Hira  Devi and\t that a\t declaration to that<br \/>\neffect was  already given  by the  civil  Court\t in  another<br \/>\ndecree dated  March 29,\t 1974. He filed an application under<br \/>\nOrder 39,  Rule 11 CPC for ad interim injunction to restrain<br \/>\nthe defendants\tfrom interfering  with\this  possession\t and<br \/>\nenjoyment  of  the  plaint  schedule  property\tsituated  in<br \/>\nvillage Dabbla\tKalan Tehsil Fazilka. The interim injunction<br \/>\nwas granted  on June  14, 1991 which subsequently came to be<br \/>\nvacated on  December 2,\t 1991.\tIt  would  appear  that\t the<br \/>\ndefendants alienated  the self-same lands by registered sale<br \/>\ndeeds dated December 2, 1991 and December 12, 1991 in favour<br \/>\nof the\trespondents before this Court. On the basis thereof,<br \/>\nthey sought  to come  on record as defendants under Order 1,<br \/>\nRule 10,  CPC. The  trial Court\t dismissed  the\t application<br \/>\nholding that  they were neither necessary nor proper parties<br \/>\nto the\tsuit. On  revision, the\t High Court  in the impugned<br \/>\norder  in  C.R.\t No.323\/93,  dated  May\t 13,  1993  directed<br \/>\nimpleadment of\tthe respondents\t as party  defendants to the<br \/>\nsuit. Thus this appeal by special leave.\n<\/p>\n<p>     Shri  Kapoor,   learned  counsel\tfor  the  appellant,<br \/>\ncontended that the claim for declaration of title is founded<br \/>\nupon the  registered will  executed by\this mother dated May<br \/>\n26, 1952  which was  upheld in\tan earlier suit in which the<br \/>\ndeclaration and\t possession was\t granted and  in furtherance<br \/>\nthereof the  appellant remained\t in possession.\t His  mother<br \/>\nHira Devi  left behind\thim and three sisters and one of the<br \/>\nsisters is  Rajender Kaur  whose sons  are the defendants in<br \/>\nthe suit.  The\tsecond\tsuit  came  to\tbe  filed  when\t his<br \/>\npossession was sought to be interdicted asserting their<br \/>\nright to  the property\tthrough their  mother. Pending suit,<br \/>\nwhen they  had alienated the property to the respondents. It<br \/>\nis hit\tby the\tdoctrine of  lis pendens under section 52 of<br \/>\nthe Transfer  of Property  Act. The  respondents are neither<br \/>\nnecessary nor  proper parties. In support thereof, he placed<br \/>\nreliance on  the judgment  of this  Court in <a href=\"\/doc\/255926\/\">New Redbank Tea<br \/>\nCo. Pvt.  Ltd. v.  Kumkum Mittal  &amp; Ors.<\/a> [(1994) 1 SCC 402].<br \/>\nMrs.  Rekha   Palli,  learned  counsel\tfor  the  respondent<br \/>\ncontended that\tthe declaration\t sought\t is  in\t respect  of<br \/>\nimmovable property.  Having purchased  the property,  though<br \/>\npending suit,  they are\t proper parties\t for  defending\t the<br \/>\ntitle of  their predecessor in interest. Therefore, the High<br \/>\nCourt was  right in  bringing them  on record under Order 1,<br \/>\nRule 10\t CPC. The  placed reliance  on the  judgment of this<br \/>\nCourt in  <a href=\"\/doc\/1084618\/\">Ramesh H.  Kundanmal v.  Municipal Corporation  of<br \/>\nGreater Bombay<\/a>\t[(1992) 2  SCC 524].  The ratio in either of<br \/>\nthe cases  has no  application to  the facts  in this  case.<br \/>\nTherefore, it is not necessary to refer to them in extenso.\n<\/p>\n<p>     Having  regard   to  the  respective  contentions,\t the<br \/>\nquestion that  arises  for  consideration  is:\twhether\t the<br \/>\nrespondents are\t necessary or proper parties to the suit? It<br \/>\ncannot be  disputed that  the foundation  for the  exclusive<br \/>\nright, title  and interest  in\tthe  property,\tthe  subject<br \/>\nmatter of  the suit,  is founded  upon the  registered\tWill<br \/>\nexecuted by Hira Devi, the mother of the appellant as on May<br \/>\n26, 1952.  The trial  court noted  that in a suit filed on a<br \/>\nprevious occasion  by the  appellant, the will was proponded<br \/>\nas basis  for an  exclusive right, title and interest in the<br \/>\nsaid property.\tHe  impleaded  Rajender\t Kaur,\tone  of\t the<br \/>\ndaughters of  Hira Devi,  to the  suit along  with two other<br \/>\nsisters and  suit came\tto be  decreed by the trial Court on<br \/>\nMarch 29,  1974. The  decree became  final. In view of those<br \/>\nfacts, the  necessary conclusion that can be deduced is that<br \/>\nthe foundation\tfor the\t relief of declaration in the second<br \/>\nsuit is\t the registered Will executed by Hira Devi in favour<br \/>\nof  the\t  appellant  on\t  May  26,   1952.  The\t respondents<br \/>\nindisputably cannot  challenge the  legality or the validity<br \/>\nof the\twill executed and registered by Hira Devi on May 26,<br \/>\n1952. Though  it may  be open to the legal heirs of Rajender<br \/>\nKaur, who  was a  party to  the earlier\t suit, to resist the<br \/>\nclaim on  any legally  available to  tenable grounds,  those<br \/>\ngrounds are  not available  to the  respondents. Under those<br \/>\ncircumstances, the  respondents cannot,\t by any\t stretch  of<br \/>\nimagination, be\t said  to  be  either  necessary  or  proper<br \/>\nparties to the suit. A necessary party is one whose presence<br \/>\nis absolutely necessary and without whose presence the issue<br \/>\ncannot effectually  and completely  be adjudicated  upon and<br \/>\ndecided between\t the parties.  A proper\t party is  one whose<br \/>\npresence would\tbe necessary  to effectually  and completely<br \/>\nadjudicate upon the disputes. In either case the respondents<br \/>\ncannot be  said to  be either necessary or proper parties to<br \/>\nthe suit  in which the primary relief was found on the basis<br \/>\nof the\tregistered Will\t executed by the appellant&#8217;s mother,<br \/>\nSmt. Hira Devi. Moreover, admittedly the respondents claimed<br \/>\nright, title  and interest  pursuant to\t the registered sale<br \/>\ndeeds said  to have been executed by the defendants-heirs of<br \/>\nRajender Kaur  on December  2, 1991  3nd December  12, 1991,<br \/>\npending suit.\n<\/p>\n<p>     Section 52\t of the\t Transfer of  Property Act envisages<br \/>\nthat &#8220;during  the pendency  in any  Court  having  authority<br \/>\nwithin the  limits of  India of any suit or proceeding which<br \/>\nis not\tcollusive  and\tin  which  any\tright  to  immovable<br \/>\nproperty is  directly  and  specifically  in  question,\t the<br \/>\nproperty cannot\t be transferred\t or otherwise  dealt with by<br \/>\nany party  to the  suit or  proceeding so  as to  affect the<br \/>\nright of  any other  party thereto under the decree or order<br \/>\nwhich may be made therein, except under the authority of the<br \/>\ncourt and  on such  terms as  it may  impose.  &#8221;  It  would,<br \/>\ntherefore, be  clear that  the defendants  in the  suit were<br \/>\nprohibited by  operation of  Section 52\t to  deal  with\t the<br \/>\nproperty and could not transfer or otherwise deal with it in<br \/>\nany way\t affecting the\trights of  the appellant except with<br \/>\nthe  order  or\tauthority  of  the  Court.  Admittedly,\t the<br \/>\nauthority or  order of\tthe Court  had not been obtained for<br \/>\nalienation of  those properties.  Therefore, the  alienation<br \/>\nobviously would\t be hit\t by the\t doctrine of  lie pendens by<br \/>\noperation of  Section 52.  Under  these\t circumstances,\t the<br \/>\nrespondents cannot  be considered  to be either necessary or<br \/>\nproper parties to the suit.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed  and  the  petition<br \/>\nunder Order  1, Rule  10, CPC  stands dismissed,  but in the<br \/>\ncircumstances without costs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sarvinder Singh vs Dalip Singh &amp; Ors on 2 August, 1996 Equivalent citations: 1996 SCALE (6)59 Author: K Ramaswamy Bench: Ramaswamy, K.
