this Court in the case of <a href=\"\/doc\/1658004\/\">State of U.P. v.<br \/>\n Rajendra Kumar and others<\/a>, 1999 ACJ 545 : 2000 (1) AWC 155. Similar<br \/>\nview has been taken by the Hon&#8217;ble Single Judge in the case of <a href=\"\/doc\/1868565\/\">Manoj Kumar<br \/>\nSaxena v. District Magistrate, Bareilly and others<\/a>, 2000 (2) ESC 967 (All)<br \/>\nand in <a href=\"\/doc\/1955519\/\">Smt. Urmila Devi v. U.P. Power Corporation Ltd.,<\/a> 2004 (2) ESC 180<br \/>\n(All) : 2003 (4) AWC 3205 and we are in respectful agreement with the view<br \/>\nexpressed therein. &#8230;&#8230;\n<\/p>\n<p>In this view of the matter, the daughter-in-law, who becomes a member of the<br \/>\nfamily of her husband, in our view, is included in the definition of &#8216;family&#8217; of<br \/>\nfather-in-law and after his death, in the absence of any other legal heir, she is<br \/>\nentitled to claim compassionate appointment provided all other conditions as<br \/>\nrequired in law for such recruitment are fulfilled. We make it clear that the<br \/>\naforesaid right of daughter-in-law would not be available, if she has remarried<br \/>\nor repatriated to her parents place and in such case the position would be<br \/>\ndifferent. &#8230;&#8230;..&#8221;\n<\/p>\n<p>It is, therefore, clear from the aforesaid judgment in Zila<br \/>\nPanchayat, Kaushambi (supra) that daughter-in-law is included in<br \/>\nthe family of the father-in-law.\n<\/p>\n<p>The order dated 22nd July, 2010 passed by the Executive Engineer<br \/>\ncannot, therefore, be sustained. It is, accordingly, set aside. The<br \/>\nrespondents shall consider the case of the petitioner afresh in<br \/>\naccordance with the relevant rules and pass an appropriate order<br \/>\nexpeditiously, preferably within a period of three months from the<br \/>\ndate a certified copy of this order is filed by the petitioner.\n<\/p>\n<p>The writ petition is allowed to the extent indicated above.\n<\/p>\n<p>Order Date :- 12.8.2010<br \/>\nGS\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Smt.
