JUSTICE DEO NARAYAN THANVI\n\n\nMr. Deelip Kawadia for the petitioners.\n\n\n         Heard learned counsel for the petitioners.\n\n\n\n         Learned counsel for the petitioners has challenged the\n\nvalidity of Section 16 of the Rajasthan Land Revenue Act, 1956\n\nand Gazette Notification dated 04.07.08, issued by the State\n\nGovernment to the effect of inclusion of the village Neta Ka Guda\n\nin Tehsil Mavli (Distt. Udaipur) from Tehsil Nathdwara (Distt.\n\nRajsamand).\n\n\n\n         In our view, the powers under Section 16 of the Rajasthan\n\nLand Revenue Act are quite inclusive and it is within the domain\n\nof the State Government to evaluate division, sub-division or\n\ntehsil    by     delimiting       the    existing   geographical      boundaries.\n\nChallenge to the provisions of Section 16 of the Rajasthan Land\n\nRevenue Act after a lapse of considerable period of about 52\n\nyears, is nothing but abuse of the process of law. So far as\n\nprayer     for     entering        the     territorial   limit   of   the   village\n\nas     well      as   its    inclusion      in      Mavali       and Nathdwara,\n\nboth      of     which      are     adjoining,      is   a   policy   decision   of\n                                  -2-\n\nthe State Government issued under Section 16 of the Rajasthan\n\nLand Revenue Act. The State can do so, if the exigencies are\n\nrequired. This court cannot go into the decisions of the State\n\nGovernment with regard to the policy decision in the matter of\n\ncreation of division, sub-division, tehsil etc. However, by virtue\n\nof Section 16(B) of the Rajasthan Land Revenue Act, the\n\npetitioner   is   free   to   make   representation   to   the   State\n\nGovernment for alteration of the boundaries.\n\n\n\n      Accordingly, this writ petition is dismissed summarily.\n\n\n\n\n(DEO NARAYAN THANVI), J.
