Justice R.BASANT\n\n Dated :07\/03\/2008\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                        B.A.No.1407 of 2008\n                    ----------------------------------------\n            Dated this the 7th day of March 2008\n\n                               O R D E R\n<\/pre>\n<p>      Application for anticipatory bail. Petitioners are accused 1<\/p>\n<p>to 8.    They face allegations in a crime registered alleging<\/p>\n<p>offences punishable inter alia under Section 452 I.P.C. They<\/p>\n<p>were not named as accused in the F.I.R.                     In the course of<\/p>\n<p>investigation, they have been arrayed as accused.<\/p>\n<p>      2.    A pregnant lady was attacked and injuries were<\/p>\n<p>inflicted on her. The injured lady was rushed to a local hospital.<\/p>\n<p>It is alleged that the local hospital refused admission to the lady<\/p>\n<p>and wanted her to be taken to some other centre for treatment.<\/p>\n<p>The hospital authorities allegedly refused to even spare the<\/p>\n<p>ambulance to carry the lady to the hospital. Ultimately, the lady<\/p>\n<p>had to be carried to another hospital in another vehicle. Before<\/p>\n<p>she reached the next hospital, she succumbed to her injuries.<\/p>\n<p>The local people were allegedly infuriated by the conduct of the<\/p>\n<p>hospital authorities. The allegation in this crime is that such<\/p>\n<p>persons &#8211; they are alleged to include the petitioners herein, had<\/p>\n<p>unleashed an attack on the hospital later because of the<\/p>\n<p>dissatisfaction with the conduct of the hospital authorities.<\/p>\n<p>Crime has been registered. The only non-bailable offence is the<\/p>\n<p><span class=\"hidden_text\">B.A.No.1407\/08                   2<\/span><\/p>\n<p>one punishable under Section 452 I.P.C. Investigation is in<\/p>\n<p>progress. The petitioners apprehend imminent arrest.<\/p>\n<p>      3.    The learned counsel for the petitioners submits that<\/p>\n<p>the petitioners are innocent. It is true that there were some<\/p>\n<p>tension at the relevant time as the hospital had refused to<\/p>\n<p>entertain the patient or co-operate for giving her prompt medical<\/p>\n<p>aid. But the allegations raised against the petitioners are totally<\/p>\n<p>incorrect. They are not guilty of any offence alleged. The police<\/p>\n<p>had come to the scene, it is submitted; but at that point of time,<\/p>\n<p>the police did not think it necessary to proceed against anyone of<\/p>\n<p>the local people. Subsequently the allegations are being raised<\/p>\n<p>against the petitioners.\n<\/p>\n<p>      4.    The   learned    Public   Prosecutor    opposes    the<\/p>\n<p>application. The learned Public Prosecutor contends that the<\/p>\n<p>attack on the hospital is well borne out by the materials that<\/p>\n<p>have been collected from the scene of the crime which bears tell<\/p>\n<p>tale indications about the acts of violence against the hospital.<\/p>\n<p>Investigation clearly reveals the complicity of the petitioners.<\/p>\n<p>There is absolutely no reason to doubt or suspect the conclusion<\/p>\n<p>presently drawn that the petitioners were also involved in the<\/p>\n<p>attack against the hospital. Such attacks against hospitals must<\/p>\n<p>be frowned upon. Serious view is liable to be taken. At any rate<\/p>\n<p><span class=\"hidden_text\">B.A.No.1407\/08                   3<\/span><\/p>\n<p>there is absolutely no reason warranting or justifying the<\/p>\n<p>invocation of the extraordinary equitable discretion under<\/p>\n<p>Section 438 Cr.P.C. Petitioners may be directed to surrender<\/p>\n<p>before the learned Magistrate and seek regular bail.<\/p>\n<p>     5.     Having considered all the relevant inputs, I find merit<\/p>\n<p>in the opposition by the learned Public Prosecutor. I am satisfied<\/p>\n<p>that there are no features in this case which would justify<\/p>\n<p>invocation of the extraordinary equitable discretion under<\/p>\n<p>Section 438 Cr.P.C.      This, I agree with the learned Public<\/p>\n<p>Prosecutor, is a fit case where the petitioner must appear before<\/p>\n<p>the investigating officer or the learned Magistrate having<\/p>\n<p>jurisdiction and then seek regular bail in the normal and<\/p>\n<p>ordinary course.\n<\/p>\n<p>     6.     In the result, this petition is dismissed.
