\tPresent
\napplication accompanies the main appeal being First Appeal No.435 of
\n1995 which arises out of the award dated 30\/7\/1994 passed by the
\nMotor Accident Claims Tribunal (Main), Ahmedabad (Rural) at Mirzapur,
\nAhmedabad in MACP No.439 of 1987.  The appellant insurance company
\nhas challenged the directions passed by the learned Tribunal in the
\naforesaid award.  By the award impugned in the appeal, learned
\nTribunal has awarded compensation to the tune of Rs.4,30,800\/- with
\ninterest at the rate of 15% in favour of claim petitioner and
\nrespondent no.4 and 5.  The learned Tribunal has directed that
\nrespondent nos.2, 3 and 7 (in claim petition No.439 of 1987) shall be
\njointly and severally responsible to pay sum of Rs.4,30,800\/-.
\nAggrieved by the award, the appellants preferred the appeal.\n<\/p>\n
\tThe
\nappellants applicants also preferred, along with the First Appeal,
\npresent application praying for stay of the said award.  After
\nhearing the appellants applicants the Court passed below mentioned
\norder on 10\/12\/1995.\n<\/p>\n
\t Rule.\n<\/p>\n
 Ad interim relief in terms of para 4(A) on condition that the
\npetitioners deposit on amount of Rs.3,30,000\/- (Rupees three lacs and
\nthirty thousand only) together with proportionate interest and cost
\nwith the Tribunal.  On deposit of the amount, the Tribunal will pass
\norder as regards disbursement and investment of the amount deposited.
\n If the petitioners have deposited any amount in excess of the
\naforesaid amount, the petitioners will be at liberty to withdraw the
\nsame.  The petitioners may retain the rest of the amount with them on
\ncondition that in case they lose in appeal and are required to pay
\nthe balance amount or any part thereof, the petitioners will pay the
\nsame with interest as may be directed by the Court.  Order that may
\nbe passed by the Tribunal as regards investment and disbursement of
\nthe amount shall be reported to this Court immediately.\n<\/p>\n
\tIt
\ncan be seen that the Court directed the applicants appellants to
\ndeposit Rs.3,30,000\/-.\n<\/p>\n
\tLearned
\nadvocate Mr. Thomas for learned advocate Mr.Nanavati appearing for
\nthe applicants submitted that the amount of Rs.3,30,000\/- with cost
\nhas been deposited.\n<\/p>\n
\tThe
\norder dated 10\/2\/1995 appears to have continued until now without any
\nmodification.  After the order was passed, the application does not
\nappear to have been prosecuted and\/or heard further.\n<\/p>\n
\tToday,
\nwhen the application is taken up, applicants’ advocate is not
\npresent.\n<\/p>\n
\tThere
\nis nothing on record which would clarify the position obtaining as on
\ntoday particularly on the point as to whether the learned Tribunal
\nhas carried out the order with regard to the disbursement and
\ninvestment or not.\n<\/p>\n
\tIn
\nthe facts and circumstances, following order is passed:\n<\/p>\n
The
\n\tRegistry shall call for the report from the officer of the Nazir of
\n\tlearned Tribunal with regard to compliance of order dated 10\/2\/1995
\n\tpassed in captioned Civil Application.\n<\/p>\n
The
\n\tclaimant shall deposit the balance i.e. difference between the
\n\tamount directed by order dated 10\/2\/1995 and the amount required to
\n\tbe paid as per the award impugned in the appeal.  The said
\n\tbalance\/difference amount shall be deposited with the Tribunal on or
\n\tbefore 30\/4\/2010.\n<\/p>\n
After
\n\tthe amount is deposited, the learned Tribunal shall immediately
\n\tinvest the said amount in fixed deposit in a nationalised bank in
\n\tthe name of Nazir of the Tribunal. The amount towards proportionate
\n\tcost and interest, not deposited by the appellant shall also be
\n\tdeposited on or before 30\/4\/2010 and such amount shall also be
\n\tinvested in fixed deposit along with the aforesaid amount.  The
\n\tinterest shall be accumulated and will not be disbursed\/paid until
\n\tfurther order by the Court.\n<\/p>\n
The
\n\tfixed deposit shall be initially taken out for a period of three
\n\tyears and thereafter it will be renewed without further orders until
\n\tfinal decision in the appeal.\n<\/p>\n
Since
\n\tthe appeal is pending since 1995, the Registry is directed to list
\n\tthe appeal for final hearing in the week beginning from 21\/6\/2010.\n<\/p>\n
Fresh
\n\tnotice intimating the date of final hearing of the appeal shall be
\n\tissued forthwith.\n<\/p>\n
The
\n\tapplicants appellants shall confirm with the Registry that the
\n\taddress of the opponents mentioned in the cause title are accurate
\n\tand continue to be the same as of now.  If there is any change the
\n\tsame shall be informed to the office on or before 15\/4\/2010.\n<\/p>\n
\tWith
\nthe aforesaid direction and clarification, the ad interim relief
\ngranted earlier is confirmed with the aforesaid modification.  It is
\ndirected that the amount deposited earlier shall continue to abide by
\nthe terms and conditions mentioned in the order dated 10\/2\/1995 but
\nwith aforesaid modification and further clarification and direction
\nthat the amount deposited earlier and the amount which may now be
\ndeposited after this order shall remain invested (after the
\ndisbursement as mentioned in the order dated 10\/2\/1995) and the
\nTribunal and\/or the Bank shall not permit the respondents to create
\nany charge and\/or raise any loan against the fixed deposit amount.
\nThe respondents also will not create any charge and\/or raise any loan
\nagainst the fixed deposit.\n<\/p>\n
\tThe
\ncivil application stands disposed of with aforesaid clarification,
\nmodification and directions.\n<\/p>\n
