(C) No. 35841 OF 2009\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n        Dated this the 11th day of December, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p>           Heard Sri.P.Babu, learned counsel appearing for<\/p>\n<p>the petitioner and Sri.M.Sasindran, learned counsel appearing<\/p>\n<p>for the respondents.\n<\/p>\n<p>     2. The petitioner appeared for the 5th semester B.Tech<\/p>\n<p>Degree examination in Electronics and Communication<\/p>\n<p>Engineering conducted by Kannur University in January, 2009.<\/p>\n<p>He thereafter, completed his course of study and passed the<\/p>\n<p>8th semester examination. He has also passed other semester<\/p>\n<p>examinations. The result of the 5th semester examination was<\/p>\n<p>published on 12.11.2009. The petitioner failed in the two<\/p>\n<p>papers in which he had appeared in the said examination. He<\/p>\n<p>had therefore applied for revaluation of his answer scripts in<\/p>\n<p>the said two papers by submitting Ext.P2 application dated<\/p>\n<p>26.11.2009. It is stated that the requisite fee was also paid on<\/p>\n<p>the same day.\n<\/p>\n<p>     3.   The learned counsel appearing for the petitioner<\/p>\n<p>submits that the petitioner has completed his course of study,<\/p>\n<p>WPC.35841 of 2009<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>that he has passed all the other semester examinations and<\/p>\n<p>the remaining papers of the 5th semester, that he had done<\/p>\n<p>well in the examination and that if his answer scripts are<\/p>\n<p>revalued, he is sure to secure a pass. He submits that as the<\/p>\n<p>University took more than ten months to publish the result of<\/p>\n<p>the examination held in January, 2009, unless this court<\/p>\n<p>directs expeditious revaluation, his answer scripts will not be<\/p>\n<p>revalued in the near future.       In this writ petition, the<\/p>\n<p>petitioner    seeks  a  direction   to   the  respondents    to<\/p>\n<p>expeditiously revalue the answer scripts of the 5th semester<\/p>\n<p>B.Tech Degree Examination conducted in January, 2009.<\/p>\n<p>      4.   Sri.M. Sasindran, the learned Standing Counsel<\/p>\n<p>appearing for the Kannur University submits that as per the<\/p>\n<p>stipulations in the Examination Manual, the University<\/p>\n<p>requires a minimum of 105 days to complete the revaluation<\/p>\n<p>process. He submits that if the petitioner&#8217;s application is in<\/p>\n<p>order, the University will take expeditious steps to revalue his<\/p>\n<p>answer scripts and to publish the results within the aforesaid<\/p>\n<p>period.\n<\/p>\n<p>      5. The Examination Manual is not a statutory regulation.<\/p>\n<p>It is only a manual prepared by the University for its guidance.<\/p>\n<p>WPC.35841 of 2009<br \/>\n<span class=\"hidden_text\">                              : 3 :<\/span><\/p>\n<p>The stipulations in the Examination Manual cannot, in my<\/p>\n<p>opinion, operate to the detriment of students.       A Division<\/p>\n<p>Bench of this Court has in <a href=\"\/doc\/1085668\/\">University of Kerala v. Sandhya<\/p>\n<p>P. Pai<\/a> (1991 (1) KLT 812) held that the Universities should<\/p>\n<p>hurry with applications for revaluation without wasting any<\/p>\n<p>time and that unless applications for revaluation are<\/p>\n<p>expeditiously disposed of, it will cause serious prejudice to the<\/p>\n<p>students. I am therefore of the considered opinion that the<\/p>\n<p>University should not wait for the expiry of 105 clear days<\/p>\n<p>from the date of publication of the results to complete the<\/p>\n<p>revaluation process.\n<\/p>\n<p>       I accordingly dispose of this writ petition with a<\/p>\n<p>direction to the respondents to take steps to have the<\/p>\n<p>petitioner&#8217;s answer scripts described in Ext.P2 application<\/p>\n<p>revalued and to communicate the result to him within six<\/p>\n<p>weeks from the date on which he produces a certified copy of<\/p>\n<p>this judgment before the Controller of Examinations, Kannur<\/p>\n<p>University.<\/p>\n<pre>\n\n                                  (P.N.
