'The  has it '\n\nawarded compensation of 1?-1s..._1,15;OOoi]} 'with inte'res\"t at 6%\np.a. from the date of petition   of payment.\nAggrieved by that, theiappeliantdhasfiled. appeal, seeking\n\nenhancement.\n\n5. '}The  the appellant contended\nthat the compensation\" by the Tribunal towards loss\nof_.atnenit_i\u00e9:.s of life inadequate. He also submitted that the\n\n any compensation towards loss of\n\n:\"V\"i..fupture  loss of income during the period of\n\n_\ufb01treatn1ent,\"  needs to be awarded, He, therefore.\n\n the impugned judgment and award needs to\n\n  'V.bte.._fIiodified. L2\n\n\n\n6. As against this, the learned counsel for the 151-\nrespondent submitted that, the Tribunal on proper<\/pre>\n
consideration of the material on record, has awarded just and
\nreasonable compensation and therefore, it does not <\/p>\n
interference.\n<\/p>\n
7. I have carefully considered the   l <\/p>\n
by the learned counsel for the parties.\n<\/p>\n
8. The point that arises’ for <\/p>\n
whether the Tribunal has awardedchjuyst and ‘ ‘reasonable<\/p>\n
compensation?\n<\/p>\n
9.  the Tribunal has awarded a
\nsum of Rs.;10,pQOit’)\u00b0\/’–._:’tovifardslloss of amenities of life and a
\n “of —  disability. The appellant has<\/p>\n
suffered “of~.oecipital bone, fracture of right parietal<\/p>\n
“.__b”one and”ceerebralf~contusion and the injuries have resulted in<\/p>\n
 disability. The doctor has deposed that the<\/p>\n
  immediate memory is about 25% and the<\/p>\n
V.\n<\/p>\n
appellant will be prevented from doing his job successfully.<\/p>\n
The appellant has to suffer discomfort throughout <\/p>\n
However, there is no evidence that the appellant is ~<\/p>\n
do any work. Therefore, corripensatiorr”cannot loe’i–Vawar_(::i~ed’.,, if<\/p>\n
under the head of loss of future earninl’gs,:’.lou’t, <\/p>\n
needs to be awarded under   ”<\/p>\n
discomfort. Having regard ,t’o._the piiattiirellof__disal:\u00a7i1ity”ar1d the<\/p>\n
discomfort the appellant has r,co’r_1sidered view,
\na sum of Rs.60,0Q0′,”‘:.,Vp:would ,;be..’a’-reasojnapble sum towards
\nloss of amenities  and accordingly it is<\/p>\n
awarded.\n<\/p>\n
10. Thel”\u00a7.’_4riburiall4Vhasijlawarded a sum of Rs.5,000\/–
\ntowards  of incorri-e. during the period of treatment taking<\/p>\n
the’–incor’nepc=f’the\u00ab,appellant at Rs. 1,250 \/ – pm. The appellant<\/p>\n
 working\u00bb carpenter. Therefore, the income of the<\/p>\n
.,ll_fpi*’apppellant  be’ taken at Rs.3,000\/– pm. Accordingly, a sum<\/p>\n
 – is awarded towards loss of income during the<\/p>\n
H  treatment.\n<\/p>\n

11. The compensation awarded by the Tribiiinal<\/p>\n
towards pain and sufferings. medical and <\/p>\n
expenses is just and proper and therefore, it does not oa’lls”  ~<\/p>\n
