The appellant Corporation has called<br \/>\n\tinto question oral judgment dated 8.7.1999 of learned Single Judge<br \/>\n\tof this Court in Special Civil Application No.2749 of 1989; whereby<br \/>\n\tthe award and order of the Labour Court ordering reinstatement with<br \/>\n\tfull backwages in favour of the respondent was modified. The<br \/>\n\trespondent had approached the Labour Court with an industrial<br \/>\n\tdispute in which his dismissal from service was under challenge.<br \/>\n\tEven as the Labour Court had, after appreciation of the evidence,<br \/>\n\trecorded the findings to the effect that the charges of embezzlement<br \/>\n\tor misappropriation were not proved, the learned Single Judge has<br \/>\n\tfound such finding to be perverse, in the sense that the respondent<br \/>\n\twas held to be negligent in discharge of his duties. Loss caused to<br \/>\n\tthe appellant did not seem to be in dispute. Thus, the impugned<br \/>\n\taward was modified by the learned Single Judge by directing that the<br \/>\n\tappellant shall pay only 75% of the backwages. As recorded in the<br \/>\n\timpugned judgment itself, the appellant had reinstated the<br \/>\n\trespondent in service and filed the petition and pursuant to exparte<br \/>\n\tad-interim stay of execution of the award 50% of the backwages was<br \/>\n\twithheld.\n<\/p>\n<p>\tIt was argued by learned<br \/>\n\tcounsel Mr.Raval that in view of the serious acts of misconduct<br \/>\n\tindulged in by the respondent, the award of backwages was required<br \/>\n\tto be confined to 50%, which was already paid and further direction<br \/>\n\tof learned Single Judge to pay interest needed to be modified in the<br \/>\n\tinterest of justice.\n<\/p>\n<p>\tHaving heard learned<br \/>\n\tcounsel and having regard to the peculiar facts and circumstances of<br \/>\n\tthe case, particularly the finding regarding fault of the<br \/>\n\trespondent, his rich record of previous defaults and failure of the<br \/>\n\tLabour Court to exercise its discretion in a judicious manner, the<br \/>\n\tappeal is partly allowed so as to modify the impugned judgment to<br \/>\n\tthe extent that the respondent shall be entitled to only 50% of the<br \/>\n\tbackwages and arrears of backwages, if any is still payable, shall<br \/>\n\tnot be paid with any interest. Remaining directions contained in the<br \/>\n\timpugned judgment are not disturbed. The appeal is disposed<br \/>\n\taccordingly with no order as to costs.\n<\/p>\n<p>\tCivil Application<br \/>\n\tNo.11862 of 2000 stands disposed, if it is still pending.\n<\/p>\n<p> \t\t\t\t\t\t(D.\n<\/p>\n<p>\tH.
