SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/12\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Ms. Calla, learned APP waives service of notice of Rule on behalf of<br \/>\nthe respondent State. In the facts and circumstances of the case, the<br \/>\napplication is taken up for final hearing today.\n<\/p>\n<p>2.\tPresent<br \/>\napplication has been preferred by the petitioner-original accused<br \/>\nArjunsing @ Sunny Navalsing Bavri through<br \/>\njail to release him on parole leave so as to  enable him to prefer an<br \/>\nappeal before this Court challenging the order passed by the learned<br \/>\ntrial Court convicting him for the offences punishable under Sections<br \/>\n302, 307, 333, 188 and 135 of the IPC.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Ms. Krina Calla, learned APP and considering the fact that the<br \/>\napplicant seems to be in jail since last more than four days and so<br \/>\nas to enable the petitioner to prefer an appeal before this Court<br \/>\nagainst the order of conviction, present application is allowed and<br \/>\napplicant is ordered to be released on Parole for a period of 15 days<br \/>\nfrom the date of his released on furnishing Personal Bond  of<br \/>\nRs.5000\/- on the following conditions, that he shall;\n<\/p>\n<p>(a).\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>(b).\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c).\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d).\tmark<br \/>\nhis presence before Surat Western Railway Police Station on 4th<br \/>\nand 12th<br \/>\nday of his release between 11.00 a.m and 2.00 p.m.<\/p>\n<p>(e).\tnot<br \/>\nleave the State of Gujarat without the prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(f).\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(g)<br \/>\nsurrender his passport, if any, to the lower court within a week.\n<\/p>\n<p>(h).\tsurrender<br \/>\nbefore the jail authority on completion of 15 days from the date of<br \/>\nhis release;\n<\/p>\n<p>4.Registry<br \/>\nis directed to send the writ of this order to the jail authority<br \/>\nimmediately.
