17 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nDHIRAJ M PATEL for\nPetitioner(s) : 1, \nNone for Respondent(s) : 1 -\n18. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAVI R.TRIPATHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe petitioner is<br \/>\nbefore this Court being aggrieved by an order passed by the Special<br \/>\nSecretary, Revenue (Appeals) in MVV\/Hakk\/ST\/66\/10 dated 30.10.2010<br \/>\n(Annexure-K), whereby the SSRD was pleased to reject the application<br \/>\nfor interim relief.\n<\/p>\n<p>2.\tLearned Senior<br \/>\nAdvocate Mr.Kavina appearing with learned Advocate Mr.Diraj M.Patel<br \/>\nfor the petitioner submitted that if this order is allowed to<br \/>\noperate, whereby the entries in favour of the petitioner, who is the<br \/>\npurchaser of the land in question by registered sale deed, may be<br \/>\ndealt by the parties and may unnecessarily create interest of third<br \/>\nparty and may add to multiplicity of proceedings.\n<\/p>\n<p>3.\tThe submission is<br \/>\nfound acceptable and therefore, the authorities are directed to keep<br \/>\nall the four  entries in a &#8216;Disputed Entry Register&#8217;, so as to see<br \/>\nthat any person, who proposes to purchase this property, will be put<br \/>\nto notice that the property is having a pending litigation.\n<\/p>\n<p>\tIt goes without saying<br \/>\nthat the revenue entries are only for fiscal purpose and they do not<br \/>\ndecide title of the property and that is why, all these entries will<br \/>\nbe subject to outcome of Regular Civil Suit No.449 of 2010 filed in<br \/>\nthe Court of learned Principal Senior Civil Judge, Surat.\n<\/p>\n<p>4.\tWith these<br \/>\nobservations, the petition is disposed of.\n<\/p>\n<p>(Ravi<br \/>\nR.Tripathi, J.)<\/p>\n<p>*Shitole<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Hiteshbhai vs Ranjanben on 20 December, 2010 Author: Ravi R.Tripathi,&amp;Nbsp;
