Nalini Jain\nRespondent Counsel :- G.A.\n\nHon'ble Uma Nath Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Ashwani Kumar Singh,J.\n<\/p>\n<p>Heard learned counsel for parties and perused the materials on record.<br \/>\nLearned counsel for the appellant submitted that earlier this appeal was<br \/>\nnot listed with other three criminal appeals namely; 2145 of 2009, 2149<br \/>\nof 2009 and 2190 of 2009 on 25.11.2009, therefore, only the co-<br \/>\naccused-appellants were granted bail. Learned counsel for the appellant<br \/>\nfurther submitted that the case of appellant is not different from that of<br \/>\nother co-accused appellants except that he caused abrasions to the<br \/>\ndeceased, whereas, the aforesaid appellants in connected matters caused<br \/>\ninjuries to prosecution witnesses and further that all the accused-persons<br \/>\nhave been convicted with the aid of Section 34 I.P.C. only.<br \/>\nLearned State counsel also does not have any ground to refute the<br \/>\nsubmissions of learned counsel for the appellant.<br \/>\nIn the connected appeal, we have passed the following order :-<br \/>\n&#8221; Heard learned counsel for appellants and learned A.G.A. for State,<br \/>\nand perused the record.\n<\/p>\n<p>This order shall also dispose of prayers for suspension of sentence of<br \/>\nco-accused Babu Badhai and Bhagauti in Criminal Appeal No. 2149<br \/>\nof 2009 and Criminal Appeal No. 2190 of 2009.\n<\/p>\n<p>Learned counsel for appellants submits that the incident took place<br \/>\nover a trivial matter regarding cattle grazing, and the accused<br \/>\nappellants caused the alleged injuries without premeditation. It is also<br \/>\na submission of learned counsel that the fatal injury noticed on the<br \/>\nchest was caused with spear which has been attributed to accused<br \/>\nChhotkau. The deceased had received only three injuries, namely, one<br \/>\nspear wound and two abrasions. As per the cross examination of<br \/>\ndoctor, two abrasions noticed on the dead body could come as a result<br \/>\nof friction against some hard object. Besides, the wounds caused to<br \/>\nthe injured witness have been found to be simple only. The accused<br \/>\nappellants have been convicted with the aid of Section 149 I.P.C. and<br \/>\nthus, the Court may take into consideration the individual role of<br \/>\neach of the accused appellants.\n<\/p>\n<p> Submissions of learned counsel are founded upon the facts and<br \/>\nevidence as noticed in the impugned judgement, and thus learned<br \/>\nState Counsel does not have a cogent ground to refute the same.<br \/>\nIn view of all the above, we accept the prayers for grant of suspension<br \/>\nof jail sentence as well as stay of recovery of fine qua accused<br \/>\nappellants Munna alias Ram Dutt, son of Ram Milan, Babu Badhai,<br \/>\nson of Munna alias Ram Dutt and Bhagauti son of Samay Deen, all<br \/>\nresidents of Village-Kanjahi Purwa, H\/o Birwa Fakir, Police Station-<br \/>\nKaudiya, District-Gonda. It is, thus, directed that the jail sentence as<br \/>\nwell as recovery of fine qua appellants Munna alias Ram Dutt, Babu<br \/>\nBadhai and Bhagauti shall remain suspended during the pendency of<br \/>\nappeal and they shall be released on bail on each of them furnishing<br \/>\nbail bonds to the satisfaction of learned Sessions Judge, Gonda.&#8221;<br \/>\nSince the accused-appellant herein only caused abrasion and no other<br \/>\nspecific role has been attributed to him and it is apparent from the<br \/>\nrecord that accused Chhotkau has caused fatal injury to the deceased<br \/>\nwith spear, we are inclined to accept the prayer for grant of relief .<br \/>\nIn view of the position being clear, without expressing any opinion on<br \/>\nmerits, we allow the prayer for suspension of jail sentence and stay of<br \/>\nrecovery of fine. Thus, the jail sentence and recovery of fine as imposed<br \/>\nupon accused-appellant Ram Jas son of Samokhan Chamar, resident of<br \/>\nVillage Kanjahi Purwa, H\/o Birwa Fakir, police station Kaudiya,<br \/>\nDistrict Gonda shall remain suspended during the pendency of appeal,<br \/>\nand he shall be released on bail subject to his furnishing bail bonds to<br \/>\nthe satisfaction of learned Sessions Judge, Gonda.<br \/>\nOrder Date :- 4.1.2010<br \/>\nRK\/*\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ram Jas vs State Of U.P. on 4 January, 2010 Court No. &#8211; 2 Case :- CRIMINAL APPEAL No. &#8211; 2188 of 2009 Petitioner :- Ram Jas Respondent :- State Of U.P.
