The trial\t court\tdis-\nmissed the amended suit for mandatory injunction to  restore\nthe  supply. The First Appellate Court decreed the  suit  on\nthe  sole ground of non-service of notice as required  under\ncondition  No. 36 in regard to supply of electricity by\t the\nappellant.  It\tdid not go into the allegation of  theft  of\nelectricity  by the plaintiff. The High Court dismissed\t the\nappeal.\nDismissing the appeal by special leave, this Court,\n    HELD: 1. The licensee undertaking is performing a public\nduty  and  is governed by a special statute.  The  law\talso\ncontemplates  service  of a notice before  disconnection  of\nsupply of electricity. The appellant cannot also be  allowed\nto go back upon its words and refuse the consumer the  bene-\nfit  of\t notice as contemplated by the agreement.  The\tsuit\nwas,  therefore,  rightly  decreed by  the  First  Appellate\nCourt. [735B-C, A-B]\n    2. The plaintiff is seriously denying the allegation  of\ntheft.\tIt is not possible to assume the accusation as\tcor-\nrect without a full-fledged trial on this issue. The  courts\nbelow  have  not examined the case on merits.  The  question\nwhether\t the allegations are true or not has to be  examined\nand decided in an appropriate proceeding. The appellant will\nnot,  therefore, be prejudiced in its claim by dismissal  of\nthe appeal. [734G-H, 735C]\n    Jagarnath  Singh  v.B.S. Gujananip for\t the<br \/>\nAppellant.\n<\/p>\n<p>Prem Sunder Jha for the Respondent.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    SHARMA, J. This appeal by special leave arises out of  a<br \/>\nsuit filed by the respondent-company against the  appellant,<br \/>\nMunicipal  Corporation of Delhi, for a mandatory  injunction<br \/>\nto restore the supply of electricity discontinued during the<br \/>\npendency  of  the suit. Initially the suit was filed  for  a<br \/>\nprohibitory  injunction\t from  disconnecting  the   electric<br \/>\nconnection. The plaint was amended following stoppage of the<br \/>\nsupply of energy.\n<\/p>\n<p>    2. According to the plaintiff&#8217;s case, the suit had to be<br \/>\nfiled  as  the\tDelhi  Electricity  Supply  Undertaking\t was<br \/>\nthreatening  disconnection  without disclosing\tany  reason.<br \/>\nSubsequently,  some  officers  of the  Undertaking  made  an<br \/>\ninspection  of the meters and alleged theft  of\t electricity<br \/>\nafter  tampering  with the seals affixed on  the  meters.  A<br \/>\nFirst Information Report was lodged with the police.\n<\/p>\n<p>    3.\tAdmittedly no notice was served by the\tDelhi  Elec-<br \/>\ntricity Supply Undertaking on the plaintiff before  severing<br \/>\nthe  electric connection. The learned trial court,  however,<br \/>\ndismissed  the\tsuit and the plaintiff appealed.  The  First<br \/>\nAdditional  District  Judge,  Delhi, who  heard\t the  appeal<br \/>\ndecreed the suit on the sole ground of nonservice of  notice<br \/>\nas  required under condition no. 36 in regard to  supply  of<br \/>\nelectricity by the appellant. The Delhi High Court dismissed<br \/>\nthe  appellant&#8217;s second appeal at the admission stage  by  a<br \/>\nreasoned judgment.\n<\/p>\n<p>    4.\tThe learned counsel for the appellant has  contended<br \/>\nthat  in  view of the conduct of the plaintiff\tin  stealing<br \/>\nelectricity,  the Court should in its discretion  refuse  to<br \/>\nissue a direction for restoration of the electric supply. We<br \/>\nare  afraid, it is not possible to agree with the  appellant<br \/>\nfor more reasons than one. The plaintiff is seriously  deny-<br \/>\ning the allegation of theft and it is not possible to assume<br \/>\nthe  accusation as correct without a full-fledged  trial  on<br \/>\nthis  issue. The case of Jagarnath Singh  v.B.S.  Ramaswamy,<br \/>\n[1966] 1 SCR 885; relied upon on behalf of<br \/>\n<span class=\"hidden_text\">735<\/span><br \/>\nthe  appellant\tis clearly distinguishable inasmuch  as\t the<br \/>\nconsumer  in that case was convicted under the Indian  Penal<br \/>\nCode,  and  the conviction was being maintained\t in  appeal.<br \/>\nBesides, the service of notice is a prerequisite for discon-<br \/>\nnection,  and  the appellant can not be allowed to  go\tback<br \/>\nupon its words and refuse the consumer the benefit of notice<br \/>\nas  contemplated by the agreement. The learned\tcounsel\t for<br \/>\nthe appellant urged that the Delhi Electric Supply Undertak-<br \/>\ning will seriously suffer if this view is upheld. We do\t not<br \/>\nunderstand  as to what is the difficulty in the way  of\t the<br \/>\nappellant  to serve a notice on the consumer before  discon-<br \/>\ntinuing the supply. It has to be appreciated that the licen-<br \/>\nsee Undertaking is performing a public duty and is  governed<br \/>\nby  a special statute and the law also contemplates  service<br \/>\nof  a notice before disconnection of supply of\telectricity.<br \/>\nThe  courts  below  have made it clear that  they  have\t not<br \/>\nexamined  the  case  on merits.
