No. 18 of 1991 by the<br \/>\nIndustrial Tribunal, Vadodara rejecting the petitioner&#8217;s claim for<br \/>\npermanency with effect from 01.06.1977 and further to declare the<br \/>\npetitioner is entitled to permanency with effect from 01.06.1977.\n<\/p>\n<p>2.0\tSpecial<br \/>\nCivil Application No. 8031 of 1999 has been preferred by the<br \/>\nMunicipal Corporation with a prayer to quash and set aside the<br \/>\nimpugned Award dated 09.10.1998 passed by the Industrial Tribunal,<br \/>\nVadodara in Reference (I.T) No. 18 of 1991 directing the<br \/>\npetitioner-Municipal Corporation to make the respondent herein<br \/>\npermanent and regular with effect from 01.06.1992 irrespective of the<br \/>\npolicy of the petitioner-Corporation as well as vacancies.\n<\/p>\n<p>3.0\tSpecial<br \/>\nCivil Application No. 8517 of 1999 has been preferred by Municipal<br \/>\nCorporation with a prayer to quash and set aside the impugned award<br \/>\ndated 13.01.1999 passed by the Industrial Tribunal in Reference (<br \/>\nI.T.) No. 87 of 1992 directing the petitioner-Corporation to treat<br \/>\nthe respondents herein as permanent with effect from 05.11.1992 and<br \/>\ngive all the consequential benefits.\n<\/p>\n<p>4.0\tHeard<br \/>\nlearned advocates for the respective parties.\n<\/p>\n<p>5.0\tThese<br \/>\npetitions arose out of identical issues in respect of regularization<br \/>\nof services of the petitioners-workmen. It is pertinent to note that<br \/>\nthe said issues have been dealt with and decided by the Full Bench of<br \/>\nthis Court in the case of <a href=\"\/doc\/1650943\/\">Amreli Municipality v. Gujarat<br \/>\nPradesh Municipal Employees Union,<\/a> reported in 2004(2) GLH 692,<br \/>\nwherein in clause 12. 1 reads as under:\n<\/p>\n<p>\t12.1\tAfter  considering<br \/>\nthe  decisions  cited before<br \/>\nus, the<br \/>\nfollowing principles emerge:\n<\/p>\n<blockquote><p>      (A) No  regularisation  or permanency can be effected<br \/>\n              de  hors  the   statutory   provisions   or   the<br \/>\n              guidelines.\n<\/p><\/blockquote>\n<blockquote><p>      (B) Long service put in by the workmen itself may not<br \/>\n              be  a  ground  to  regularise services of ad hoc\/<br \/>\n              temporary workmen against the sanctioned  set  up<br \/>\n              without   following   statutory   procedure   of<br \/>\n              recruitment.   At   the   most,   Labour   Court\/<br \/>\n              Industrial   Tribunal  can  issue  direction  for<br \/>\n              consideration   of    absorption    subject    to<br \/>\n              availability of posts on the establishment.<br \/>\n      (C) To  avoid  nepotism  and  corruption, no backdoor<br \/>\n              entry in service;\n<\/p><\/blockquote>\n<blockquote><p>      (D) Financial capacity of  the  local  body  to  have<br \/>\n              additional  burden is a relevant consideration to<br \/>\n              be kept in mind while ordering regularisation  or<br \/>\n              absorption.\n<\/p><\/blockquote>\n<p>6.0\tOn<br \/>\nthe facts of the case, it is an admitted position that the<br \/>\npetitioners-workmen were not appointed regularly and, therefore, in<br \/>\nview of the aforesaid decision, they cannot be regularized. However,<br \/>\nlooking to the fact that the petitioners-workmen have been contined<br \/>\nfor almost 11 years, as and when vacancy<br \/>\narises, the respondent-Municipality will follow the guidelines laid<br \/>\ndown in the aforesaid decision if the case of Amreli Municipality  (<br \/>\nsupra) and shall extend the benefits to the workmen. The award of the<br \/>\nLabour Court is modified accordingly.
