\n    Officer, School Tribunal, Solapur.           By the said orders, the
\n    applications filed by respondent-Institution to dismiss the<\/p>\n

    appeals of the petitioners pending before it, came to be
\n    allowed and the appeals were dismissed as infructuous in<\/p>\n
    view of the order passed by Government of Maharashtra dated
\n    15\/5\/2007   of   final    closure    of    the    respondent-institution<\/p>\n
    under Rule 25(A) of Maharashtra Employees of Private Schools
\n    (Conditions of Service) Regulation Act, 1977 (hereinafter
\n    referred to as     MEPS Act    for brevity).\n<\/p>\n
    3]    The appeals before the School Tribunal had been filed
\n    by the petitioners, who were employees of the respondent-
\n    institution      questioning   the        retrenchment         notice           dated<\/p>\n
    21\/7\/2005 issued to them as per Rule 26(1) of MEPS Act by
\n    the
\n          respondent-institution.        During      the
\n    appeals, closure order dated 15\/5\/2007 of the respondent-\n<\/p>\n
                                                             pendency          of     the<\/p>\n
    institution was passed by the Government of Maharashtra.\n<\/p>\n
    The respondent-institution thereupon moved                  applications in
\n    the said appeals stating that in view of the closure order,
\n    the appeals had become infructuous.              As indicated above, the<\/p>\n
    said applications came to be allowed by the impugned orders<\/p>\n
    and the Appeals of the petitioners were dismissed. Hence,
\n    the above Writ Petitions.\n<\/p>\n
    4]    At the outset, it is noticed that the closure order<\/p>\n
    dated 15\/5\/07 was issued during the pendency of the appeal
\n    which was filed in 2005.            It is further noticed that the
\n    impugned orders are passed, based on the closure order of<\/p>\n
    the   Government     of    Maharashtra        dated        15\/5\/07          on      an
\n    interlocutory application, holding that since the appeals
\n    have become infructuous in view of the closure order, the
\n    appeals stand dismissed.\n<\/p>\n
    5]    In order to appreciate the controversy, it would be
\n    apposite to extract Rule 25A of the MEPS Rules 1981 which
\n    deals with termination of service on account of abolition of
\n    post due to closure of school.            The same reads as under :\n<\/p>\n

     Service on account of abolition of<\/p>\n
     posts –\n<\/p>\n
          [1] The services of permanent<\/p>\n
     employee may be terminated by the
\n     Management on account of abolition
\n     of posts due to closure of the
\n     school after giving him advance<\/p>\n
     intimation of three months to the
\n     effect that in the event of closure
\n     of the school, his services shall
\n     automatically stand terminated. In
\n     the case of closure of school due<\/p>\n
     to de-recognition, such advance
\n     intimation of three months shall be
\n     given by the Management to the<\/p>\n
     permanent employees after receipt
\n     of a show cause notice from the
\n     Deputy Director.\n<\/p>\n
     Explanation : For the purpose of
\n     this   sub-rule,   the   expression
\n      closure   of  the  school    shall
\n     include –\n<\/p>\n
     [i] voluntary    closure   by   the<\/p>\n
     Management of the entire school if
\n     it is imparting instruction through
\n     one medium or a part of the school
\n     comprising one or more media of
\n     instruction if it is imparting<\/p>\n
     instruction through more than one
\n     medium; and<\/p>\n
     [ii] closure of the school due to
\n     de-recognition by the Department.\n<\/p>\n
     [2] The names of the employees in
\n     aided schools, whose services stand
\n     terminated in accordance with sub-
\n     rule   (1)   on    account  of   de-
\n     recognition    and    who  are   not
\n     directly responsible for such de-
\n     recognition, shall be taken on a
\n     waiting   list   by    the Education
\n     Officer in the case of Primary and
\n     Secondary Schools or by the Deputy
\n     Director in the case of Higher<\/p>\n

             Secondary   Schools    and   Junior
\n             College of Education, and same
\n             shall be recommended by him to the<\/p>\n
             Managements of newly opened aided
\n             schools or of the existing aided
\n             schools which are allowed to open<\/p>\n
             additional divisions or classes for
\n             consideration.\n<\/p>\n
    6]   The Division Bench of this Court [Swatanter Kumar CJ<\/p>\n
    (as he then was) and A.M.Khanwilkar,J.] in the decision of
\n    Laxmi Education Society and others V\/s State of Maharashtra
\n    and others reported in 2010 (2) Mh.L.J. 837 had the occasion<\/p>\n
    to elaborately consider the scheme of closure of schools as
\n    contemplated under Rule 25-A of MEPS Act. Speaking on behalf<\/p>\n
    of the Division Bench, Justice A.M.Khanwilkar observed in
\n    paragraphs 33,34 and 35 of the judgment as follows :\n<\/p>\n
                   [33]      The    next   question    is
\n             what are the consequences of closure of
\n             the school qua permanent employees.\n<\/p><\/blockquote>\n
             That question in our opinion, will have
\n             to be addressed by the School Tribunal<\/p>\n
             in the first instance, keeping in mind
\n             the provisions of Rule 25-A of the
\n             Rules.    We have already observed that
\n             the closure of the school would be
\n             governed only by the regime of Rule 25-\n<\/p><\/blockquote>\n
             A of the Rules.      We do not propose to
\n             elaborate on this issue any further .
\n             Lest it may affect the merits of the
\n             pleas available to the Management as
\n             well    as   the     concerned     permanent
\n             employees.      All questions in this<\/p>\n
             behalf will have to be addressed by the
\n             Tribunal. Even the question as to
\n             whether    the    Tribunal     can    direct
\n             absorption of the affected permanent
\n             employees    in    the   school     on   the
\n             assumption that they have been rendered
\n             surplus due to voluntarily closure of
\n             the   School\/Junior     College     by   the
\n             Management, will have to be considered
\n             by the Tribunal in accordance with law.
\n             We do not wish to detain ourselves on
\n             those aspects.\n<\/p><\/blockquote>\n

                                    28                      wp8106-10\n\n\n          [34] The   next    question   is   :\n<\/pre>\n
     Whether the School Tribunal can examine<\/p>\n
     the question of bona fides of closure.\n<\/p><\/blockquote>\n
     In this context, we will also consider
\n     the correctness of the opinion recorded<\/p>\n
     by the learned Single Judge in the
\n     impugned decision that the Tribunal has
\n     misdirected itself in considering the
\n     said    question     inspite    of    the
\n     observations of the Division Bench in<\/p>\n
     the case of Bhagwant Kumar Sandhu, 2008
\n     (1) All MR 270.    In the first place,
\n     jurisdiction of the School Tribunal
\n     flows from section 9 of the Act, which
\n     read thus :\n<\/p>\n
          9]   Right of appeal to Tribunal<\/p>\n
     to employees of private schools –\n<\/p>\n
          [1] Notwithstanding      anything
\n     contained in any law or contract for<\/p>\n
     the time being in force, (any employee
\n     in a private school –\n<\/p>\n
          [a] who is dismissed or removed
\n     or   whose   services  are   otherwise<\/p>\n
     terminated or who is reduced in rank,
\n     by the order passed by the Management<\/p>\n
     or<\/p>\n
          [b] who is superseded by the
\n     Management while making an appointment<\/p>\n
     to any post by promotion, and who is
\n     aggrieved, shall have right of appeal
\n     and may appeal against any such order
\n     or   suppression    to   the  Tribunal
\n     constituted under section 8 ;\n<\/p>\n
          Provided that, no such appeal
\n     shall lie to the Tribunal in any case
\n     where the matter has already been
\n     decided   by  a   Court   of  competent
\n     jurisdiction or is pending before such
\n     Court, on the appointed date or where
\n     the   order  of    dismissal,  removal,
\n     otherwise termination of service or
\n     reduction in rank was passed by the
\n     Management at any time before the lst
\n     July, 1976.\n<\/p>\n

          [2] Such appeal shall be made by
\n     the employee to the Tribunal, within
\n     thirty days from the date of receipt by<\/p>\n
     him of the order of dismissal, removal,
\n     otherwise termination of service or
\n     reduction in rank as the case may be:\n<\/p>\n
          Provided that, where such order
\n     was made before the appointed date,
\n     such appeal may be made within sixty
\n     days from the said date.\n<\/p>\n
          [3] Notwithstanding       anything
\n     contained  in   sub-section  (2),   the
\n     Tribunal may entertain an appeal made
\n     to it after the expiry of the said<\/p>\n
     period of thirty or sixty days, as the
\n     case may be, if it is satisfied that<\/p>\n
     the appellant has sufficient cause for
\n     not preferring the appeal within that
\n     period.\n<\/p>\n
          [4] Every     appeal   shall    be
\n     accompanied by a fee of (five hundred)
\n     rupees, which shall not be refunded and
\n     shall be credited to the Consolidated
\n     Fund of the State.\n<\/p>\n
          It is a remedy provided to the<\/p>\n
     employee of a private school, who is
\n     dismissed or removed or whose services
\n     are terminated or who is reduced by
\n     rank by order passed by the Management.\n<\/p>\n
     All questions arising in respect of the
\n     said   grievance   will    have   to   be
\n     considered by the tribunal.      However,
\n     at the same time, that does not mean
\n     that   the   tribunal     can   undertake
\n     parallel enquiry on matters which the<\/p>\n
     Education Department is expected to
\n     examine upon receipt of intimation from
\n     the management about its proposal to
\n     close the school. Indeed, the Tribunal
\n     can incidentally go into the question
\n     of whether there is closure effected,
\n     but it does not empower the tribunal to
\n     render conclusive finding with regard
\n     to the bonafides of closure.       As we
\n     have observed in earlier part of this
\n     judgment,    even     the     Appropriate
\n     Authority of the Education Department<\/p>\n

     cannot sit over the decision of the
\n     Management to close down the School as
\n     an Appellate Authority.     The scope of<\/p>\n
     enquiry even before the Appropriate
\n     Authority of the Education Department
\n     is only to consider as to what suitable<\/p>\n
     directions are warranted in the fact
\n     situation of the case, so as to
\n     minimise the loss and hardship to be
\n     caused    to    the   stakeholders,    in
\n     particular, the students community and<\/p>\n
     the permanent employees of the school.
\n     In our view, therefore, the School
\n     Tribunal    cannot   render    conclusive
\n     finding with regard to the bona fides
\n     of the decision of the Management to<\/p>\n
     close the school. Moreover, an enquiry
\n     with   regard    to the    bonafides   of<\/p>\n
     voluntary closure will be an exercise
\n     in futility as the right of the
\n     Management to close the school can only
\n     be regulated by imposing reasonable<\/p>\n
     restrictions    in  the    interests   of
\n     general public. For, it would not be
\n     open even to the Appropriate Authority
\n     to outright reject the proposal of
\n     voluntary closure of the school, as<\/p>\n
     that would impinge upon the rights
\n     guaranteed under Article 19(1) (g) of<\/p>\n
     the Constitution.\n<\/p>\n
          [35] The next question is : Is it
\n     open to the school tribunal to consider<\/p>\n
     the issue of closure resulting in
\n     causing    prejudice  to  the   existing
\n     students of the school or prospective
\n     students and that of the society as a
\n     whole. We are afraid it is not open to
\n     the school tribunal to reopen the issue<\/p>\n
     of closure of the school, which would
\n     attain finality with the directions to
\n     be issue by the Appropriate Authority
\n     of the Education Department.         The
\n     School Tribunal in any case would be
\n     competent only to address the matters
\n     in   the    context  of  privileges   or
\n     benefits available and accrued to the
\n     permanent employees if any, on account
\n     of the closure of the School. The
\n     School Tribunal has no concern with any
\n     other    issue,   since  it   has   been<\/p>\n

                  constituted only to examine the limited
\n                  grievance   brought   before it   under
\n                  Section 9 of the Act.\n<\/p>\n
    7]     On perusal of the aforesaid paragraphs of the judgment,<\/p>\n
    it can be seen that what has been expounded by the Division
\n    Bench    is    that    notwithstanding      that    the     closure         of     the
\n    institute, the School Tribunal would address the matters in<\/p>\n
    the context of         privileges or benefits available and accrued
\n    to the permanent employees if any, on account of the closure
\n    of the institution. It is further expounded that in so far<\/p>\n
    as the closure is concerned, the school tribunal would have
\n    no concern and it would not address itself on this issue and<\/p>\n
    it would only have to examine the limited grievance brought
\n    before it under Section 9 of the said Act.\n<\/p>\n
    8]     Considering the aforesaid judgment, it cannot be said
\n    that    merely        because   the    closure   order     has     been       issued<\/p>\n
    during the pendency of the appeals, nothing would survive
\n    for consideration for the school tribunal in the appeals<\/p>\n
    pending before it.          It is also noticed that the tribunal
\n    would also, in accordance with law, have to address itself
\n    on the issue of retrenchment for the period prior to the<\/p>\n
    closure order being passed since the appeals also challenge
\n    the retrenchment notices which are subject matter of the
\n    appeal, which were filed prior to the closure order dated
\n    15\/5\/2007 and were pending at the time.\n<\/p>\n
    9]     In the circumstances, I find that the School Tribunal
\n    was not right in dismissing the appeals pending before it
\n    that too on an interlocutory application filed on behalf of
\n    the     respondent-institution.           The    impugned          orders          are
\n    therefore,unsustainable and required to be set aside and
\n    accordingly set aside.          Rule is accordingly made absolute in
\n    terms of prayer clause          B     of the petitions.\n<\/p>\n

    10]   It would be open to the petitioners to file appropriate<\/p>\n
    applications    for amendment to their appeals to bring on
\n    record subsequent events and further make any consequential<\/p>\n
    prayers, if so adviced. If such applications are filed the
\n    same shall be decided on its own merits and in accordance
\n    with law after hearing the respondent-institution.\n<\/p>\n
