Nanavati waives notice for respondent.\n<\/p>\n<p>The<br \/>\n\tpresent appeal is directed against the judgment and order dated 29th<br \/>\n\tJune, 2010 passed by the learned Single Judge in Special Civil<br \/>\n\tApplication No. 1201 of 1999, whereby the learned Single Judge has<br \/>\n\tordered to grant all financial benefits available to the petitioner<br \/>\n\tas Assistant Librarian and the differences of the emoluments and<br \/>\n\tother financial benefits receivable by the petitioner, treating him<br \/>\n\tas regularly appointed Assistant Librarian.\n<\/p>\n<p>The<br \/>\n\tshort facts are that the respondent-original petitioner was<br \/>\n\tappointed as Junior Clerk on 1.10.1963  in the Institute of<br \/>\n\tAgriculture, Anand. In  1972,  he was transferred to Gujarat<br \/>\n\tAgricultural University as Junior Clerk. On 23.5.1974, he was<br \/>\n\tpromoted as Publication Assistant and on 17.4.1976, he was promoted<br \/>\n\tas Superintendent. On 22.6.1976, the respondent-original petitioner<br \/>\n\twas posted as Assistant Librarian. In 1984, the respondent-original<br \/>\n\tpetitioner passed Bachelor Degree in Library and Information<br \/>\n\tScience. On 17.11.1986, without following any regular selection<br \/>\n\tprocess, the respondent-original petitioner was appointed as<br \/>\n\tAssistant Librarian on ad-hoc basis for a period of six months. On<br \/>\n\t19.5.1988, his appointment on ad-hoc basis was cancelled and he was<br \/>\n\ttransferred to his original post. On 16.8.1989, Board of the<br \/>\n\tUniversity rejected the claim of the respondent-original petitioner<br \/>\n\tfor regularization of his services as Assistant Librarian and it was<br \/>\n\tresolved to fill up the post of Assistant Librarian through public<br \/>\n\tadvertisement. On 1.1.1991, the respondent-original petitioner<br \/>\n\tobtained Master&#8217;s Degree in Library Science and Information Science,<br \/>\n\twhich was requisite qualification for the post of Assistant<br \/>\n\tLibrarian. On 12.3.1997, the respondent-original petitioner was<br \/>\n\tpromoted to the post of Assistant Administrative Officer and on<br \/>\n\t15.2.1999, the respondent filed  petition claiming his appointment<br \/>\n\tto the post of Assistant Librarian as regular appointment and prayed<br \/>\n\tfor all consequential benefits including difference of salary etc.<br \/>\n\tOn 31.8.2002, the respondent attained the age of superannuation and<br \/>\n\tretired as Assistant Administrative Officer. Thereafter, the<br \/>\n\tpetition came up for hearing before the learned Single Judge on<br \/>\n\t29.6.2010 and the learned Single Judge found that all benefits must<br \/>\n\tbe made available to the petitioner as that of Assistant Librarian<br \/>\n\tand directed accordingly for the reasons recorded in the judgment.<br \/>\n\tUnder the circumstances, the present appeal before us.\n<\/p>\n<p>We<br \/>\n\thave heard Mr. D.G. Chauhan, learned counsel appearing for the<br \/>\n\tappellants and Mr. P.R. Nanavati with Mr. Acharya, learned counsel<br \/>\n\tfor the respondent.\n<\/p>\n<p>It<br \/>\n\tis an admitted position that the learned counsel for the<br \/>\n\trespondent-original petitioner has not been able to show any<br \/>\n\tdocument whereby the original petitioner was selected as Assistant<br \/>\n\tLibrarian and was regularly appointed as Assistant Librarian. It is<br \/>\n\talso not in dispute that requisite qualification for the post of<br \/>\n\tAssistant Librarian was Master&#8217;s Degree in Library Science and<br \/>\n\tInformation Science which the respondent-original petitioner<br \/>\n\tacquired only on 1.1.1991. Therefore, the factum of the posting of<br \/>\n\tthe petitioner as Assistant Librarian on 22.6.1976 whether should<br \/>\n\tenure benefit as that of Assistant Librarian for all purposes or not<br \/>\n\tis an aspect to be considered in the present appeal.\n<\/p>\n<p>It<br \/>\n\tis hardly required to be stated that if any employee is selected by<br \/>\n\tundergoing regular selection process and thereafter if he is given<br \/>\n\tappointment on temporary basis and thereafter if he continues, such<br \/>\n\tmay enure benefit as that of regular appointment, salary etc to such<br \/>\n\tperson. But in a case where an employee has not undergone regular<br \/>\n\tselection process and is only holding the post by way of transfer or<br \/>\n\totherwise, that too,  when such person is not holding requisite<br \/>\n\teducational qualification for the post in question, in our view,<br \/>\n\tbenefit cannot enure to such person as that of the post which he is<br \/>\n\tholding. It further appears that when the respondent-original<br \/>\n\tpetitioner was posted for the first time in the year 1976, he was<br \/>\n\tholding the post of Superintendent and posted as Assistant<br \/>\n\tLibrarian. At that time, he was not even holding the qualification<br \/>\n\tof Bachelor&#8217;s degree of  Library Science and Information Science and<br \/>\n\tacquired it for the first time in the year 1984. Further, after he<br \/>\n\twas posted on ad-hoc basis on 19.5.1988, his appointment on ad-hoc<br \/>\n\tbasis came to be cancelled and the Board of the University had<br \/>\n\tresolved for filling up the post of  Assistant Librarian by regular<br \/>\n\tselection process. Further, it is only  in the year 1991 that the<br \/>\n\tpetitioner acquired the qualifying degree for the post in question.<br \/>\n\tUnder these circumstances, mere factum of holding the post cannot be<br \/>\n\tconsidered as investing any additional right in favour of the<br \/>\n\trespondent-original petitioner as that of Assistant Librarian. Even<br \/>\n\tat the time when he retired, his post was that of the Assistant<br \/>\n\tAdministrative Officer though he was working as Assistant Librarian.<br \/>\n\tIn our view, if regular selection process is given a go bye and the<br \/>\n\tfactum of holding the post is read to confer benefit of a regular<br \/>\n\tsalary in favour of  a person who was not holding qualification at<br \/>\n\tthe relevant point of time when he was posted, such would not only<br \/>\n\tresult into investing right in favour of the person  who is legally<br \/>\n\tnot entitled to it but would frustrate the basic settled norms to be<br \/>\n\tobserved in public employment and the observance of regular<br \/>\n\tselection process and the conferment of the benefit to the persons<br \/>\n\tso entitled. We are more inclined to take this view because of two<br \/>\n\tpeculiar circumstances in the present case, one is that the original<br \/>\n\tpetitioner did not undergo regular selection process and another is<br \/>\n\tthat when he was posted for the first time, he did not hold the<br \/>\n\trequisite qualification for the post in question.  Under the<br \/>\n\tcircumstances, we  find that the petition was lacking merit and was<br \/>\n\tdeserving dismissal. Hence, we find that the judgment and the order<br \/>\n\tpassed by the learned Single Judge cannot be sustained.\n<\/p>\n<p>In<br \/>\n\tthe result, the appeal is allowed.
