SHAH\n\t\t\n\t\n\n \n\nDate\n: 25\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent petition under Article 226 of the Constitution of India, is<br \/>\nagainst the interlocutory order dated 7.12.2010\/ 10.12.2010 passed by<br \/>\nRevisional Authority &#8211; Secretary (Appeals),  Revenue  Department,<br \/>\nState of Gujarat in Revision Application No110\/2010, by which,<br \/>\nRevisional Authority has refused to stay the order dated 26.7.2010<br \/>\npassed by the Collector, Bharuch, by which, mutation entry in favour<br \/>\nof the petitioner is ordered to be set aside and the order with<br \/>\nrespect to cancellation of mutation entry in favour of private<br \/>\nrespondent, has been confirmed.\n<\/p>\n<p>2.\t\tConsidering<br \/>\nthe fact that the dispute is with respect to mutation entry and the<br \/>\npetitioner as well as private respondent are claiming title and<br \/>\nownership by way of two different sale deeds and Civil Suit is<br \/>\npending between the parties, the present petition is not entertained<br \/>\nmore particularly on the ground that as per settled proposition of<br \/>\nlaw, mutation entry in the revenue record does not confer any right,<br \/>\ntitle and interest in favour of the persons, whose names are entered<br \/>\nin the revenue record and the parties have to govern by outcome of<br \/>\nthe Civil Suit. In view of the above, the present petition is not<br \/>\nentertained and the same deserves to be dismissed and is accordingly<br \/>\ndismissed.
