Venkataramana of Gokavaram,<br \/>\nAndhra Pradesh applied to CPIO Shri Tarun Kumar, Joint Secretary, Central<br \/>\nInformation Commission seeking the following information:\n<\/p>\n<blockquote><p>              &#8220;(i)   Registration or response numbers (whatever call in<br \/>\n                     Registry) of two second appeals which were sent<br \/>\n                     by this applicant on the name of Shri Shailesh<br \/>\n                     Gandhi, Information Commissioner, Central<br \/>\n                     Information commission, 4th Floor, Block-IV, Old<br \/>\n                     JNU Campus, New Delhi-110067 on first day of<br \/>\n                     April 2009 through Registered post with<br \/>\n                     acknowledgement due and another second appeal<br \/>\n                     on the name of Shri Wajahat Habibullah, Chief<br \/>\n                     Information Commissioner, Central Information<br \/>\n                     Commission, Room No. 306, 2nd Floor, B Sing,<br \/>\n                     August Kranti Bhawan, Bhikaji Cama Place, New<br \/>\n                     Delhi 110066. On second day of April 2009<br \/>\n                     through registered post with acknowledgment due<br \/>\n                     and simultaneous two         another by registered<br \/>\n                     posts with same two names and addresses.\n<\/p><\/blockquote>\n<blockquote><p>              (ii)   Present status of these two second appeals.\n<\/p><\/blockquote>\n<p>(iii)                Details of procedure of allotment of cases normally<br \/>\nfollowed in the Registry of CIC for disposal of second appeals.\n<\/p>\n<p>      This request was backed with the following plea:<br \/>\n      &#8220;This information sought for concerns the immediate danger to<br \/>\n      the life, liberty of the applicant and concerns also violation of<br \/>\n      model code of conduct in the ongoing general elections process<br \/>\n      of Two thousand nine and many more grounds. Therefore<br \/>\n      kindly provide me true, naturally processed required information<br \/>\n      without negligence, within 48 hours to the applicant only through<br \/>\n      certainly registered post only.&#8221;\n<\/p>\n<p>      To this Shri J. Venkataramana was sent a reply on 30.4.2009 by Shri<br \/>\nTarun Kumar, Jt. Secretary informing him as follows:\n<\/p>\n<p><span class=\"hidden_text\">                                      1<\/span><\/p>\n<blockquote><p>         &#8220;(i)     The appeal in the name of Shri Shailesh Gandhi,<br \/>\n                 Information Commissioner is not traceable at the<br \/>\n                 moment. Since we are not able to locate any such letter,<br \/>\n                 therefore, no necessary action has been taken. You are<br \/>\n                 requested to send us a copy of the same.\n<\/p><\/blockquote>\n<blockquote><p>       (ii)      Your two application received in the Commission in two<br \/>\n                 different envelope and has been registered vide diary no.<br \/>\n                 20102 &amp; 19855 dated 20.4.2009. However, it has been<br \/>\n                 sent to the concerned section for registration of cases.\n<\/p><\/blockquote>\n<blockquote><p>       (iii)     Another letter dated 31.3.2009 was given diary no. 18731<br \/>\n                 dated 9.4.2009 was against Department of Post. The<br \/>\n                 case has been registered and their registration no. is<br \/>\n                 CIC\/AD\/C\/2009\/323?<\/p><\/blockquote>\n<p>       From the perusal of your RTI application, it is seen that there is<br \/>\n       no issue of life and liberty. Therefore, this cannot be treated<br \/>\n       within the proviso of section 7 (1) of the RTI Act, 2005.&#8217;<\/p>\n<p>       It seems, however, that this response was not received by Shri<br \/>\nJanapareddy Venkataramana because he has moved an appeal on 4.5.2009<br \/>\nreceived in this Commission on 5.5.2009 in which he has complained of not<br \/>\nhaving received a response and accusing CPIO as below: &#8211;\n<\/p>\n<blockquote><p>        &#8220;(a)     Malaifidely, corrupting, blindly, cloudily the direction of the<br \/>\n                 third parties who rivals of this appellant by this Central<br \/>\n                 Public Information Officer.\n<\/p><\/blockquote>\n<blockquote><p>       (b)       Several illegal attempts to suppress the application and<br \/>\n                 other appeals without register and record.\n<\/p><\/blockquote>\n<blockquote><p>       (c)       Playing an oral drama with assistance of hi sub-ordinates<br \/>\n                 and others by this central public information officer to<br \/>\n                 divert the matter in another way through self rule.\n<\/p><\/blockquote>\n<blockquote><p>       (d)       Making duplication for unauthorised false information to<br \/>\n                 invalid this matter by this central public information<br \/>\n                 officer.<\/p><\/blockquote>\n<p>       (e)       Dragging on this matter corrupting, destroying the<br \/>\n                 information of this appellant and passing the information<br \/>\n                 to others by this central public information officer and<br \/>\n                 many other prospective grounds.&#8217;<\/p>\n<p>       Upon this a notice of hearing was issued by Registrar &amp; Appellate<br \/>\nAuthority, CIC, Shri L. C. Singhi on 2.6.2009 informing Shri J. Venkataramana<br \/>\nof the hearing scheduled for 10.6.2009, which also he appears not to have<br \/>\nreceived as reflected in the decision of Appellate Authority of 20.8.2009, which<br \/>\nis as below: &#8211;\n<\/p>\n<blockquote><p>        &#8220;3.      The notice sent to the appellant has returned un-served.\n<\/p><\/blockquote>\n<blockquote><p>                 I have verified the address appearing on the notice and<br \/>\n                 mentioned by the appellant in his appeal petition.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                            2<\/span><\/p>\n<blockquote><p>       4.      From the records of the CPIO, which have been<br \/>\n              presented before me, it appears that the RTI application<br \/>\n              was received on 13.4.2009 (wrongly mentioned to have<br \/>\n              been received on 30.4.2009 in the response given by the<br \/>\n              CPIO). The CPIO appears to have responded to the RTI<br \/>\n              request vide his letter no. CIC\/CPIO\/09\/568 dated 30th<br \/>\n              April 2009 issued on 1st may, 2009.\n<\/p><\/blockquote>\n<blockquote><p>      5.      It appears that the First Appeal has been filed by the<br \/>\n              appellant without having an occasion to go through the<br \/>\n              reply given by the CPIO.\n<\/p><\/blockquote>\n<blockquote><p>      6.      I presume that the appellant has, in the meanwhile,<br \/>\n              received the response of the CPIO and if he still desires<br \/>\n              to persist the matter, he can file a fresh appeal.&#8221;<\/p><\/blockquote>\n<p>      Instead we have received a second appeal from Shri Janapareddy<br \/>\nVenkataramana dated 12.5.2009 complaining of &#8220;nil&#8221; reply both from CPIO and<br \/>\nAppellate Authority and praying as follows: &#8211;\n<\/p>\n<blockquote><p>       &#8220;(a)   Immediate supply of required authenticated information to<br \/>\n              this appellant only.\n<\/p><\/blockquote>\n<blockquote><p>      (b)     Impose penalties on the central public information officer.\n<\/p><\/blockquote>\n<blockquote><p>      (c)     Disciplinary action against the Central public information<br \/>\n              officer.\n<\/p><\/blockquote>\n<blockquote><p>      (d)     Pay compensation of this appellant for the several<br \/>\n              damages in the process.\n<\/p><\/blockquote>\n<blockquote><p>      (e)     Expos\u00e9 this case to the public at large through point and<br \/>\n              electronic media.<\/p><\/blockquote>\n<p>      (f)     And any other reliefs deems fit under the law.&#8217;<\/p>\n<p>      We have received a response of 10.6.2010 from Deputy Registrar and<br \/>\nNodal CPIO Shri M. C. Sharma to our appal notice of 9.6.2010 in which he has<br \/>\nsubmitted as follows: &#8211;\n<\/p>\n<blockquote><p>        &#8220;As per record available Shri Janapareddy Venkataramana<br \/>\n      submitted an RTI application dated 8.4.2009 under RTI Act,<br \/>\n      2005 seeking information (copy enclosed). The CPIO replied<br \/>\n      the same on 30.4.2009 (copy enclosed). Not satisfied with the<br \/>\n      reply of the CPIO Shri Janapareddy Venkataramana submitted<br \/>\n      the First appeal before the First Appellate Authority and the First<br \/>\n      Appellate Authority issued a notice for hearing on 2.6.2009<br \/>\n      (copy enclosed) fixing the date for hearing on 10.6.2009. First<br \/>\n      Appellate Authority decided the matter vide decision no.<br \/>\n      CIC\/AA\/A\/2009\/227 dated 20.8.2009 (copy enclosed).&#8221;<\/p><\/blockquote>\n<p>      The responses quoted by us above with the attachments received from<br \/>\nthe CPIO&#8217;s office, which stands quoted above, are not a part of Shri<br \/>\nJanapareddy     Venkataramana&#8217;s     appeal.     The   appeal   was   heard   with<\/p>\n<p><span class=\"hidden_text\">                                       3<\/span><br \/>\n arrangement for videoconference on 8-7-2010. Only respondent Shri Tarun<br \/>\nKumar, Jt. Secretary is present.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>      From the above it would appear that appellant Shri Janapareddy<br \/>\nVenkataramana had not received a response to his original application of<br \/>\n8.4.2009. However, we have not received any further response from him with<br \/>\nregard to the orders of 20.8.2009 of Appellate Authority Shri L. C. Singhi,<br \/>\nRegistrar, CIC, passed subsequent to the registration of his second appeal.<br \/>\nUnder the circumstances we must assume that he is satisfied with this<br \/>\nresponse. Nevertheless a copy of the response to our appeal notice received<br \/>\nfrom CPIO Shri M. C. Sharma and not endorsed to appellant Shri Janapareddy<br \/>\nVenkataramana will now be endorsed to appellant Shri Janapareddy<br \/>\nVenkataramana and sent to him by speed post as a measure of abundant<br \/>\ncaution. The appeal itself having been moved on non-receipt of the responses<br \/>\nagainst which if received, we have no appeal, the present appeal is dismissed.\n<\/p>\n<p>       Announced in the hearing.
