The petitioner, a resident of Village-\n<\/p>\n<blockquote><p>                      Govindpur, P.S. Sangrampur, District-Munger, has filed<br \/>\n                      this petition under Article 226 of the constitution in<br \/>\n                      public interest pointing out inaction of the respondent<br \/>\n                      authorities in respect of one Smt. Putul Devi, Mukhiya,<br \/>\n                      Gram Panchayat Raj, Didarganj, respondent no.12<br \/>\n<span class=\"hidden_text\">               -2-<\/span><\/p>\n<p>herein.<\/p><\/blockquote>\n<p>            It is the claim of the petitioner that the said<br \/>\nSmt. Putul Devi has abused her position, has resorted to<br \/>\ncorrupt practices and has amassed wealth beyond her<br \/>\nknown resources.\n<\/p>\n<p>            In the counter affidavit, made by the<br \/>\nPanchayati Raj Officer, Munger, the allegations made<br \/>\nagainst the aforesaid Smt. Putul Devi are admitted. It is<br \/>\nstated that the Deputy Development Commissioner,<br \/>\nMunger has made enquiry on the complaints made<br \/>\nagainst the aforesaid Smt. Putul Devi. He has opined that<br \/>\nthe aforesaid Smt. Putul Devi has, in connivance with<br \/>\nher husband and the brother-in-law, misappropriated the<br \/>\npublic money allotted under several schemes. A criminal<br \/>\ncomplaint has also been lodged against the said offenders<br \/>\nfor offences punishable under Sections 406, 409, 420,<br \/>\n467, 468, 471 read with 34 I.P.C. and is registered as<br \/>\nSangrampur P.S. Case No.67\/10.\n<\/p>\n<p>            Learned Advocate Mr. Subodh Kumar Jha<br \/>\nhas appeared for the petitioner. He has submitted that<br \/>\nthough criminal complaint has been lodged against the<br \/>\naforesaid Smt. Putul Devi, it is in respect of a few of the<br \/>\nincidences and all the incidences of corrupt practices<br \/>\nresorted to by her have not been included in the first<br \/>\ninformation report. He has also submitted that though<br \/>\nthere are complaints against the said Smt. Putul Devi,<br \/>\nwhich have been, prima facie, found to be true, the<br \/>\nrespondent authorities have failed to take action for<br \/>\nremoval of the said Smt. Putul Devi.\n<\/p>\n<p>            We quite appreciate the anxiety shown by<br \/>\n<span class=\"hidden_text\">                          -3-<\/span><\/p>\n<p>          the writ petitioner. We also wonder why the respondent<br \/>\n          authorities have not taken action against the elected<br \/>\n          Mukhiya for abusing her authority and for indulging in<br \/>\n          corrupt practices.\n<\/p>\n<p>                      In above view of the matter, we direct the<br \/>\n          State Government and the Commissioner, the respondent<br \/>\n          no. 6 to consider the matter and to exercise the power of<br \/>\n          removal of elected Mukhiya after following due<br \/>\n          procedure. We trust that the above respondents will pay<br \/>\n          immediate attention to this matter.\n<\/p>\n<p>                      Subject to the above direction, Petition is<br \/>\n          disposed of.\n<\/p>\n<p>                               (R.M.
