JOSEPH FRANCIS, J.\n               - - - - - - - - - - - - - - - - - - - - - -\n                Crl.R.P.No. 469 of 2003\n               - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 24th day of March, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This revision petition is filed by accused 1 and 2 in<\/p>\n<p>C.C.No.103 of 1999 on the file of the Chief Judicial<\/p>\n<p>Magistrate Court, Kottayam. The said complaint was filed<\/p>\n<p>alleging commission of           the offence punishable under<\/p>\n<p>Section 138 of the N.I. Act.\n<\/p>\n<p>      2. The case of the complainant is that the first<\/p>\n<p>accused Company purchased 20,000 oil palm sprout from<\/p>\n<p>the complainant and towards the cost of the same, issued a<\/p>\n<p>cheque dt.21.12.1998. The cheque was presented by the<\/p>\n<p>complainant through their accounts in the State Bank of<\/p>\n<p>Travancore, Kottayam branch, but was bounced for<\/p>\n<p>insufficiency of funds. The complainant issued a lawyer<\/p>\n<p>notice, intimating the dishonour of the cheque and<\/p>\n<p>demanding payment. But the company has not discharged<\/p>\n<p>the liability. Accused Nos. 2 to 4 are responsible officers<\/p>\n<p>Crl.R.P.No. 469 of 2003<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>  of the accused company. Pursuant to the summons, accused 1<\/p>\n<p>  and 2 appeared before the court. Accused 3 and 4 absconded<\/p>\n<p>  and the case against them was split up. When particulars of the<\/p>\n<p>  offence were read over to the accused, they pleaded not guilty.<\/p>\n<p>         3. The complainant was examined as PW1 and Exts.P1 to<\/p>\n<p>  P11 were marked. The second accused was questioned under<\/p>\n<p>  Section 313 Cr.P.C., who denied the allegations raised. From<\/p>\n<p>  the defence side, a witness list was filed. Though steps were<\/p>\n<p>  taken, nobody could be examined.\n<\/p>\n<p>        4.  The learned C.J.M., Kottayam, on considering the<\/p>\n<p>  evidence, found accused 1 and 2 guilty under Section 138 of<\/p>\n<p>  the N.I. Act and they were convicted and sentenced.          The<\/p>\n<p>  second accused is sentenced to undergo simple imprisonment<\/p>\n<p>  for three months. The first accused is sentenced to pay a fine of<\/p>\n<p>  Rs.2,20,000\/-, which will be recovered from the assets of the<\/p>\n<p>  company and on recovery, Rs.2,00,000\/- will be paid to the<\/p>\n<p>  complainant as compensation. The case against accused 3 and 4<\/p>\n<p>  was refiled.\n<\/p>\n<p>Crl.R.P.No. 469 of 2003<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>        5. Against that conviction and sentence, accused 1 and 2<\/p>\n<p>  filed Crl.A.No. 420 of 2001 before the Sessions Court,<\/p>\n<p>  Kottayam, which was dismissed, confirming the conviction and<\/p>\n<p>  sentence.   Against that judgment accused 1 and 2 filed this<\/p>\n<p>  Revision Petition.\n<\/p>\n<p>        6. Heard the learned counsel for the revision petitioners,<\/p>\n<p>  the learned counsel for the first respondent and the learned<\/p>\n<p>  Public Prosecutor.\n<\/p>\n<p>        7.    The learned counsel for the revision petitioners<\/p>\n<p>  submitted that the petitioners are not challenging the conviction<\/p>\n<p>  of accused 1 and 2 under Section 138 of the N.I. Act and that the<\/p>\n<p>  only prayer of the petitioners is to show leniency in awarding<\/p>\n<p>  the sentence.     In the decision reported in       George     v.<\/p>\n<p>  Kamarudeen (2007 (1) KLT 759), it was held that a substantive<\/p>\n<p>  sentence of imprisonment till rising of the court would be<\/p>\n<p>  sufficient in the case of offence under Section 138 of the Act to<\/p>\n<p>  meet the ends of justice, particularly in view of the fact that<\/p>\n<p>  adequate compensation has been awarded.         In view of the<\/p>\n<p>Crl.R.P.No. 469 of 2003<br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>  principle laid down in the above decision, I am of the view that<\/p>\n<p>  the ends of justice would be met by sentencing the second<\/p>\n<p>  accused to undergo imprisonment till rising of the court and by<\/p>\n<p>  confirming the sentence to pay fine of Rs.2,20,000\/- by the first<\/p>\n<p>  accused.\n<\/p>\n<p>        8. In the result, this Crl.R.P. is allowed in part. The<\/p>\n<p>  conviction of accused 1 and 2 in C.C. 103 of 1999 on the file of<\/p>\n<p>  the Chief Judicial Magistrate Court, Kottayam under Section 138<\/p>\n<p>  of the N.I. Act is confirmed. The sentence of the second accused<\/p>\n<p>  to undergo S.I. for a period of three months is reduced and he is<\/p>\n<p>  sentenced to undergo imprisonment till rising of the court. The<\/p>\n<p>  sentence to pay a fine of Rs.2,20,000\/- by the first accused is<\/p>\n<p>  confirmed.\n<\/p>\n<p>        9. The learned counsel for the revision petitioners submits<\/p>\n<p>  that five months&#8217; time may be granted to the revision petitioners<\/p>\n<p>  to pay the fine.
